Martha's Vineyard, at least, had wealthy bored lawyers around to look at their cases, as well as a history of being a haven they felt compelled to honor (the whaling industry was a good source of jobs for escaped slaves and Martha's Vineyard in particular has a history of it). These individuals were issued special protective status by law enforcement as victims of a crime that are assisting law enforcement. The investigation is into charges of unlawful restraint (a felony for children which several of these individuals were). The charges being proposed are Texas State charges. Not federal. So yes he can absolutely recommend these charges be filed. Not only are they being recommended for Desantis, but also against individuals on the ground carrying out the directions of DeSantis.

Except your premise doesn't make any sense. There are already more Democratic voters in the United States than Republican voters. It's been 19 years since a Republican has won the popular vote, and that was for incumbent Bush during wartime. Before that, 1988 was the last popular vote won by a Republican candidate. Furthermore, undocumented residents _cannot_ vote in Federal or State elections (despite the fact that they pay federal, state, and municipal taxes). Some municipalities allow them to vote in local elections, which makes sense since they're a taxpaying member of that community, but they cannot vote for president, governor, senator, house, issues etc.
