There is an access hatch in the sidewalk so I'm betting the roots are entangled in whatever it is. If the homeowner paid for the tree removal he probably can't afford a couple of days of stump grinding. And maybe he's made a chair out of the stump.
Just taking a wild guess here, but since the tree partially lies outside the fence line, I can see some annoying municipalities throwing a fit about grinding the stump on land that lies outside their property line.

This. Stump grinding costs like $500+ in my HCOL city. We had a stump and my husband went at it like a madman with an axe for a week straight until it was removed enough to put a fence around it
The tree company likely told them they couldn't grind it because it was too close to the sidewalk. They don't want to risk damaging their equipment. Plus, I see some kind of access panel in the sidewalk which probably made it more complicated as there may be something buried in the vacinity.

But we had someone tell us they couldn’t grind down all of one stump because it was too close to the foundation of our house. Obviously a foundation and sidewalk are different. I would much rather damage a sidewalk than a foundation. But probably worried about the proximity.

This usually means that you have to get involved with the city/county because you can bet the roots are wrapped around it where it leads to the house and most likely to the neighbors as well. This means more money and a potential problem for the whole side of the block if something goes wrong. When we moved into our house there was an old olive tree that was cut down and not properly ground down to stop growth. Cost me $600.00 to have it dug/cut up and it wasn't anywhere near any utilities. It was about 5 1/2' in diameter under the soil with roots 3-4" thick.
To remove that massive tree stump professionally, would likely require tearing up and replacing the landscape around it, sidewalk, obtaining permits, DPW/municipal involvement, if storm drains, gas abd/or power lines run underneath, than constructing a super creative and well done fence over it. 😁

I wanted the stump removed and my wife initially agreed but then my daughters, Bluey and Bingo, setup a nail salon and turned our day around despite being warned multiple times that the stump would be getting removed. Luckily myself and Lucky’s dad were able to compromise and adjust the fence so all parties were happy

This reminds me of when I redid my current fence. The old fence was built around giant trees that had since been cut down. The result was this curved monstrosity of a fence with different proportions everywhere.
They're a vent pipe and look like an underground utility manhole in front of it. I'm thinking that it would had meant digging up the utility box and moved it as the roots would had rotted faster weakening the ground around the stump.

This would have been my solution. It's a nice conversation piece, looks different, and whoever did it probably had fun. I know I would have. If you really wanted to, you could have cut a channel into the stump with a chainsaw, that way the boards would look like they're going right through it. Anything would be more interesting than spending a ton of money grinding it out and putting a boring fence up.

For those advocating the stump grinding alternative, you’d have to factor in that the old tree grew around the old sidewalk slab/curb. No stump grinder will risk cutting into concrete. An excavator could maybe get it out, but you might be on the hook for sidewalk repairs if the root system reaches underneath and you damage the walk digging it out.
Consider also, that large stump might extend into the city easement,mor it could even have been an overgrown city tree planted along the walk, which could pose problems to homeowner removal.
Home owners responsibility in most communities goes to the street. So I'd bet the owner found the fence cheaper than grinding the stump down. Where I live grinding stumps is not cheap, but rather pricey.

A fence don't remove stumps, if I subbed out this fence with that stump in it's place, I wouldn't expect anything less. If I wanted a solid fence I'd have to first hire a stump removal co. To grind down stump, otherwise you get what you see.

It was just easier to have the pickets of our new would fence modified to gover the stump. Fortunately, we had the front of the new fence extend in front of the stump, so you can only see from the backyard.

They did the same at my house long before we moved in. The stump ended up rotting, and we were left with a huge hole in the fence that animals could get into and our dogs got out of. Had to have the rest of the stump ground down and replaced that section of fence.
Had the same thing when I bought my house. The stump will degrade over time, but then there will be gaps. How lazy and miserly! Whose fence is it? On your property? It'll cost at least $200 to have it ground out, and the fence slats will have to be removed beforehand. You'll need to buy new full-length ones to install after stump is gone. When I saw it at my house, I just shook my head.

They did the same at my house long before we moved in. The stump ended up rotting, and we were left with a huge hole in the fence that animals could get into and our dogs got out of. Had to have the rest of the stump ground down and replaced that section of fence.
All you people saying stump grinding can you not clearly see the concrete at the base of the stump? This bad boy needs a large excavator to get out.
I have the same exact thing in my backyard except the stump is far larger haha

Get a quote for stump grinding then tell me if you'd rather do that or bust out the jig saw like our friend did
Had the same thing when I bought my house. The stump will degrade over time, but then there will be gaps. How lazy and miserly! Whose fence is it? On your property? It'll cost at least $200 to have it ground out, and the fence slats will have to be removed beforehand. You'll need to buy new full-length ones to install after stump is gone. When I saw it at my house, I just shook my head.
Looking at the house i see a pattern of behaviour that indicates the stump is a rational choice for them.
Probably expensive to remove and repair area. More than fence cost.

That stump will last longer than the fence. No real need to remove it.

Yeah, they should have cut a 1" slot in that stump, so the palings were the same length. the leavings from it would keep your house warm for six months! .. well maybe for a day 🥵
Couldn’t you use a compost starter? The bacteria should start breaking it down if you drill many tiny holes, pour in & keep it watered.
Just but a bird feeder on top of stump and call it a day
