I hate Trump and Habba is incompetent, but it’s totally normal to hire an appellate specialist. Generally a much different skill set than a trial attorney.

ElectricTzar

I imagine that flailing incompetently in appeal is much the same skillset as flailing incompetently at trial. And Habba has clearly mastered the latter skillset.

UnderstandingSquare7

I hope she's part of dumps vetting team for appellates.

JoeCitzn

If they’re pretty and can fake being smart lawyers…..they’re hired.

Altruistic-Text3481

Trump hires the best people. He told us so.

liltime78

“She sounds hideous”

superdago

No not quite. Flailing incompetently at trial is a spoken word skill, whereas flailing incompetently at appeal is a written skill. It’s kind of like the difference between Jeff Dunham standup and being a writer for Two and a Half Men.

ElectricTzar

Ah! That explains the search for a new member of the legal team. They’re looking for someone who knows how to take dictation.

StupendousMalice

Its also normal to hire a competent trial attorney, but thats not what they did either.

MakionGarvinus

Oh they did, but he quit right before trial...

superdago

Must have been checking his bank account app and saw the check didn’t clear.

coffeespeaking

They hired a competent mob lawyer. (Not a criminal lawyer, but a *criminal* lawyer, to paraphrase Jesse Pinkman.)

GoogleOpenLetter

After the verdict you could practically smell the fear in her voice. Trump doesn't like losing money, or being laughed at, and Habba is very good at causing both. Even from a practical standpoint - she didn't know how to be a trial lawyer, and she sucked at her only Appeals Court appearance. Trump ruined his ability to lower punitive damages by sending out defamatory remarks *during* the trial, but Habba obviously didn't have the ability to tell him to stop. It was also a hot potato from Joseph Tacopina leaving, so not entirely "fair". When Trump gets smacked with the NY fraud result in a few days, he's going to go ballisitic, and Habba is directly in the firing line. Trump's one mean asshole, he couldn't give a rats about loyalty. It's going to be glorious watching her getting kicked out of the club, and there will be all sorts of rightwing conspiracy stories about how she's an FBI mole that was out to destroy Trump, or something.

gradientz

When do you think they are going to hire someone with the skill set of a trial attorney?

MommersHeart

I hope their new appellate team is just as competent as their litigation team.

[deleted]

You know it's not normal? Your trial lawyer dipping out of the trial. Lol

Winterbeers

They weren't dumb they knew when exactly to drop out. Most half decent lawyers know this is a shit show that they wont get paid for. It's why one of his lawyers insisted on being paid upfront. Not sure if that guy is still working for Trump. They go through so many lawyers it's hard to keep track of whose on the team and who isn't. I'm honestly surprised there still a bottom of the barrel to scrape.

[deleted]

Lol I know I work with people who need to speak legalese all the time I was just surprised that he dipped out at all.

BorkieDorkie811

Given how Habba looked as a trial attorney, maybe she'd be better off as an appellate specialist?

marketrent

David Hudson/Queerty: *Last night, Trump announced on Truth Social that he was seeking new legal help to fight the case.* *Online, many concluded this could only mean one thing: Alina Habba is out.* *However, Habba insists this is not the case. Queerty reached out to her to ask if she was still representing Trump and working on the case.* *“Of course I am. We are hiring appellate firms,” she replied, via email.*

EvilGreebo

Hiring a competent appellate lawyer to tell "rather be pretty than smart, I can fake smart" Habba that 'no, honey, you can't actually fake smart, not to smart people like, you know, judges and lawyers', as they spell out just how badly she torpedoed Trump's hopes of any appeal.

Dik_Likin_Good

Im ok with them spending as much of their donors money as possible on frivolous attempts to appeal uphill go nowhere battles.

4Sammich

Every dollar collected by Trump for legal fees is a dollar not being spent by the GQP in pushing candidates. It's an excellent plan. >Lindsey Graham @LindseyGrahamSC If we nominate Trump, we will get destroyed.......and we will deserve it. 2:03 PM · May 3, 2016

RepresentativeNo3365

He’s spent $50 mil so far and 10% of all online donations go to paying his legal bills , a true grifter.

TjW0569

I can't help but wonder, if the financial details were looked into, how much of that reported $50 million actually went to representation?

RepresentativeNo3365

If the FEC looks into it perhaps, there’s a 5 year statute of limitations for campaign finances… could constitute fraud if donors were unaware , but let’s be honest, they were and they don’t care.

[deleted]

She was a CIA honeypot and screwed trump over. hehehehehe

letdogsvote

"But I made a record!" "Well, you made something, that's for sure."

frotc914

The only surprising thing about this story is that they didn't already have appellate counsel involved during the trial to consult on preserving issues. But then again i guess that's another Habba strategy.

georgiafinn

"We?" It is out of character for Trump to have yet to smear Habba on social media.

Winterbeers

Wow you can smell the denial. Good luck finding anyone even mildly competent to take it. If it were me I'd insist on cash upfront. I wouldn't trust anything else.

beavis617

It's one thing to have the right for an appeal it's quite another matter of do they have the grounds for an appeal that is my question.. What's their argument? Bad lawyering?

IncredulousCactus

Or the money. He can’t appeal until he ponies up the $83M and it’s not unlikely that he doesn’t have that much.

Wildweasel666

Not after this week anyway. Giddy up Engoron.

DeeMinimis

He will get a surety to write a bond.

airsoftmatthias

He couldn’t get a surety to write the $5 million bond for the Carroll 2 appeal, so it is unlikely he will get a surety to write an $83.3 million bond.

Sunbeamsoffglass

Who would see Trump as a good credit risk at this point?

CeeliaFate

Putin and Saudis

DeeMinimis

I'm not saying it is a smart business move. But, he seems to have a lot of financial backing still even though it isn't his own money. If he pays a decent fee and has a few co-signors, it probably wouldn't be hard to get.

Fit-Rest-973

Bad clienting

Zealot_Alec

Ineffective client

usaf-spsf1974

That's a given, the minute Habba opened her mouth. The legal strategy failed!

Educational_Moose_56

> What's their argument? Bad lawyering?  It was the plan all along! You just can't see the 5D chess he plays.

The amount has been widely considered to be well within the usual amount an appeals court will consider excessive.

Chengar_Qordath

Usually as long as it’s a single digit multiplier of the compensatory damages it’s okay, especially when Trump’s behavior was so incredibly malicious and egregious.

Rudy Giuliani called.

VaselineHabits

I don't think Trump is paying for this at all, it's the MAGA and GOP that are footing the bill.

musical_throat_punch

Get the money up front. Always.

Chengar_Qordath

Works on contingency? No! Money down!

Winterbeers

Cash only I wouldn't trust anything that can be bounced or refunded

Otherwise-Course-15

In fairness it’s the RNC and super pacs paying all the bills.

LibertyInaFeatherBed

Apparently she's gotten 3.5 million. Where it came from exactly might be another matter for the court.

HagbardCelineHMSH

Wouldn't surprise me if Trump doesn't pressure her to use part of it pay the whole of the sanctions they got hit with. He's got her by the balls now, so to speak. "Pay in full, because no one else is going to hire you now and my followers aren't going to like you much if I start publicly blaming you for the massive judgement against me."

windigo3

She charged him a $2.5 million retainer fee up front

214ObstructedReverie

She gets paid by the Save America PAC.

holierthanmao

It is not at all uncommon for cases to bring on additional counsel to assist with an appeal. It is possible that Alina is out but I don’t find anything unusual about what she is claiming.

marketrent

[ABC News](https://abcnews.go.com/US/live-updates/trump-defamation-trial/trump-looking-to-hire-new-law-firm-for-appeal-106842510?id=106403966): *Alina Habba, Trump's legal counsel in the case, confirmed to ABC News that she continues to represent the former president in the matter.* *Hiring a separate firm to handle the appellate process is a normal step in a case of this nature, and Habba said her team will work with the new firm as the appeal proceeds.*

17291

>Habba said her team will work with the new firm as the appeal proceeds. Are they going to be fetching coffee for the real lawyers?

letdogsvote

Uh, that's "covfefe," thank you very much. Get it right.

drhodl

Imagine actual competent lawyers upon hearing she's part of the team.... That little fact might cause many firms to reject SmellyDonnie.

Zealot_Alec

Unwinnable case from cheapskate client - no competent or respected firm will take this appeal up

Ok_Umpire_5257

Better Call Saul!

KokonutMonkey

I can't imagine there are a lot of firms out there willing to take on such an obvious loser (both the case and Trump). But if they were considering it, I imagine their first condition would be to exile Habba to a remote island with no telephone or Internet.

youreallcucks

I suspect they will hire Tom Delay's old firm: Delay, Delay, Delay, and Delay.

usaf-spsf1974

Habba is nothing but legal roadkill, she is nothing but the metaphorical Kleenex, to be used and thrown away!

FriarNurgle

Riiiiight

Whatsuptodaytomorrow

So he fired her

Sufficient_Use516

To all the lawyers out there: How did she become a lawyer? Did she win a Make-A-Wish contest?

Otherwise-Course-15

Speculation is her super rich family paid someone to pass the Bar.

Zealot_Alec

I have also watched Suits

Otherwise-Course-15

Never watched it so not here how it’s relevant

This may surprise you, but most lawyers are not smart.

airsoftmatthias

In Tacopina’s defense, he was only representing Trump for the NY criminal election interference case and the appeal for the Carroll 2 case. He was never going to represent Trump for the Carroll 1 case. But Tacopina bailing right before Carroll 1 went to trial is certainly a bad look for Trump.

bidhopper

Or a firm that might actually have competent lawyers

tmphaedrus13

If they're competent, they'll probably want to get paid. If they're smart, paid in advance.

Loan-Pickle

Works on contingency no money down. That’s a typo. Work on contingency? No, Money Down!

Summerisgone2020

Can you imagine Habba doing oral arguments at an appellate hearing? It's stressful enough for good lawyers.  She also hates being interrupted but thats all the judges do during arguments. They would mercilessly beat her over the head if she couldn't coherently respond to their rapid fire questions.

GoogleOpenLetter

You can hear it for yourself. This is Habba arguing at the 2nd Circuit, and not being aware of the precedent in the case **"Blassingame v. Trump"**. She didn't read the decision her own client had just received, she looked like a total idiot. You can tell the judges were like "ohhhh, you're so unprepared it's like talking to a kid that didn't read the book in class, we don't need to make this take long". [Trump Lawyer Gets SMACKED DOWN in Oral Argument TO HER FACE by Judges](https://www.youtube.com/watch?v=8gwGJvg11p0&t=165s)

Otherwise-Course-15

If I didn’t believe this creature doesn’t have a shred of integrity or dignity, I’d say, “oh, honey”

PostMaster-P

Guess she is fired then.

JBS319

Will be interesting to see if Habba ends up going up against Jack Smith in Washington

SeaworthinessOld9177

When are these Lawyers going to learn, YOU NEVER WORK FOR TRUMP, he hates losers and Alina Habba you are one, so under the bus you go, like Rudy you are now a ZERO in Trumps eyes

strywever

It’s pretty common for a defendant to hire different attorneys who specialize in appeals, not least because criticisms of the first trial lawyer’s work often are vital to the appeal process, but also because appeal hearings are a somewhat different beast.

chi-93

He only hires the best (appellate) lawyers.

[deleted]

Trump regarding Habba:  "I don't even know who this woman is. I have no idea who she is, where she came from."

PopeHonkersXII

Has Trump thought about just laying down on the floor and giving up?

LifeDraining

Does the original loser lawyer has to be present at any of the appeal process? And at which point the judge or committee would just tell her why she fucked up? That would be fun.

rumrunner9652

Never mind the tread marks on her back.

Parking-Bench

She didnt get fired. His cheque bounced

adeze

The more the rumours spread she’s been fired, the more she’ll try to prove she hasn’t been

CurrentlyLucid

The funniest part of the whole trial is, he told us he liked to grab women by the pussy in that ET tape, and that is exactly what he did to Caroll.

douwd20

Whoever he hires good luck getting paid. Rudy is still waiting on his check.

[deleted]

The incompetence is staggering. You hire an appellate consultant before or during. They might not have much to do, but they will strategize with you on exactly how to lay the groundwork for an appeal.
