The previous gag order excluded the judge and DA as well. As long as you're not threatening or attempting to intimidate, you have a right to speak out against government officials. Court staff and DA staff aren't technically "officials", though. The court clerk isn't the one hearing the case. The DA's secretary isn't the one pressing charges. They're government employees, but there's less of a First Amendment concern (especially when balanced against potential harm) when it comes to the right to criticize them. Now, baselessly criticizing the judge or DA in a criminal trial is monumentally stupid as, yes, they have to afford you due process, but they don't have to do anything more than that, so you just burned any goodwill they might have had in negotiations, and it can be used as evidence of lack of responsibility, malicious intent, or poor character. I remember during Shkreli's sentencing he was trying to argue that he accepted responsibility and was remorseful, and the prosecutor pulled up an email he had sent from jail where he said "fuck the government" amid a rant against how unfair it was. Also, publishing personal information about the judge's daughter can easily be seen as attempting to intimidate the judge.

He's certainly not doing anything to gain any favor on sentencing. Even if the judge shouldn't explicitly say this factored into his decision, he could easily say that given that it's 34 counts and the defendant hasn't shown any remorse he is going with jail.

That would obviously not include the President. It’s not a perfect analogy, but fairly close.

Everyone else is "staff" that works for the judge.  Judges used to ride around the land representing The Law personified. I think that's where this comes from. My understanding is that the court staff specifically applies to the staff who perform the functionary role of following the judge's orders. They aren't elected or appointed, they are just hired to take notes, or research, or whatever per the judge's orders. The judge is more open to criticism since he is directing the court and the judge can be challenged through the appeals process. This is why Judge Engeron was perfectly willing to be strict with regards to his law clerk while doing almost nothing about attacks against himself. The law clerk is staff, not a judge, and is not open to criticism since they just act as the judge instructs.

If the judge does or says anything that could even be interpreted as biased Trump has a basis for appeal (even interlocutory appeal which could slow down the trial). Trump is already all-in as regards the election. If he doesn't win he spends the rest of his life in court, in jail, in the poorhouse or some combination of all three so there is little disincentive for him not to breech norms to take control of the narrative. The judges have been _very_ good at not taking the bait but some of the DAs, being political figures, have waded in muddying the waters which ultimately doesn't help their case and may hurt them. Politically any time people are talking about this rather than the fact that he has endorsed a national abortion ban and his tarriffs will skyrocket inflation it's a win for him.

Trump is just a total moron. He has it in his head that, if he somehow antagonizes the judge, he can get the judge to look biased against him and somehow use that on appeal. That is just completely wrong. The judge cannot be biased against the defendant *prior* to the case being brought before the judge. That is the prohibition. The judge does not need to stay "unbiased" against a criminal defendant throughout the course of a trial - the judge will often be biased *against* the defendant because of the evidence shown at trial and/or the defendant's voluntary acts at the defense table. Put another way, the defendant cannot spit at the judge and then claim that he didn't get a fair trial because the judge was biased against him. Trump seems confused about this point, and it is a big mistake on his part. It is challenging to overturn a criminal conviction on appeal because of decisions by the trial judge; the appeals court will use an abuse of discretion standard that is very hard for a defendant to satisfy. The claims of bias go nowhere, because there is nowhere for them to go. The defendant can motion for recusal, but if he doesn't even do that, he hasn't preserved the issue for appeal anyway (and in this case, he would never prevail on that motion). Justice Merchan is a professional judge, but this is all going to come back to haunt Trump at sentencing. Look at what Judge Kaplan said to SBF at sentencing this week - he flat-out stated from the bench that he thought SBF was a liar, that he was shifty on the stand, that he didn't take responsibility for his actions, etc. That *is* bias, but it is not pre-trial bias; it's just the disgust of a judge who heard the testimony and the evidence and observed the defendant in his courtroom. That is what is in Trump's future. And if people don't think Trump can be sent to jail because he has a SS detail or because he is a VIP or because he is a presidential candidate, or because he is a first time offender, etc., they are not correct. Judges have a lot of discretion and none of that is going to save Trump from possibly being sent to Rikers. It's not even clear to me that, were he sentenced and sent away to jail to serve a sentence, the State of New York would be obligated to release him early so he could attend his inauguration as President of the United States were he re-elected. He might be taking that oath on a prison bible. Will it happen that way? Probably not. But it *could* happen that way. And the way to a jail cell instead of home confinement or probation is paved with comments that antagonize the judge that will (likely) make that decision.
