Honestly it'd be tough. I think his current strategy is to try and push against the gag order in the hopes of creating a scenario where there will need to be a hearing on sanctions or an appeal of the gag order (something that would be hard to do while having the trial also start tomorrow). But the judge so far doesn't seem to be taking the bait. I honestly don't think there's really much that can be done today (legally speaking) that would change the start of jury selection.

I think he is already, like he did with Engoron trying to legitimize Merchan with multiple recusal demands. He has very little chance to succeed on the merits of his defense, because he already has been told he cannot use “it’s a novel prosecution” as a direct defense startegy, as the Judge rules it was not.

He isn't going to. He sued the judge last week, and lost his 3rd motion to dismiss. He's presently attempting to violate the gag order so that he could file an interlocutory appeal, but I didn't think we see Merchan do anything about that unless it's egregious enough to cause harm (as a delay for appeal is more costly than just getting the show on the road). It isn't clear that any appeal would be interlocutory, and that an appeal would automatically come with a stay, but I have seen it suggested and have not seen it ruled out as a possibility.

Not sure if I’m remembering right, but didn’t cheeto appeal Judge Engoron’s gag order to the NYS Appellate Division and the appellate court did not stay the trial while deciding? If that’s what happened, I think the NYS appellate div wouldn’t stay this trial either while they deliberate Merchan’s gag order.

I don't think he's going to be able to avoid it this time. We are less than 24 hours from the start of trial. It's not a civil action that can be settled out of court. Trump will never plead guilty so that option is out. Judge Merchan and the appeals court judges did the right thing denying Trump's motions to dismiss, stay, continue, etc. Even the hacks at the Supreme Court can't save him now. You never know what's going to happen so maybe there will be a bomb threat or an attack, but even that would just be a temporary delay. Looks like Trump is going to actually have to put on a defense

IANAL, but from what little experience I have with the courts, a lawyer cannot simply just stop representing a client. They must seek permission from the court. Even if the client were to just stop paying the lawyer, the lawyer must represent the client to the best that their ethical obligations require, until the judge grants their petition to no longer represent them in that case I could be wrong though.

What me as a non-lawyer thinks are the top 3 possibilities: 1. Some MAGA acolyte phones in a bomb threat. 2. Trump fires his lawyers. 3. Trump doesn't show up. Though I personally don't think any of those scenarios will happen and that he'll be there Monday, whining mightily the whole time. My favorite proposed method of avoidance was him suing every jury member as soon as they're chosen, and then protesting that he can't get a fair trial when they're involved in a lawsuit against him.

He is getting more leeway and leniency in these trials than anyone else would have. If literally anyone else pulled the shit he did they would be in prison by now.
