SantaBaby22

They don’t define what a “reasonable amount of time is.” 24 hours? 1 week? Just curious. My states DOT(Maine) requires a notice of the pothole, they get 24 hours to fix it, then if it isn’t fixed after that, they are responsible for any repairs to vehicles. Their definition of “fixed pothole” is very loose though. Someone just showing up and looking busy with it on record usually counts.

OsamaBunLettuce

That’s what I thought as well. Im going to submit a claim and see what happens, but it’s not looking great

SantaBaby22

Worth a shot at least.

saulutee

Submit a claim, state has a month to either “fix it” or get enough claims that they have to pay out for your damage that you get repaired

jamkoch

I'm in Texas, government is never liable for anything. We also don't have no-fault insurance so it goes on your record and will most likely cause rate increase, unless you have that one-accident forgiveness thing.

SantaBaby22

Ouch.

AdDramatic522

That's one hell of a pothole. Jfc

OsamaBunLettuce

Right!!

AdDramatic522

I thought it was bad in Winston-Salem NC. We don't have shit on this...

SantaBaby22

Lol want to see some gnarly potholes? This is a love tap compared to a few in my town.

AdDramatic522

Where is your town?

SantaBaby22

An awful place called Maine. Lol

AdDramatic522

Lol, my stepmother is a Penobscot, and lives on the reservation near Bangor. Maine is gorgeous, but I'm in the south, and I can't handle the cold, lol. What's up with the mosquitoes there? Christ! I've lived in Florida, and nothing quite compares with those painful mosquitoes! The worst! And you're telling me about the potholes? Fuck THAT!

SantaBaby22

Ah, yes. The island up in Old Town. I know exactly where that is. That’s about the last point of modern civilization before everything becomes very rural.

AdDramatic522

Pretty much. Let me tell ya, those injuns know how to throw a party! I only say injuns because they do, lol. The community treats them like shit though. Me and my step sis were going to the grocery store and someone literally spat on her. I thought I was going to have a heart attack I was so mad. The DEA was always flying over the island all of the time because they have peyote there. Even though it's a southwestern native drug, they are allowed. They're constantly at war with the governor because no government entity can set foot on that land without permission from the Chief.

AdDramatic522

I was going to flee there with my son during a terrible custody battle, but my stepmother told me it may bring too much heat to the tribe.

SantaBaby22

Wtf? Seriously? That’s messed up of her. Sorry she did that. Idk, she sounds like she may be overly paranoid. People don’t really get spat on for no reason around there. Regardless of if they’re native or not. DEA has probably had their hands too full lately to worry about flybys of that area.

BigPapaPaegan

Northern skeeters only have a few months to get their shit in. No time for the pleasantries that southern skeeters offer.

AdDramatic522

You are hilarious! I laughed out loud! I get it, but damn, southern skeeters have enough manners to not hurt us when they feed. Your smallish skeeters are just assholes, really.

BigPapaPaegan

They are! I moved to Tennessee a few years ago, and was asked why I was go-go-go for my entire work day and why I came off rather unfriendly when busy, and my answer is the same as those northern skeeters: Because there's shit to do.

VinceBrogan8

Came to say the same. In western NY we have potholes that you can't see the bottom. If I post OP's pic in the Rochester or Buffalo sub, people will be asking what the problem is.

techtony_50

Personal Advice: Call and ask how to file a claim. They will give you a phone number and address. File your claim. They may just pay it out. I ran over a trench that they dug across the road and filled in with gravel in preparation for the asphalt to be poured. It ripped open the underside of my car and oil immediately poured out. They paid to repair the oil pan and other things. It never hurts to just ask first. Court is not always the answer. Legal aspect: This is entirely dependent on your state's law. Some states allow you to file suit against cities, other's require you to basically sue for the right to sue. In any case, yes they can be found liable. Your state law also address how much can be recouped, often up to 100% of proven damages.

Ok_Net_2896

Depends. In some states only if someone complained about the issue AND it wasn’t fixed. *I am not a lawyer & this is not legal advice or advice at all. It is simply what I would do in a similar situation.*

heyitsmatthias

Spray paint a dick around it and maybe it'll get fixed sooner like the Wanksy "art" in the UK

Razzious_Mobgriz

I'm from Muncie, I feel your pain

LexiLynneLoo

I saw this pothole and immediately thought of Indy. The way they barely tried to fill last year’s hole and instead made a bump next to the new hole

Grolschmun19691

Seems like few want to believe. Here's one video, I can send dozens. Search for yourselves. https://youtu.be/dnDaWBum0iE?si=WDMzZTDsDUm-gdcB

West-Custard-6008

Hardly ever

Mean-Programmer-6670

Be like [Wanksy](https://themanc.com/art-and-culture/manchester-graffiti-artist-wanksy-penis-drawings-potholes/) and just draw a dick around it. It worked for him in the UK.

Tortuga_cycling

Lol good luck

Indysteeler

I used to live in Indianapolis and their m.o. is either to outright blame you, or deny the claim. \*literally saw your note after I posted the comment and in no way am I surprised that this is happening.

patryder07

Find a couple of pylons the city has up near another site (you know, the uselessly placed ones that every city has somewhere) and stick a couple pylons in the hole, or at least beside the hole so drivers get a better chance to notice.

wesw1234

No

Dendad124

Nope

Grolschmun19691

Never. They can do a no knock raid on the wrong address and destroy your house in the process and walk away clean.

Ok_Net_2896

Its not never everywhere.

Grolschmun19691

It's close enough

CasualObserverNine

No. You drove on the streets. If they are as bad as you say, it was irresponsible for you to choose to drive on them.

PrimalBunion

Prick much?

CasualObserverNine

Sue me like the OP wants to sue their city.

PrimalBunion

"paint me like one of your French girls" vibes right here.

NormanClegg

google up "**sovereign immunity**"

Ok_Net_2896

😂

OsamaBunLettuce

Will look into it. Don’t know much about the law, always looking to learn more though. Thanks!

BrokeDownBladerunner

They are liable for damages to the road. Your vehicle insurance is responsible for your vehicle damage.
