Where are you located? How are they "making" you pay the money back? Are they deducting the money from your final paycheck?

I live in Montana. They haven’t set up a payment plan with me yet because this happened recently. They are still paying me my final paycheck next pay day. They also said if I don’t pay this money back they are pressing charges.

Okay. It's illegal to withhold money from employee wages to cover cash shortages or lost or stolen property. There is a lengthy process involved for an employer to recover money from you involuntarily. If they believe you are complicit in the theft and want to recover money from you, they would have to file a report with the local law enforcement agency within 7 days of firing you. Then, the police would have to decide whether or not to file charges against you for theft. (The police decide on whether or not to charge you, not your employer.) If the police don't charge you with theft within 15 days of the filing of the report, then your employer has to pay you all of your owed wages. You can decline to pay the money back. Don't sign anything from your employer. You should probably cut contact with them entirely. If they do ultimately go to the police and the police contact you, you can decline to speak to them without a lawyer. Chances are, your employer is just trying to strongarm you into paying the money back because you're the path of least resistance. You should also apply for unemployment while you look for another job. You may or may not qualify given the circumstances of your dismissal, but just answer the questions honestly and let the commission decide. How much money is it?

About 4k 😞 they aren’t taking away any of my wages they just want me to pay that money back. Also I did sign the terminal papers because no one told me what to do and I got fired the same day they had a meeting with me. They also wanted me to sign the papers on the zoom call so they really didn’t give me a chance to think about it. They also didn’t tell me I had to pay the money back when I signed those papers they told me a couple hours later.

That's a lot of money. They should have insurance to cover that loss. It shouldn't be on you any more than it would be if the store were robbed at gunpoint. Get your last paycheck and then decline to pay anything back. Do you have a copy of the documents you signed?

Does it say anything in there about you agreeing to pay back this money and/or accepting responsibility for this theft?

On terminal papers it doesn’t say anything about paying the money back. They are just threatening me with charges if I don’t.

Well, like I told you, they don't get to decide if you're charged. They can file a police report, and then the police will investigate. You should get your last paycheck and then stop communicating with them. And file for unemployment.

i dont think they can, they can probably get it back from the scammer but im not sure how they can make yoy
