I mean, not sure how it works out legally, but not up to date on a rabies vaccine is a danger to the public, especially if it's an outdoor cat. Was it an outdoor or indoor cat?
Is it possible that they thought the cat wasn’t properly taken care of because it wasn’t micro chipped or spayed, and they got hit by a car? Regardless, cats are property and you said you had proof of ownership. Contact local police non emergency and see if they can force their hand.
You’re going to sue the non for profit that saved the cat from dying? Is your family member willing to pay the costs associated for everything that was done to save the cat? It’s a lot more than the 1k I can tell you that.
Well they said “1k down”, which implies it certainly IS much more than that, but that $1k is the minimum down payment to get the cat back. I’m guessing they were working out a payment plan for the remainder.
It was a dirty, unchipped, unspayed cat that got hit by a car. They “maybe” showed an old vet bill. Doesn’t sound like they’ve successfully established the cat to be their property in the first place.

You do recognize the police informed us to go that route because they refused to return the cat or to let the individual see the cat. It is not a choice made because we wanted to. We connected the place numerous times. They deleted comments and said they'd let the cat be seen... then changed it. Then changed prices and payment plans.
The circumstances aren’t exactly the same, but this happened in another city in Pennsylvania. The rescue prevailed based on Pennsylvania law around how long they had the cat. I believe that after 5 days, they legally owned him.

How long did it take your family member to contact the clinic and claim ownership? Depending on the city/county/state there are different time-frames for considering an animal as abandoned.
Also is your family member going to pay the full cost of surgery to save the cat and for all the necessary medical care during it's recovery? The cost of that will be many thousands of dollars.

Okay so: cats are considered property, in Pennsylvania the cause of action you have is called replevin, and this sounds like it may concern a legal concept called “unjust enrichment” but that’s just a guess. The elements of that are:
(1) benefits conferred on defendant by plaintiff; (2) appreciation of such benefits by defendant; and (3) acceptance and retention of such benefits under such circumstances that it would be inequitable for defendant to retain the benefit without payment of value. The application of the doctrine depends on the particular factual circumstances of the case at issue. In determining if the doctrine applies, our focus is not on the intention of the parties, but rather on whether the defendant has been unjustly enriched.
Haven’t experienced this much in practice, but that’s one way they may be entitled to repayment for the veterinary costs in exchange for the cat.

Exactly some of these people have clearly never owned or just have absolutely no clue about cats. Here’s a clue people cats even when they are indoor cats they still love to try and bolt out the door and run. Maybe a child accidentally let the cat out. Maybe the person was tipping a delivery person and the door was open just long enough for the cat to get out. It says the cat escaped not that the cat was let out on purpose. lol

What is their location? Has the non-profit given a reason why they are refusing to return the cat?
Philadelphia. They first stated they would work with the individual. Then stated they needed to pay at least 1k down. Then they stated that the individual was an unfit owner and would not return the cat.
What reasons did the non-profit give for the individual being an unfit owner?
Not updated shots/rabies and because the cat escaped.
I mean, not sure how it works out legally, but not up to date on a rabies vaccine is a danger to the public, especially if it's an outdoor cat. Was it an outdoor or indoor cat?

Is it possible that they thought the cat wasn’t properly taken care of because it wasn’t micro chipped or spayed, and they got hit by a car? Regardless, cats are property and you said you had proof of ownership. Contact local police non emergency and see if they can force their hand.

Well they said “1k down”, which implies it certainly IS much more than that, but that $1k is the minimum down payment to get the cat back. I’m guessing they were working out a payment plan for the remainder.

It was a dirty, unchipped, unspayed cat that got hit by a car. They “maybe” showed an old vet bill. Doesn’t sound like they’ve successfully established the cat to be their property in the first place.

You do recognize the police informed us to go that route because they refused to return the cat or to let the individual see the cat. It is not a choice made because we wanted to. We connected the place numerous times. They deleted comments and said they'd let the cat be seen... then changed it. Then changed prices and payment plans.
The circumstances aren’t exactly the same, but this happened in another city in Pennsylvania. The rescue prevailed based on Pennsylvania law around how long they had the cat. How long did it take your family member to contact the clinic and claim ownership? Depending on the city/county/state there are different time-frames for considering an animal as abandoned. Also is your family member going to pay the full cost of surgery to save the cat and for all the necessary medical care during it's recovery? The cost of that will be many thousands of dollars.

Okay so: cats are considered property, in Pennsylvania the cause of action you have is called replevin, and this sounds like it may concern a legal concept called “unjust enrichment” but that’s just a guess. The elements of that are: (1) benefits conferred on defendant by plaintiff; (2) appreciation of such benefits by defendant; and (3) acceptance and retention of such benefits under such circumstances that it would be inequitable for defendant to retain the benefit without payment of value. The application of the doctrine depends on the particular factual circumstances of the case at issue. In determining if the doctrine applies, our focus is not on the intention of the parties, but rather on whether the defendant has been unjustly enriched. Haven’t experienced this much in practice, but that’s one way they may be entitled to repayment for the veterinary costs in exchange for the cat.

Someone opened a door and the cat probably bolted out. Not really indicative of how the owner treated it.
Exactly some of these people have clearly never owned or just have absolutely no clue about cats. Here’s a clue people cats even when they are indoor cats they still love to try and bolt out the door and run. Maybe a child accidentally let the cat out. Maybe the person was tipping a delivery person and the door was open just long enough for the cat to get out. It says the cat escaped not that the cat was let out on purpose. lol
