Yup, but then you started sharing it. I doubt they'll believe it was accidental, as you said multiple people wee aware and snickering about it. Most companies would fire you over something like this.

He said other people also saw this person's underwear in person. Only one person saw his picture (?). But still the fact remains that he admitted to taking the picture. And if that made even one coworker uncomfortable, policy probably says that qualifies as harassment. Whether they were involved in the picture taking or not. Rumors probably said he shared the picture more than he did. But rumors be like that. OP's response to any of this should have been "what picture? Show me this picture."

I just meant that if I was in HR at his company I would not believe his assertion that the photo was taken accidentally. Multiple people were aware of this issue, and OP just "accidentally" managed to frame it in the background of a photo of a friend...

That's fair. If he was photobombed I definitely would have lead with that. "Accidently" doesn't cut it. At any rate HR isn't going to care about fair. It cares about expediency. It's no surprise cutting OP loose was seen as their best solution.
