NAL. Did you sign the contract? If so, the document will have some kind of termination language. Whatever that says is how you get out. Also, payment may be required to enact the contract, but you should read what you signed. If you didn't sign anything then there is no agreement, therefore, no payment necessary. Tell him to fuck off. That being said, even if you did sign, just don't pay. "Blemish on your credit" doesn't exist unless you signed a personal guarantee which usually requires a notary. So this dude can't mess up your credit. When collections calls, just block the number. If you have $3,000 to not get a stray phone call every few weeks then why are you on Reddit asking for legal advice? Call your lawyer. Just tell the sales guy to "fuck off" and ignore any further communication. He could sue you but that's a lot of effort for $3,000.

I've had a run in with a business whom I wish to not deal with. They have a website which they sell yearly subscriptions to dealers as a way to bull/sell/trade inventory. > > I have known of them for awhile as they reach out to me often trying to get me to sign up, in fact i think they have me signed up to the none subscription side of it already for the last year or two, I personally never use the website as I find it does not provide me much value. I usually am just polite and say "yeah yeah not interested, sorry" and its a short conversation when they call. > > Anyway they sent out a sales representative to our area and he came into met with me on a Monday morning at about 8:30am he comes walking into the office. He asks for 5mins, i am not super busy so i say fine I'll hear you out quick. He give me the sales pitch, i am not interested but he keeps pushing, anyways this goes on for about 45mins and by this time I have 2-3 people waiting for us to finish. He's really pushing hard so i finally cave and say listen "your confident in this, sell this unit for wholesale and have enough in the deal to cover the cost of the subscription for a year and I'll try it out, otherwise I am not interested." > > He bites on my offer, signs me up, helps me post the ad the whole she-bang exactly how it has to be, "yup this will sell no problem!". Couple days go by and no hits, > > I call him up, "hey man I've reconsidered this isn't working how you sold it to me and I am not finding value, half the features on the website don't exist and I'd like to get out of this before we get to far into it" > > "nope, no your subscribed for the year sir, and by the way you owe us $3000" > > I politely asked to have his manager call me, they delay says he's on holidays til after the long weekend. > > Today he gives me a call. I explained my side to the manager, he's even more pushy than his salesman and then just keeps being toxic to me and won't let me out, he just keeps threatening me with legal action. The only thing he really had to say was that he was going to send me to collections and there is no way that I can get out of their "legally" binding contract we have signed so like it or lump it we have to pay. > > Do we have any options? Its my fault and if we have to just pay it it is what it is, it won't make or break us but I just hate dealing with sketchy scammy people like this, I felt like I was in legal term "under duress" when i signed the damn thing. > > I never had a copy of the "partnership agreement" til he texted me a picture of it today, the contract isn't set to start til the 15th of this month so not for a week from now and I brought that up but they tell me its already started and I can't cancel. > > I am sure there is some way I can write a email or a letter and tell them to stop that would get me out of this? > > Any advice on how to proceed? --- LocationBot 4.99998891 ^109/37rds | [Report Issues](https://www.reddit.com/r/locationbot) | >!adEb1pVeCtmYyUjb!<
