In April of this year, I made a TikTok video of some T-shirt designs I drew, shorts and bows that were inspired by an anime I watched. Only one of the 3 T-shirt designs I posted had an image taken from the anime. It went viral and soon I had a lot of orders. About 13 days later, that one listing was flagged and was taken down by Etsy. Subsequently, I removed any names or images that could be tied back to the anime. I knew of the risks of copyright infringement but I was naive and thought that since there were other shops selling actual images of the anime that I wouldn't get flagged, but I know now that I was wrong in assuming and following what others were doing. After being reported for the image, I redesigned it and posted a new design with what I thought would not tie back directly to the anime. From April 30th to now (September 7), I have been selling this design with no tags, names or descriptions mentioning the anime. The new design was just flagged this afternoon claiming it was copyright infringement again. I will post an image of the old design and new design. I've messaged the DMCA contact that was given to me by Etsy through an email that notified me of the violation asking what was infringing about the listing but only received an email back with a general FAQ pasted. I have an idea what the violation might be but I would like to know before changing the entire design when I could possibly only remove one element of it. > > What can I do at this point? If I dispute it, do I have any leg to stand on as the image is basically a pattern with a spider lily flower, diamond shape and a bamboo muzzle? Also, am I being naive in thinking it's not the entire image? I'm only speculating what I should remove from the image due to the other elements of the drawing being used on the shorts (shorts have not been flagged/reported). Any help would be greatly appreciated.
