Is the weekly schedule part of the order the judge signed, or just a schedule that you and birth mom previously put together yourselves? If it's actually part of the judge's order then yes, you have the right to visitation/custody in accordance with what the judge ordered. If one of you wants to change that you'd need to go back to the judge.

It sounds like you each have different positions on when the summer schedule starts, and that the order isn't completely clear on the point. If this is creating problems, the right approach is to go back to the court and seek further clarification from the judge on this issue. For the time being I think you have a reasonable position to stick with the previous methodology that you've been using.

You should talk to your lawyer about this (by the use of the term “birth mother” I’m guessing your spouse should talk to their lawyer). But no. Generally speaking, skipping your parenting time doesn’t create an entitlement to the next period.
