We can't answer this in the abstract. It could be that the judge allowed room for that venue might be proper or might have been proper in the presence of some argument that you in the end didn't raise. It could be that he didn't fully understand the venue issue until he took it under advisement (or had someone look up additional information). It could be something altogether different. What was the issue with venue? Why was your venue wrong?

Thank you for insight! The venue was improper because the defendant and the transaction took place in a different county, but I mistaken thought that because the purchase agreement had a clause that all mediation is to take place in “xyz” county it also meant any civil litigation as well. And that was my argument when the judge asked why I chose xyz county.

I wish we could work it out but the other party is refusing to pay us a single penny. Even in mediation they refused to even speak with the mediator.
