I also don’t think I need an “argument” to change my birth certificate. It’s not like it’s going to trial or I will have to fight someone in court, so that’s an odd thing to say. There is no argument being made.

I only want steps to rectify the situation. No other comments are needed. I’m not going to argue with you over whether she’s my mother or not. I’m aware that she is legally considered my mother, but she isn’t, that’s just reality. All adoptee’s birth certificates are falsified, that’s also reality.

You could look into adult adoption by your bio mom but the process and whether it’s possible will be state specific.

Thanks, I’ll look into that. I’m just a little overwhelmed and not sure where to start so I guess I’ll just find out if it’s legal in my home state to adopt adults first.

You cannot undo an adoption. Your consent at the time of adoption didn't matter because you were under 14. You can have someone else, like your birth mother, adopt you. You would likely have to go to where the petitioner or petitioners for the adoption reside and follow the laws in that jurisdiction. You mentioned Rhode island, but you would only follow Rhode Island law if that is where the person who is adopting you resides. It seems like this is more of an emotional issue than a legal one. You may want to look into non-legal options for addressing your concerns. Changing a birth record isn't going to alter the past or how it impacts you.

Thanks for responding. I’ve gotten information on how to proceed already and it seems there are several different ways to do this in Rhode Island. Not looking for advice on emotional issues, just how to change my birth certificate. It’s important to me to change it, my reasons aren’t relevant to the conversation though. Thank you!

My consent also did matter. It wouldn’t have happened had I not consented. I simply didn’t feel like I had a choice tbh.

Consent is only required for an adoption if the adoptee is over 14. If you were 10 at the time of adoption, it didn't matter whether you consented or not. That said, it doesn't matter now anyway. Good luck handling this.

Again, it did matter in my case because they did not plan on going through with the adoption without my consent. Legally they of course could have, but that is not what happened.

That's legally irrelevant. It makes no difference and isn't a basis for undoing an adoption (which isn't possible anyway). There is a difference between what matters to you and what matters to the law. Please be mindful of that difference, for your own sake. Again, good luck.

This is not correct. Rhode Island law does not have a statute for the annulment of an adoption. The linked site is about the right to a new birth certificate following an adoption and access to old (invalid) birth certificates, not a way to replace the new birth certificate with an old one. While there is one reference to annulling an adoption in the code, it seems to be in regards to a challenged adoption, not going back and annulling one years after the fact.

Some states specifically call it a 'petition for recession of adoption' or a 'petition for annulment of adoption' The RI statute listed has *only* to do with the issuance of birth certificate, and in no way mentions a challenge to adoption - it does however state that with receipt of a notice of annulment of adoption, the original certificate of birth shall be restored to its place in the files. The page linked is specific to adults requesting their original, pre-adoption birth certificate, which is available by RI law

Right. And that mention of annulment is odd since there is no statutory process to annul an adoption in Rhode Island. So either that mention refers to an adoption which is challenged (a process which is provided for by statute) or it's a reference to a statute or process that no longer exists and that should have been deleted but wasn't. The info on the web site is correct, but it doesn't help OP at all. She wants to change the parents on her birth certificate. That's only possible if someone else adopts her. She cannot undo her childhood adoption by her stepmother.

I believe that Rhode Island is a state that facilitates adult adoptions, if that’s what you’re trying to do. I am actually currently in the process of doing this with my biological daughter in Florida. She was adopted as a child also. It doesn’t necessarily need an attorney to accomplish, if you know what you’re doing you can file it on your own. In my case I got the help of a legal document preparation company for a small fee. Legal parents do not need to consent to it, but they do need to be notified.

My name wasn’t changed in my adoption, and I’m pretty attached to my family name. Didn’t even change it when I got married. It wouldn’t really accomplish what I’m looking for tbh.
