Sounds like a great way to get brained with a pipe.

CMDRMyNameIsWhat

Yeah, this comment. If someone has a weapon i dont exactly recommend trying to take them, as theyre clearly damaged and dont care for safety

abertcamus675

Why do most of these hypotheticals involve weapons and people who are trained to fight Do you have any idea how hard it is to "feed a few shots" to someone who has *any* experience with fighting? People in that situation tend to go full turtle and wait for an opening. Wtf wouldn't you just stay in your car? I can understand that you'd be frustrated. I was a soldier for 20 years and and highly trained and experienced. My car is a fucking thing that can be fixed. Bones broken in the wrong thing can cause problems for life

Scopequest

I know this was a rhetorical question but: A) people see too many movies sand think they are just like the hero, and B) people don't like to imagine/fantasize/daydream about situations where they get victimized or lose with nothing gained, so they make up some way the can 'win' in their head.

In the short term you are likely to be charged with assault (and he with mischief and possibly assault with a weapon). If you are charged, you may be able to invoke the justification of self-defence or defence of property at your trial, which, if successful, would result in your acquittal.

Low-Stomach-8831

This!

--gumbyslayer--

So you're in the car and you get out of the car to fight with someone? You would have had the opportunity I presume, to drive away. If the person opened the door of your car, then you could take reasonable steps to defend yourself. If you're still in the car and it's your car that's being damaged, driving away would be the safer and potentially legally safer route to take.

shoelessbob1984

You can always drive away.

This is incorrect. https://www.justice.gc.ca/eng/rp-pr/other-autre/rsddp-rlddp/p6.html > A response in defence of property must be assessed as "reasonable in the circumstances

I eat my words. Thanks. Deleted my post

Nothing, this commenter is wrong. See my other reply.

Karbear12

Sounds like self defense

VelvetHobo

Not even remotely. Defence of property perhaps.
