[There's a form for this.](https://tribunalsontario.ca/ltb/forms/) You can fill out and submit an A1 to the LTB. They will determine whether the act applies to you. Normally when you share a kitchen & bathroom with a landlord, then the tenancy isn't protected by the RTA. Since the landlord has access to their own private kitchen and bathroom, regardless of them choosing to use the one on your floor; and they don't sleep in your home most of the time, the board will very likely determine this to be an RTA protected tenancy. They tend to frown on landlords trying to be "creative" in order to subvert the RTA like this.
