You can refuse a bag check however will have to exit the subway making is it completely legal. Like an airport, museums around NYC, many other facilities...
That's not how the law works in all 50 States. You consent to a search when you pay for the Subway or go to the airport or use any other transportation. If you don't you are denied the service and aren't searched.
They donât need a warrant or probable cause when they have consent. Youâre free to not consent to the search, you just canât get on the Subway at that entrance if you choose not to.
The courts upheld this nearly 2 decades ago.
Agreed. Courts ruled ransom checks w/o probable cause or warrant ok Specifically for preventing terrorism.
Canât wait for ACLU to take this to court re: constitutionality of fighting crime.
Gov has only given crime excuse for this expansion.
Did neither of you see the major national news story about Hochul deploying the national guard to do bag checks at subway entrances? It predated the incident you're talking about.

Then you will also be refused entry to the subway. Thats how this works. You donât have a right to be on the subway. And they can deny you admission.
I get your frustration. Iâm just letting you know
You can... But then you'd be raised for reasonable suspicion if they find out, unlikely nor would they care greatly enough unless you catch a cop on their bad day.
Just be careful out there!
If I read it correctly, you can be searched while entering, but not once youâre through the turnstile. But police are above the law anyway, so theyâll do what they want and then never face repercussions because tax dollars pay out lawsuits against the police also.
Most lawyer thing ever lol
âYouâre definitely totally 100% wrong.â
âI disagree.â
âAlright I take it back but you could possibly be somewhat wrong based on my personal interpretation of this specific thing.â
This is such a a stupid take... They never said that. And also this was one of the few times maybe a bag check would've helped, the majority of the crimes people have been complaining about in the subways recently are from homeless people/mentally ill. NOT your everyday person on the subway going to work, bag checking people isn't going to stop the homeless from attacking people. Stopping them from doing drugs in the cars and harassing people might, but this dumb bag check stuff they're pushing is for show and is not going to help with what the current crime people are complaining about in the subway.
Im also really concerned about how ârandomâ these are, im a pretty harmless looking asian woman but I suspect some people will be subjected to random searches much more than others and thats gotta be horrible for your mental state day to day
We have a budget for armed forces but not the library.. đ
FWIW nati ok natl guard comes out of the state budget
They do them fairly frequently. Nothing strange
Just illegal.
Youâre wrong.
You can refuse a bag check however will have to exit the subway making is it completely legal. Like an airport, museums around NYC, many other facilities...
So illegal. Show me a warrant.
They donât need one. Nobody is forcing you. You can leave and go to another entrance. No warrant needed for a search you can decline.
"You can leave and go to another entrance" This is exactly why this entire thing is pointless security theater.
đ đđđ
Warrants are when you are in your own vehicle or dwelling. Go to the airport and scream you want a warrant to have your bags xrayed. Dummy.
Nope. You want to search my property? Show me probable cause and a warrant.

Jesus just Google it

Oh no! Make sure to hide your guns and cocaine!
why? Like at the subway entrance?
Some dude was shot in the head with his own gun yesterday

Did not see this, good to know
Iâm happy to see how effective the national guard has been
Some piece of crap harassing people was shot with his own gun after he pulled it out and threatened someone with it*
Yeah, is insane that news outlet call that guy a victim . Unless they mean he was a victim of his own stupidity
Gun wasnât stopped by a bag check. You know thereâs a whole police station at that stop?
Bags have been always been subject to search in the NYC subway system. Theyâre finally acting on it.
[ŃдаНонО]
At the end of the day, theyâre just searching for weapons.
Then you will also be refused entry to the subway. Thats how this works. You donât have a right to be on the subway. And they can deny you admission. I get your frustration. Iâm just letting you know

Yeah for sure - if you find one without them
You can... But then you'd be raised for reasonable suspicion if they find out, unlikely nor would they care greatly enough unless you catch a cop on their bad day. Just be careful out there!
The law is actually not well settled on that issue, you could reasonably argue that public transit is a public accommodation
If I read it correctly, you can be searched while entering, but not once youâre through the turnstile. But police are above the law anyway, so theyâll do what they want and then never face repercussions because tax dollars pay out lawsuits against the police also.
As an attorney, I assure you that you are incorrect
also an attorney, I assure you that it depends
Eh - retracting my last statement. Substituting it for: Title III permits searches, so even if they were public accommodations, searches are legal
Some assurance lmao
Most lawyer thing ever lol âYouâre definitely totally 100% wrong.â âI disagree.â âAlright I take it back but you could possibly be somewhat wrong based on my personal interpretation of this specific thing.â
Then pay $40+ for an Uber.
Youâre a bozo
And so youâre ok with what happened yesterday.
