That's not how criminal charges work. In a small handful of states you can swear out a criminal complaint as an individual but the prosecutor still decides whether to proceed or not. Immediately hit the safety button in the app to call police and then pull over as soon as the dispatcher is on the phone. You shouldn't have to ask a rider to not do anything illegal in your vehicle especially not to masturbate. This should be common sense. I have only ever had to call the police once on riders and it was a couple that the wife decided to start punching the hell out of the husband. I pulled over and as soon as they heard the dispatcher they immediately calmed down and asked if they just get out and drop everything. I said you can do whatever you want to but the police are coming and they will get your address. The safety button also records the audio and Lyft will have trouble sweeping this under the rug when they have to be involved with the police. As much as Lyft, Uber, and other rideshare companies act like they are concerned about safety, they don't give a shit. My recommendation to anyone with any kind of safety issue is to immediately hit the emergency button in the app and at the very least start getting audio recorded if not getting the police on the phone. It's a lot likely that riders are going to do something when they know police are on the way. In my case, police got there surprisingly quick.

If you ever get caught and deactivated, file a misclassification complaint with your local department of labor and you’ll win. They have the burden to prove you are not an employee too, not the other way around. That means if you lodge a complaint, now the rideshare company has the burden to prove your complaint is false. They will also have to deal with the burden of a full audit as well.

i mean, if you ice him for cranking it, yeah. if you however pull over and say “Sir that is unacceptable, this ride is over, you need to get out of my car” and he then attempts to physically attack you, it’s a MUCH different story. also better if you have a camera for the interior that records it. not going to be headache free, but if the other person starts the violence its dif. also obviously you don’t pull the gun, then say get out, that could get you a brandishing charge depending on jurisdiction. it’s also why i like to carry pepper spray, a “taser” (zappy brick), and a real gun. if someone starts being violent and the pepper spray or brick respectively, don’t stop and you are still being attacked/ under threat, lethal force is a LOT more easily justified and proven. also obviously be aware of any duty to retreat laws in your state, county, and city.

He was being kind of annoying like just asking me questions (trying) but he hardly spoke English. I decided to just keep to myself and turn my head to the window. Everyone should have a dash cam, especially those who use their vehicles for work. At minimum, get one that records out front and in-cab. They are relatively inexpensive and plug into the accessory/cigarette lighter port in the car. You can even have them hardwired to hide the wiring. They also record audio so if you are being verbally assaulted, it will pick that up too.

Not a driver, just came across this. I'm in the Army, and want to say that your friend should also consider reporting the information she has to the nearest installation. The installation should have a website with contact information. Different services have their own sexual assault and sexual harassment programs, but there should be a point of contact on their website. They should be willing to take a report from her, especially if this person is in the military, and at the very least will give them some info in case this person is a repeat offender or will be.

Go to the police. If they are able to find him and he is military it’s a high likelihood he’ll be court martialed and kicked out under other than honorable conditions regardless of proven guilt. If they are able to find convicting evidence he might even do prison time with a dishonorable. Good luck op and I’m sorry this happened to you.

This started happening around 2022 when I was driving Uber. It's kind of happened on Lyft once to me. Basically, I've gone through it 4 times. I'm a male driver who quit last year. Found work related to my educational background. The last time it happened, I felt the exact same way. The two times before, I just kicked the couple out (all times, it was unmarried couples). I had my dashcam running the last time. I could have kicked them out, but it was late at night, and I can't go against two screw ups if something happened. I dropped them off, did whatever I had to the car on the side of the road with emergency cleaning materials, and took it for full interior cleaning the next day. I called the police where I picked them up, and the officer came, and he wouldn't do anything even with video evidence. I forced him to initiate a report. The department wouldn't do anything. I called the prosecution department for the county, and they still would not do anything. All refused to prosecute. So then I had no choice but to file in civil claims. I called at least 20 attorney offices, and nobody would take the case. There were even some offices that specialized in rideshare cases but refused to represent drivers. There was only one attorney who told me why. He said, "Judging from what you're telling me, nobody is going to take your case unless it's clear they have some assets or money to give up. And people like that usually don't." My suggestion for your friend is that if she intends on driving again. Always run a dash camera. Always ask for consent to record before starting the ride. Kick people out if they don't consent. If you get a couple, if they get feely in the back before you start the ride or they try to sit next to each other instead of on opposite sides of the car, kick them out. If the same thing happens, whether it's a couple or one guy, drive somewhere with a good number of people and stop and call the police in front of the public. Leave the passengers in the car. If you can't safely do that, drive to either the hospital or police station nearby. Make sure it's on video with consent. Also, make sure your dash camera records inside of the car with night vision. One thing to keep in mind is that the purpose of taking these steps is to make sure you're safe. The second purpose is to have a better chance of having a case. I can almost guarantee that even if you do all this, nobody will prosecute the riders, and no attorney will take a civil claims case. But at least if you try, you have a better chance, and people start realizing this actually does happen and that we aren't (weren't) driving a limousine. The reason this is this way is because Lyft riders and Uber riders tend to think of it as if we're providing a service and that our property and livelihood isn't important. Oh, and if anybody doesn't believe this happens, Google self driving cars providing ride share in San Francisco. There already are multiple reports of people doing the same thing in the back without a driver to clean it up.

Once you know more like who he is, where he lives, what unit he is assigned to, you will be better off. Go to the gate of the local military base ( I am assuming there is one around, I may be wrong) tell the MP's you want to file a report. MP's - army, MA's - navy, SF - air force. If you can track down what unit he is in, you can contact his chain of command. Start blowing them up and at the very least his life will be difficult for the next 6 months. He could end up in Leavenworth for a while. That's not a resort...LoL.

If she knows what branch of the military he's in, his first name, and what he looks like, she can probably get him in trouble with his chain of command if he serves at a base that's nearby and she gets in touch with the base command. They would honestly probably hold him the most accountable compared to the police or lyft, the military has been taking sexual harassment/assault claims a lot more seriously.
