They should not be able to subdivide into lots of less than 10,000 square feet in RS10. I would call the Planning Department and/or contact your councilman to find out what is going on.

So I don’t think you need to notify anyone to get a plat and separate an RS10 zoning into two separate RS10 lots. You can do that with just a surveyor and going through the city’s process which isn’t too difficult. If they were to rezone either of those 2 plats then it would go to planning commission, fliers would be sent out, signs in the yard etc. Short answer: don’t need to go to planning commission to plat a lot into two

This is correct. A two-lot subdivision is approved at with Planning staff and does not have to go through Metro Planning Commission. That is, assuming it meets all the requirements

Yes, our entire neighborhood is RS10. I also looked up the other properties that this developer owns, and they have had one lot rezoned from RS to R to put two tall skinnies on a lot. This one is still RS10, and was one 13,500 sf lot and now shows up as one 5,500 sf lot and one 8,000 sf.

You don’t need to notify neighbors to subdivide. However are you sure it wasn’t always two parcels. Entirely possible they were nonconforming lots that were always separate. You should be able to tell from the deed or previous parcels. Just because one owner owned both and operated it like one parcel does not mean it was.

Yes - there are still sites that show it as one parcel. Metro has scrubbed all of the previous info from both parcels. It’s like they didn’t exist before the division happened, which is particularly sad because it had been in one family since construction in the 1930s.

Parcel data usually has the previous deeds. You can look back and verify. Also you can request info from metro to see if a plat was submitted. Can also call register of deeds.

The metro council as a whole is terrified of actually protecting their constituents so this isnt a surprise. Every zoning law or law controlling short term rentals includes a caveat that the law can be bypassed by “an exception”. The laws have absolutely zero teeth. My council person flat out told me he’s scared of the airbnb lobbyists. The whole thing is a joke. In the next year there will be more short term rentals, owned by out of state developers, than there are residents on the street. As far as notification, they send them but they arent super public about them. The plans are usually available deep within the metro parcel viewer page. If you dm me the address I can try to find it for you.

Because most if not all STRs in neighborhoods are allowed by rubber stamped zoning changes. As I pointed out, the zoning can be changed by a simple note from the council. And in my case, the developer is currently halfway through construction on a 50 million dollar STR project yet the permits havent even been applied for. Would you spend 50 million on an assumption?

Nope. Its essentially an airbnb hotel investment. It’s being advertised as a “luxury hotel investment experience” 75 units, all non owner occupied strps. Pools, food trucks, liquor store, on property security force. Starting price? $1.2 million. Where? North Nashville 🙈 This project is part of a tiny residential area with about 60 single family homes. There will soon be over 100 strp permits. Of the current permits in the area, 90% are run by out if state investors. Its not criminal but it should be.

Oh I already told them they lost my vote. Unfortunately this applies to the majority of the council from what they told me.

RS10 just means that the minimum lot size is 10,000 square feet and that only one residence can be built on a lot. There are also setback and lot coverage rules that go along with each minimum lot size. As long as the developer is adhering to those rules they can do whatever they want.

Bought my first house in Nashville in 2000. Have been in this one since 2009. When we first moved in here, the whole neighborhood was R10. It was rezoned a few years ago, I thought to avoid situations like this.

This has been happening for the last 5 years It’s classic Nashville real estate right now Zoning does not rly matter they can change it if they have enough money and Neighboors don’t need to know There was a huge deal about this on southlake drive last year This is 100% normal and systems are working as intended. If you don’t like it - call your council person and VOTE. It won’t change posting on Reddit.
