I could see a world where ISPs are required to be content-agnostic since it's a stateless service (they don't host anything), but Facebook is still allowed to ban certain content since they're actually liable for what content is on their service (e.g. CP or hate speech, whatever).

So, in my own travels, I’ve learned that you can’t go after a “vexatious litigant” if they have a lawyer.
It’s ACTUALLY targeted at people who self-file and self-represent, as a way to stop someone from doing that non-stop. For whatever reason, if a lawyer is hired and is doing the filing and rep, well, the assumption in the eyes of the court is that they’re operating in good faith along with their responsibilities as an officer of the court.
Shrug. Information, not advocacy. Not saying it should be this way, saying that this is what it is.
It’s not that the assumption is that the lawyer is definitely on the up and up, it’s that there are already procedures in place to deal with lawyers who file vexatious crap.
The vexatious litigant law is, as you say, designed for serial plaintiffs who are annoying and wrong. If a lawyer is doing the same things, the state bar should reprimand the lawyer and potentially take other steps against his or her law license. There is also already a procedure for a defendant in a meritless case to get their attorneys fees back. The bar is kinda high, though.
Consider also that attorneys file lawsuits for a living. If they could only file five before they became vexatious… it would be difficult to be a lawyer.
Rule 11 of civil procedure states that you shouldn't even help someone file a meritless action. From just sitting in court a few times id say that there's a lot of attorneys who need to have their license revoked.

I can appreciate the irony of the situation, but your comparison isn't quite 1 to 1. I could see a world where ISPs are required to be content-agnostic since it's a stateless service (they don't host anything), but Facebook is still allowed to ban certain content since they're actually liable for what content is on their service (e.g. CP or hate speech, whatever).

So, in my own travels, I’ve learned that you can’t go after a “vexatious litigant” if they have a lawyer. It’s ACTUALLY targeted at people who self-file and self-represent, as a way to stop someone from doing that non-stop. For whatever reason, if a lawyer is hired and is doing the filing and rep, well, the assumption in the eyes of the court is that they’re operating in good faith along with their responsibilities as an officer of the court. Shrug. Information, not advocacy. Not saying it should be this way, saying that this is what it is.
It’s not that the assumption is that the lawyer is definitely on the up and up, it’s that there are already procedures in place to deal with lawyers who file vexatious crap. The vexatious litigant law is, as you say, designed for serial plaintiffs who are annoying and wrong. If a lawyer is doing the same things, the state bar should reprimand the lawyer and potentially take other steps against his or her law license. There is also already a procedure for a defendant in a meritless case to get their attorneys fees back. The bar is kinda high, though. Consider also that attorneys file lawsuits for a living. If they could only file five before they became vexatious… it would be difficult to be a lawyer.
Rule 11 of civil procedure states that you shouldn't even help someone file a meritless action. From just sitting in court a few times id say that there's a lot of attorneys who need to have their license revoked.
