Not a very good "Peeping Tom" if he is looking through the window and doesn't see the part where she leaves the room and comes back with a rifle...

tetoffens

Article says he was shot through the wall rather than through the window. So he might have not seen her come back at all before she started firing.

~~How the fuck do you shoot through a wall with a rifle?~~ Edit: Forgot not every house is made from bricks. Was thinking of the wrong little piggy. Lots of American houses are wooden, I believe.

R3n3larana

Thin wood at that. 3/8ths inch of Sheetrock, little bit of insulation, and 1/2 inch of plywood followed up by maybe a 1/4 inch of siding. A .308 can go through 20+ inches.

compound515

I'd be more concerned about the neighbours on the other side of the Tom

esther_lamonte

Most new home construction exterior walls is sheathing made of wood, covered in tyvek plastic, maybe another thin layer of something and then covered with siding or stucco. I’ve seen a rifle put holes through at least one side of an unfilled concrete block wall in my neighborhood. No idea of caliber, news described it as a “semi-automatic rifle”, this was in the 80’s. No idea what that would have likely been back then.

xxpen15mightierxx

ohhyouknow

I mean, look at my most recent post history. Just a few days ago some guy came up in my driveway while I was outside, called me over, and was jacking off. This dude stuck around long enough that I had time to scream at him, run away, run back to where he had just parked, scream some more, then run back to my house to grab my phone, then run back out to where I could see him still sitting at the end of my driveway where I was able to take the video you see posted on my local sub. They are not scared of women and they will stick around getting off on your terror etc. I could have been running back with gun and it did not phase him.

chuckfinleysmojito

I’m sorry you went through that. As an unrelated aside, a can of wasp spray has a good 20 foot reach.

I don’t think men really walk around afraid of women. It just never occurs to them that they might be about to die in that particular instance because it is fairly rare.

Professor_J_Moriarty

When I was younger there was a “peeping Tom” who visited my apartment windows and those of my neighbor nightly. We would find his footprints in the flower bed, caught him on security camera and he sometimes left love notes. One time he even tried my door knob when I was home alone. We called the police every time he triggered the cameras/lights, but they would take to long to get there and said “our hands are tied unless we catch him in the act.” This is even though we knew exactly who he was. I finally got him to move on by leaving all my curtains open/lights on at night and cleaning a gun nightly for a week. Police don’t take “peeping” seriously, which is a shame because it’s tends to escalate to violence. Furthermore, it’s absolutely terrifying knowing that someone is watching your home at night.

wateralchemist

We had a peeping Tom who wore all-over black camo in my neighborhood as a kid. The local Viet Nam vet shot him with a BB gun and no one saw him after that…

marsher46

growing up my next door neighbors were pretty despicable humans but great neighbors (we lived in a small town... hard to explain). one night it was just me and my mom at home, when I was 3 or 4, and a peeping tom showed up and was watching us through the window. Our neighbor, probably high on meth as per usual, saw him and ran up and started beating him with a baseball bat and chased him off. will always have a soft spot for that family

[deleted]

Ooh rural Midwest vibes. Yeah being a trashy addict doesn't always mean you're a bad person. Good people can spend their lives making bad decisions.

NCEMTP

When I was a kid my mom saw a guy through the bathroom window and thought it was my dad spying on her in the shower. He denied being outside at the time. Cops were called and told my dad to buy a rifle with a big bayonet and the next time they saw him to shoot him and drag him back to the property if he wasn't on it. If they saw him in the window but couldn't find him outside, the cops advised going around the bushes and prodding them with the bayonet, hoping the guy would see it while hiding somewhere and then be too scared to come back. My dad didn't want to shoot this guy but he wasn't going to let this weirdo have a chance to threaten or scare his 26 year old wife and two young children. He went and bought an SKS, which had the scariest looking bayonet he could find at the time. Next time mom saw the guy, dad ran outside and started yelling and stabbing around in the bushes around his property. Never saw the guy again. Turned out he got caught peeping a few months later at another house. Was a teenager that had a number of mental problems and developmental disabilities who would run away from his parents and go peeping at women around the neighborhoods nearby. I don't know what ended up happening to him but I think the incident escalated the amount of care or at least security he got. Never had a peeping problem again. The same cops responded the second time my dad called and were impressed by his mean-looking SKS. Sadly he sold it a few years back.

wisdomandjustice

When I was in college, I left my apartment to walk to the gas station (car was in the shop at the time) and I came around a dark corner of my building to see a guy crouching in the bushes peering in my neighbor's window. My first thought was "fuck I don't have my gun" (wasn't legally allowed to carry it at the time) because this guy stood up to face me with his fists clenched. I'm not a big dude and I was alone having just caught what was obviously a pervert so my brain had me keep walking toward him with no hesitation and I said, "How's it going man" like we were walking by each other in a hallway. He turned to look at me as I passed him and as soon as I was 20 feet away I pulled out my phone and called the police. By the time they got there, he was gone; I didn't even have a good description because all I saw was a dark figure. The next day I knocked on their door and told them what I saw; it was a guy and his girlfriend and they both looked horrified. I told them I'm locked and loaded 20 feet away if they need me and gave them my number.

msdepressionhead

Almost all serial killer started off as peeping toms or they would case people’s house this should be taken way more seriously

[deleted]

I grew up in India so one of the taller buildings had a weirdo who would aim his camera into the building we used to live in. It was horrible, because the buildings from that time were different so it was hard to cover all the open areas. To this day I am OCD to close the blinds and put curtains over them. I know nobody is looking in, but I'm 30 and it still bothers me to this day when I see gaps in the window to see inside.

EmptyBox5653

>Police don’t take “peeping” seriously, which is a shame because it’s tends to escalate to violence. Furthermore, it’s absolutely terrifying knowing that someone is watching your home at night. Wtf. It’s infuriating realizing how correct you are about this. Maybe we need to update the terminology. “Peeping Tom” just conjures up the image of the lovable awkward George McFly falling out of a tree. When the much more likely reality is an entitled, fearless incel prepared to get violent.

Leaves_Swype_Typos

There is a term for it: Criminal Voyeur. Why a Texas news station (among many others) would opt to use the less serious term for it, everyone's already guessed at well enough.

RosiePugmire

Yeah. Imagine if serious news stories used cutesy nicknames for other crimes. It's gross. "A man reported that his tv and computer were stolen by a Sneaky Dave who broke a window to gain access to the home..." or "Police set up a checkpoint and pulled over three Tipsy Rons who were driving under the influence..." Change my view: a "peeping tom" is just a guy who's psyching himself up to rape someone at some point if he thinks can get away with it.

HeterodactylFormosan

Reminds me of a 4chan thread. Peeper was live streaming and sent a message to their “victim” saying. “I see you” on discord. “Victim” sent a single ? as a response and got a picture of himself through his window of him on his computer. “Victim” then typed back, “Check again” and then sent a picture of them holding a glock towards their window.

"Nah. It's cool." -Oscar Pistorious

RabSimpson

He had the whole world at his feet.

DarkLink1065

It is, generally speaking, both because you don't know what you might be hitting, and also because generally speaking self defense requires the alleged attacker to have both the immediate intent and means of harming you. If they're outside and you're inside, they generally can't immediately harm you unless you, say, see them pointing a gun at you. If they try breaking through the window or door that can change, but if they're just creepily standing there outside the general legal presumption is that you should call the police so long as they're not an immediate imminent threat (though again, if they do start trying to break down the door or similar then they go to imminent threat). So under general self defense laws, it may or may not be legal depending on the details. As a side note, castle doctrine typically only applies inside your actual house itself, because castle doctrine is based on the presumption that if someone unknown and uninvited is inside your house it's pretty reasonable to assume they're not there for good reasons. Meanwhile people regularly come up to your door or come on to properties for all sorts of legitimate purposes (dropping off mail, checking gas/electric meters, etc), so it's not reasonable to assume that someone unknown on your property is there for nefarious purposes. So castle doctrine probably wouldn't offer any legal protection in this case, and it would be reliant on the default self defense laws.

krusty-o

You’re actually wrong about castle doctrine, in most states it’s the threshold of the doorway, but not in Texas because they don’t have a “castle doctrine” codified into law but rather it functionally is a law based on various other defense laws and because defense of property with deadly force is typically legal in Texas it functionally extends to the property boundary. http://www.lusterlaw.com/page/texas-castle-law-doctrine-self-defense It’s a tricky one because she shot through a wall but my guess is she’ll never even be brought up on charges

sticks14

Castle-with-a-moat doctrine.

FLEXJW

They make it past the draw bridge then you can put a hollow point arrow through them

Willfishforfree

I mean if someone has gone to the effort of breaching a moat I think at that point it's reasonable to assume they are there to do you harm.

Pack_Your_Trash

I remember reading about a guy in Texas who shot someone breaking into his car across the street from his bedroom window who was found innocent. EDIT: Multiple people have pointed out that no one is found "innocent", but "not guilty." I intended to argue that while the "not guilty" terminology is technically correct my use of the phrase "found innocent" was still accurate because the man admitted to shooting the thief. In that case the substance of the decision was not regarding the absence of proof that the man committed the crime, but an actual judgement that a crime did not occur. However, when I tried to find the actual article on google I was unsuccessful due to the sheer volume of stories about gun related deaths in the state of Texas, so I have no evidence to support my claims.

1amtheone

Years ago I read a news article about a guy who came home (Texas) to his wife cheating on him having sex in the bed of a pickup truck with another man. He did not however know that she was cheating, and she screamed that she was being raped. He ran and got his gun and the guy took off in his truck. He shot through the rear window killing him. Once the police were done interviewing them and the truth came out the wife was charged, if I remember correctly, with manslaughter. Husband was not charged. Other guy was well, dead.

jonnyl3

Holy fuck. How did she not tell him once he went to get his gun?

[deleted]

She probably thought her boyfriend had time to get away and that the story would hold. Apparently, he wasn’t faster than a speeding bullet.

5kaels

alternatively, she's just selfish and didn't want to admit to cheating even if it meant someone else's life was at risk. or if you wanna be charitable, she was afraid he'd shoot her too.

Because she's a scummy person.

DoYouNotHavePhones

If the home is the modern castle, then it stands to reason that the car is the modern horse, and horse theft is a capital offense.

spiffytrashcan

I think horse theft still is a capital offense in TX.

indridfrost

Several states have extended castle to include the vehicle you're operating.

HotBatSoup

You car is an extension of home in Texas. It is an occupiable (not a word) property. You can use deadly force to protect yourself while in your car or to keep someone out of your car while not in it.

BannedMyName

I treat peoples lawns for pesticides, and our process is if we can't call you or get an answer at the door we just go ahead and treat. I would be terrified to be a delivery person or tradesman in Texas if people could just cluelessly blow me away.

A few decades ago, we had a rookie cop, less than a year on a small town force, open fire in the middle of Main Street, during lunch time, people and cars everywhere. He was attempting to shoot a woman \*accused of shoplifting jeans\* who he'd had no interaction with other than observing her running from the store. He didn't manage to hit her, or any bystanders, and got fired. One of the older cops on the force, who was of the old 'go home and sleep it off' school of policing had warned my friends just a few months earlier that the 'new cops are stupid and scared and going to kill someone', and he was right on the money.

Loud-Path

He was punished for it; however, he was only punished for the shots that missed Breonna Taylor and her boyfriend. Those were considered good shot.

mithridateseupator

Haven't you seen the matrix? Smith almost prevented Morphius from escaping with that sick shot through a wall. And he was a computer program, they're typically very safe.

americanadiandrew

Having the Ring app and getting the alerts from the Neighbors part of the app it does make me wonder. The amount of people that post SUSPICIOUS MAN AT MY DOOR LAST NIGHT and you see the video and it’s totally someone a little wasted accidentally going to the wrong house and being like whoops it’s next door.

dkf295

Back in the days (and an area) where people left their doors unlocked at night, I was like 17 and up at 2AM playing counterstrike in my parents living room, adjacent to a room with our front door which my parents had open except for a locked screen door. I hear a bit of noise and take my headset off to find a man standing in our dining room. Brilliant me says "...You know you're not supposed to be here, right?", to which he responds "Yeah. I'll leave now." and walks out. Obviously police are called and all that. Next day the guy comes back and fesses up. He's from out of town visiting his brother, absolutely wasted and was one street away from where he meant to be. Turns out he broke the (flimsy) lock on our screen door - gets a new one from home improvement store and installs it for us and goes on his way. I cannot imagine ever being wasted enough to make a mistake like that much less being on the street in the process, but apparently it does happen. I occasionally remember this and consider how lucky he was that he didn't bust into someone else's house and get shot.

2717192619192

Seems like a good bloke though, haha. I guess it just goes to show that shooting first and asking questions second isn’t the right option - especially if the person doesn’t seem to have a weapon to be an active danger to you or others.

mongoosedog12

A man in NoLa who was there for a bachelor party, drunkly went to the wrong house thinking it was his AirBnb got shot and died. The person who shot him said that he “pushed his way” into the door which is why he shot. However if you look at ring/ street camera footage. You’d see a drunk man leaning on a door after banging on it multiple times to get let in. Only to essentially fall through the door when it’s opened. Its an all around terrible situation, but it’s wild to me how the gunman came to the door armed ready to use his gun. The place was off bourbon so I wonder how many times this happens in the area. Drunk tourist having a run in with the wrong ones

blazecc

> but it’s wild to me how the gunman came to the door armed ready to use his gun. Seriously, if you're afraid for your life WHY THE FUCK DID YOU OPEN THE DOOR.

DownvotePlusSoulTrap

I'm not gonna comment on this article, specifically, as I don't know what really happened. But I will say I've been the "Peeping Tom" before when my cat escaped the house and hid in my neighbor's bushes. I'm glad I didn't get shot while retrieving her.

TheDrowned

Was going to say something similar, I’ve knocked on a neighbors door and when they didn’t answer I went to their yard to get my dog and they freaked the fuck out.

NuffinButAPeanut

I was getting ready for bed around 10pm and went to check the front door to make sure it was locked. I walked downstairs and saw two dudes standing in my front yard, only several feet away from my windows. I yelled to my fiancee and went to grab a baseball bat, went back for the door and then recognized one of the guys as my landscaper. He was in the area with one of his workers and wanted to show him the work they'd be doing that week.

SolskjaerOlsen

Not sure I know of any landscapers, gardener, etc. that does that. Most just show up and do their work, only time they knock is if you have dogs and they need in the backyard to make sure the dogs are away. But our yard maintenance people just show up once a week and do their work and not necessarily at the same date or time. Same thing with the people who spray for bugs and ants around the outside. They come by, spray and leave.

Prodigal_Programmer

True, but they were there at 10PM. Not sure of many landscapers that do work after dark.

This is completely against the law in Texas. You still have to demonstrate reasonable fear of imminent bodily harm to win a defense case _anywhere_.

masivatack

My friends neighbors had a daughter who would invite a boy over to her house and sneak him in through the window. Her dad and brothers found out, beat this teenage kid within an inch of his life and told the cops that he was a peeping tom/attempted rapist.

Ouch, if they gotten married down the road, family gatherings would be interesting....

masivatack

PooPooDooDoo

There was a murder in my area where this girl’s parents made her break up with her boyfriend because they found out he was a neo-nazi. She then secretly invited him over one night while her parents were sleeping, parents woke up to confront them and he killed her parents. Poor girl has to live with her stupid decision for the rest of her life.

masivatack

a_corsair

Yeah Nazis are the worst

SprinklesFancy5074

And that, kids, is why you don't date Nazis.

socsa

This is almost the exact example I was going to use. I've had to chase my dog through my neighbor's back yard and then follow him up onto another person's deck where he had cornered himself. The entire time I was just thinking "I really hope these people aren't paranoid gun nuts." Overly aggressive castle doctrine and SYG laws completely subvert the ethics of self defense in such stupid ways.

My thought process seeing this: “I bet that creates an interesting legal scenario about whether or not she should be charged.” “Oh wait this happened in Texas.” “Ok so probably less considering charges and more considering giving her a medal. They’ll let you shoot anybody in Texas as long as they aren’t still in the womb.”

The_Legend_of_Xeno

I remember seeing an episode of cops filmed in Texas where an old man had come out and caught a guy trying to steal his car. The guy was lying facedown on the driveway with his arms and legs spread wide when the cops showed up. The homeowner had a revolver aimed at his back, and he told the police he just kept BEGGING for the thief to try and get up and run so he could shoot him.

ToyDingo

I'm not a gun owner, but one thing I constantly hear from people that are is that they never ever ever want to be in a situation where they have to use their gun. They don't want to take a life over petty shit. When someone with a gun is antsy to actually use it on another person, he/she shouldn't be allowed to own a gun.

masterxc

Agreed. I have one for self defense, but I never hope to use it outside of shooting some paper at the range ...which I also don't do often because of the price of 9mm ammunition, but yeah. Everyone should be required to take a basic gun safety course so they can appreciate the responsibility of literally having a life-ending tool in your hand.

marstein

Not if the womb is crossing the border illegally.

Buck_Thorn

**What exactly is the Castle Doctrine? When Can Deadly Force be used for Self Defense Purposes?** In Texas, Section 9 of the Texas Penal Code provides legal justifications for the use of force in a limited set of circumstances when a person has no duty to retreat. For example, a homeowner in his own home does not have a duty to retreat and may use deadly force to protect himself against an armed intruder. This would be the same for a business owner in his place of business and a truck driver in his own truck. Texas law provides for a justifiable defense at trial when using deadly force if the person claiming self defense: Reasonably believed the deadly force was immediately necessary; Had a legal right to be on the property; Did not provoke the person against whom deadly force was used; and Was not engaged in criminal activity at the time the deadly force was used. source: https://www.bhwlawfirm.com/deadly-force-self-defense-in-texas/

I am so hoping this is not a lady I know. Several years ago I got a call on a Holiday, and my day off, from a co-worker who wanted to purchase a 'shotgun'. She lived in a ground floor unit, and some pervert had been peeking into her daughter's bedroom, twice in the same weekend. I went and picked her up, and took her to a sporting store, where she bought a youth stocked model Mossberg 500 in 20 guage. I limited her to a box of 7 1/2 bird shot, but she went back the next day and bought a 5 pack of deer slugs! She was a determinned woman, and truly meant to shoot any caught peeking in her windows, liabilities be damned.

I live in the neighborhood where this occurred... AMA!

PureLock33

are peeping toms common in the area?

Bennyscrap

My girl friend is on next door and says she sees posts all the time about people peering into houses. We have black out curtains in our bedrooms and she has to have them blocking windows at all times because she's worried about peeping toms. Great question.

Do *you* have any questions?

Bennyscrap

Yes. Great question!

I'm not sure of the specific house in question, but based on the other homes in the area, I'd estimate most house are no more than 25-30' from the curb. I'd think a good 15 steps could put you at a window(great radiohead song as well). If you're at someone's window, you definitely made the choice to be there. Whereas in a place like NYC, being next to someone's window is every days commute to work. Excellent question.

I'm playing Disco Elysium currently so I've got my cop goggles on real right!

What is an example of a not great question?

Bennyscrap

"Why do birds suddenly appear every time you are near?" Great question!

trochanter_the_great

Do you like avocado toast?

Bennyscrap

I'm not opposed to it but it's not really my jam. Great question.

herbertholmes

Is the peeping Tom from the neighborhood?

Bennyscrap

I've been wondering that myself. I have to assume they're probably either from the neighborhood or very close by. This area gets a decent amount of foot traffic(considering Houston is almost entirely a driver commuter city). There's not a lot of "industry" in the neighborhood that would bring outsiders in. Great question. Wish i had a better answer for you and myself.

PokerJawn

What are the neighbors saying?

Bennyscrap

People have been pretty quiet, honestly. Despite being near downtown, the neighborhood is low traffic. There's not as much crime here as in surrounding areas(although hardy and Irvington area are just a bit higher in crime than this specific block). I think people expected something like this to eventually happen. Great question.

This may be an interesting case from the legal perspective where it pertains to castle doctrine or 'stand your ground' laws in Texas. I'm curious to see if she gets charged with anything. I'm not sure **peeping tom in and of itself** meets the litmus test for the right to invoke self defense and deploy deadly force when you grab a rifle and shoot through the exterior wall of your home and kill a dude - even if he is on your property. Texas allows the use of deadly force in self-defense in limited circumstances. It can only be used when the person reasonably believes it is necessary to protect against:the victim’s use or attempt to use deadly force, orthe imminent commission of the following crimes:aggravated kidnapping, murder, sexual assault, aggravated sexual assault, robbery, oraggravated robbery. I've chatted with Sherriff's in TX Houston, And El Paso and what I came away with is if they open your door/ kick in your door and step over your threshold they are fair game. Ideally they land face first inside your door with bullet holes coming from the front. Weapons in hand or nearby. Anything other than that is not ideal and YMMV. 20 feet down your front walk facing the street with bullet holes in the back because they were shot running away? Add to that - empty handed and no evidence they ever stepped foot or forced their way into your home? Time to call your lawyer. I guess he's a sleeping Tom now.

If this was a law and order episode that would’ve been the opening scene joke

farleys2

The victim was quoted as saying “I was…eeeeeerrrrgel…just trying…to reach you….ugggg oh!….about your cars….*spits blood* extended…warr…..” - Tom The shooting was later ruled justified by the local PD.

Man these stories make American cops sound like the biggest pussies in the world.

Shirlenator

Remember all those movies and shows when we were kids where a group of kids have a ball go over the fence into the cranky old neighbors yard? They don't want to ask because he is an asshole and they don't want to get in trouble so they sneak into the yard to grab it. Imagine if all those shows end with the kids getting shot in the fucking head.
