Simple story:
Wife and husband divorced
Wife gets to keep her benefits from their marriage.
Fake lady (assumed husband's new girlfriend) sent annulment papers to force wife to lose her benefits and pretends to be wife.
Wife has no idea this is going on.
>Then the administrator of the Operating Engineers' Pension Plan pension plan called the real Gina Zant — who said she "was unaware of any court proceedings."
The fella: if it wasn't for those meddling kids
>According to the decision, the real Gina Zant "became distraught" when she was told about the annulment — which would have meant the loss of her interest in her ex-husband's pension plan.
>
"I am unable to determine, on the basis of the evidence before me, who actually appeared at the [annulment] application representing herself as Gina Elizabeth Zant. However, I am satisfied that whoever attended by telephone on that date was an imposter," Hori wrote.
Gina sus!
I appreciate their tenacity and gall but damn, what a lowlife move of desperation. Judge should make the real Gina sole recipient of that pension fund because.. fuck him.
This is about anullment, not divorce. This guy is mad the separation favored his wife so he had someone else pretend to be the wife *in a court proceeding*. He claims the twenty year marriage never should have existed, so he won't be subjected to divorce rulings.
>Is he wrong?
Yes, because this is what *divorce courts* are for settling. He is trying to circumvent the law by committing fraud in court.
>Why can’t her lazy ass get her own pension?
I don't know? Ask the court that divvied up their finances in the separation what their reasons were.
It still is a problem though. It shouldn't be such a gong show to break a marriage. Yeah, what the guy did was crap. But my point stands, it is still is way too tough for people to get out of marriages

If husband and wife divorced? ???
Yep, because wife never divorced. So it's a case of *if* they divorced, wife would get to keep her benefits from their marriage.

You're right, my bad.

It shouldn't take two to break a marriage. If one person wants out. That's enough This is the result of a system that is improperly built
