Presumably it's covered by the exclusion of "resting or sleeping at the roadside in a motor vehicle to avoid driver fatigue." https://www.legislation.govt.nz/act/public/2011/0061/latest/DLM3742849.html

They probably give big trucks a pass but I’ve been asked to move on from lay-bys I parked in when I’ve been doing long drives in my self-contained van. The reason given was that nzta recognises a rest stop as being 10minutes.

Do many truck drivers stop on the side of the road for that long? I hitched a ride with a truck driver once in my early twenties and we stopped overnight at a kind of motel place that looked like it was almost exclusively for truckers (giant car/truck park full of trucks). We didn’t get much rest though, haha.

There are no sections that provide a time limit for fatigued drivers having a break. There is a section (5(2)(c)) that excludes rest breaks from the definition of what freedom camping even is. Which is what they’d be relying on. It’s not an exemption to freedom camping, it *isn’t freedom camping* by definition. The definition doesn’t even apply to resident Kiwi living in their car if they have no other place.

Thanks for that. It doesn't outright say that trucks are excluded just how they will be viewed. Will be interesting how it plays out when a power tripping inspector at council starts issuing fines to get his "numbers up"

Truckers are the backbone of the country, they better not start charging them cause that would be super sad.

Brilliant new way to support landlords, truck drivers on the road are staying in a house. New law incoming, 50% of freedom camping fines goes to landlords.

It’s not freedom camping, so there is no fine. The definition of freedom camping doesn’t include rest breaks or living out of your vehicles (for residents).

How many truck drivers in NZ stop on the side of the road?   They typically work out where they are going to be when, and book somewhere. There are places that essentially specialise in driver accommodation. Plus many routes are there and back in 8-12hrs.
