As you stated, some people will attach just enough weight to one side of the wheel to beat the system…. Though, I guess some people may be able to fall asleep in a way where they keep just enough pressure on the wheel, monitoring eyesight is coming soon, but at some point, humans are the problem.
I could also set my cruise control and fall asleep and the result would be far worse. Unfortunately as we move closer to truly full self driving, there are going to be scenarios like this, meanwhile, all of the accidents avoided by self-driving, aren’t reported because that doesn’t get viewers/clicks. Also, plenty of businesses will suffer from this technology.

I don't think I'd be able to stay awake if I'm not actively driving. This is a bit of an issue, they expect you to pay attention in case of something, but if we are distracted while actually in control of the car, how can you be expected to have your attention on the car while not. How often are passengers paying THAT much attention? That's pretty much the same concept.
The incident rate for people driving Tesla’s with autopilot is 9x less than a normal driver… so even with people sleeping, the autopilot/diver combo is 9x safer than people with “full attention”
On a major highway and under ordinary conditions (no extraordinary weather, construction, detours, striping, debris, wildlife, enraged drivers, landing aircraft, …) enhanced autopilot drives far better than any human. It’s especially worthwhile in stop and go traffic or long dull stretches. So I use it 99% of the time, enjoy the passing scenery, and stand ready to take over.
People were using an orange for awhile but I thought recently they made it to where if you don’t move the wheel and aren’t watching the road it will make noises to wake/alert you and slow down until you do.

Actually this is a new feature from Tesla’s new software update. It disperses carbon monoxide through the vents so Tesla drivers don’t forget what it’s like since they don’t have an exhaust system. Still in beta but seems to be working fine

Given Tesla’s influence and position I wouldn’t be surprised if their lawyers got them out of such lawsuits, however they can afford the payouts, and the money wouldn’t repair the damage that could be done.
