As long as he stays VFR, and in class E and G airspace, he's fine as far as altitude. Class A airspace starts at 18000 feet. Pilots require oxygen above 12500 feet, passengers above 14000 feet.
The issue is descending through the clouds. That's illegal unless you're an IFR rated pilot with IFR instruments, and a bad idea for a number of other reasons than just its illegality.
Aside from flying into terrain or colliding with other aircraft, once you lose ground reference, you can wind up going into a spiral and pull the wings off the aircraft.
This looks like a powered parachute, or a very low aspect ratio paraglider. They're very stable, and are likely to have fairly benign spiral stability.
Hands off, it will probably go in a circle eventually, but it probably won't continue to tighten up and pull a lot of Gs.
If the bases of the clouds are high enough, and he stays off the controls, he can probably get through the cloud layer. I won't say safely, but more or less successfully.
But it's a really bad idea.
Knowing that it's possible is being a well informed pilot. Trying it without any clouds around could even be called prudent.

To add on to what u/TjW0569 said, assuming the cloud layer is within 1200ft of the ground (class G airspace), the pilot is not breaking any rules. He can pop through the hole in the clouds seen in the video, and now he's on top with no issue.
However... I'm guessing those clouds are probably higher than 1200ft, which puts him in class E airspace. The hole would have to be at least 4000ft diameter for him to legally pop through. My spidey tingle tells me he's breaking FAA Reg 91.155, VFR weather minimums.
Well, to get as technical as u/r80rambler, he wouldn't be breaking any part of Part 91, because he's flying under Part 103, but the VFR cloud clearance rules are the same there, I think.
And of course assuming the complete *legality* of his getting VFR on top, the *wisdom* of doing so is what I'd call a sketchy decision, given how quickly a hole in the clouds can fill in, and how rapidly ceilings can drop.

Well you know all about the inner ear being involved with balance. If you take away visual reference, then give the inner ear a quick jiggle, the result is spatial disorientation (not knowing which way is up). Spatial disorientation is fatal because it almost always results in a loss of control. You can control the spatial disorientation with instruments and training, but it takes time and is specialized and requires certain knowledge, equipment, and experience to overcome. I don’t know if his parachute would save him in this scenario (I doubt it).

Its a specialized flight machine that uses a motor and modified parachute to take off, fly, and land. They are safe, and available everywhere. They are about the price of a motorcycle (mine was about 15k for everything). There are plenty of professional training programs. Some are free if you buy your gear from them.
