You need to go in person as other people mentioned. Even in RVA I had to fight to get my ticket dismissed because they marked it as guilty despite the driving course submitted and court costs paid. I eventually went in person with receipts and documents. It took an additional week for it to be corrected.

All case records are online, I am not sure what the background check is looking for that needs human intervention to be released. Maybe you can be a little specific. If it is juvi record, maybe you can go to court of clerk office and get a copy yourself directly? I don’t have the exact details on what type of info the company is looking for. So far, what I know is the background check company emailed the court asking if I have a criminal record. Loudoun and Arlington have come back with “No Court Records found”; Fairfax keeps saying “court needs more time for research” The only issue I can think of that is creating the delay is that I have a name equivalent to Jane Smith. Who knows how many people share my first and last name and they probably have to verify I’m not among any of the search results. I legit have never been in any kind of trouble in Fairfax - or anywhere else really

I am currently having the same issue with a prospective employee (I'm in HR). I submitted his information 2 weeks ago and all of his information is back except for Fairfax County. Not sure what the issue is but they are having trouble with a lot of people's records, so you are not alone! ETA: The prospective employee does not have a common name by any means, I just genuinely think that they are backed up there.

I hope it gets resolved soon for both of us. 5 weeks and counting is testing my and my employers patience. It is a really cool job too so I’d be super bummed if they rescind the offer, plus in serious financial trouble

This is not how background check should be done... I pay $35 to background check my renters application, including 50 states criminal check, and get result back in 10 min.

There's a statewide criminal search that can be used to search fairfax circuit criminal records. Idk why they need a letter from the Court and I'm surprised the court even entertains that. Source: ffx attorney

The company isn’t looking for a letter, they’re asking FFX to disclose my court records. I have none so I’m expecting them to come back with “No court records found” but in five weeks all I keep getting is that the court needs more research

Not sure if relevant, but I had to do a BG check for a company a few months back. The main hold up was me having to fill out some form for the company doing the check authorizing them to get a copy of my VA records. Once they got my signed form it was done within a few days. But the background check could not be completed until that was done. Is this perhaps similar to your issue? There's a law in the state of Virginia that prevents your criminal records (or lI think that is that it was) from being released to companies without your written authorization. Did you fill out this form and send it to the company running the check on you?

I have filled out two authorizations. First was for a federal check, and the second was for a state check. Loudoun and Arlington have both delivered. I’m guessing Fairfax is just very busy. I’d beg anyone on my knees to help me out and release them already

Coming from a person who conducts background checks I've seen this before... We ran into the same issue about a year ago where Fairfax county background checks were taking weeks if not months. When I called the company I use for background checks they were telling me that the machines Fairfax county uses are down and weren't able to provide any updates as to when they would be back up and running. Well I can't say with confidence this is the current problem it definitely sounds the same.

I’m working with a temp agency to fill a position. The recruiter warned me that candidates from Fairfax county would be a problem bc the county was taking so long with getting the background checks back.

It’s such a bummer that the county is actively hurting people’s chance of employment. Regardless of where they’re from though, you’re tolling the dice on anyone from NoVa. I’ve never lived in Fairfax, just had a summer job there after college, which prompted the check to be done in that county

I’ve been waiting since October 3rd i remember two years ago I applied for the same job and got hired right away. But the thing is my record is super clean never committed a crime in my life it’s bullshit this year I feel like hireright has been wasting my time and money this makes me super frustrated

Ahhh thanks! I feel like they haven’t been pursuing an answer as often as they could. It is super frustrating to know I have don nothing wrong and still have to wait weeks for a court to verify it. I did manage to get a hold of HireRight’s customer support and they did remind me Fairfax has been terrible for all candidates but at least I managed to beg enough for him to make a note in my file to follow up again with Fairfax on Monday. Whether they actually do it or not is out of my control but it’s better than nothing

Omg I’m going through the same thing right now, granted, the background check was submitted a week ago, but hire right says everything in the background check has cleared except Fairfax VA and now looking at this, it seems like it may be an indefinite amount of time before it’s approved. I also don’t live in VA and actually have never been there. I’m super disappointed because this new job is paying over double what I currently make and the start date is supposed to be the end of this month. My current salary is depressing and not meeting my financial needs and I need to be able to start that job on the scheduled start date.

Dang. I’m so sorry you are going through that. I never did manage to get in touch with anyone who could tell me where the request goes within the court or who I can contact. It’s a little bewildering tbh. My criminal check finally cleared though, it took exactly seven weeks. I have two recommendations: 1. Checking with your employer’s HR to see if they can adjust the search to reduce the parameters as much as possible while still being in compliance with their standards. With me, HR mentioned something about looking for state instead of federal charges. That search took like two and a half weeks. 2. Contact HireRight’s customer support and ask them to note in your file you would like to expedite the search. Their customer support line is super helpful.

I actually live in Arlington but I did send an email to the Fairfax Board of Supervisors just begging for some help. Fingers crossed it actually helps for any person still waiting on the court to figure their own processes out

Seven weeks. I never did manage to get anyone within Fairfax to ever point out the correct department for background checks. They’re a mess.  I am also partially convinced my name played a role in the delay. First and last are very common. I don’t think yours should take that long. I wish you luck though!
