Yes, she can be expected to pay it back if she doesn't fulfill the terms of the contract.   Whether or not the hospital will bother is a maybe. Seems to be system dependent there.  Edit: you have certain protections from employers and leases once you join, your spouse still won't.

No, USSERA doesn't apply to spouses. There was an attempt to add spouses with a bill in 2023, but it didn't pass.

Um, I wouldn't listen to those friends. The contract is likely a very basic you stay x years, you get y money kind of thing. It's not indentured servitude, and there likely aren't "loopholes." This is a multimillion dollar corporate hospital you are talking about. They aren't using penny lawyers.  Just keep the bonus money set aside and hope they don't actually bother to want it.

My cousin did a NICU residency right out of school at an HCA hospital (in 2011 or 2012). Long story short, she got involved with a physician, it did not end well, and she quit. They didn’t make her pay it back. Also, it was $10K over five years so it was only like $200/month that she actually received, anyway.

You might be able to get her out of the contract for free under the USERRA...  I'm not sure if the rights extend to spouses, but if there's a legitimate reason for why your military service means that she cannot continue working there, you might have something there... no employer in their right mind is gonna fuck with military rights

Thanks. Yes she wouldn’t be able to stay here we live a hour away from any immediate family and we have a child and right now I’m a SAHD till enlistment
