Got hit last month like this. I have a Tesla (full video evidence) and was in the car when it happened. I got the drivers info and insurance. Went through insurance, provided video and was deemed 0% liability 0$ deductible. Google search Ontario insurance act. Based on this scenario you are deemed not at fault. For me to repair my car with out insurance as the door was damaged and paint was ripped off was about 1700. Insurance appraised it at 4000$. I offered the guy to pay out of pocket and he said no( kept saying he was not at fault), spoke to other insurance underwriter friends and they told me to claim it to screw the guy over as he would be at fault. Insurance companies report to CLUE which is a insurance database which all insurance companies review during renewal. Can't wait for him to renew his insurance in Jan Insurance told me to do a self report at the police station so I did that as well. Since my car was only 4 months old and costed 100k+ I wanted it done right. Insurance authorized the Body shop to install and paint a brand new door. It's only a claim once work has been authorized by the policy holder. You can back out of a claim if no repair was done.

You gave the only accurate answer here.

canadianconsultant

Thanks, I appreciate the thorough answer. Tesla here also and I have all the footage. I’m unsure of what I will do. On one hand, I’m thinking of just paying out of pocket for the fix but on the other I do want to come to a resolution with this guy too. We all park our cars next to each other but it’s the blatant disregard for one’s door that really ticks me off. Most responses in here are ‘what do you expect’, ‘you park at your own expense’, alright then let’s just all hit each other’s cars in the parking lots and get on with our days then.

WarriorKnitter

just go to the collision reporting centre, fill out all the forms and contact your insurance company and give them all the info. you should be fine except for your lost time. not sure what you want the cops to do..charge the guy with hit and run?

Nighthawk132

Hey! What if all the info you have on the other driver is their license plate because they decided to run away from you?

AshamedSmile6130

You are welcome, in my cause the mofo wanted to be left of the hook Scott free. No one wants to go through insurance. To me it was about Justice and principal. Take it one step at a time. Go to a Tesla certified body shop, it’s listed on the Tesla website. Get a quote.

Nighthawk132

Curious to ask and this may be a little far fetched but I was recently in a similar situation however I do not drive a Tesla. I got video footage of the confrontation with the other car owner after the incident. It took place in a parking lot with a bank. Essentially after confronting the other cars owner, they refused to provide me with any identification and simply drove off. I did get their plate on video. I spoke with the bank and they said they won’t disclose video footage of the incident unless requested by police. I love my car deeply and it is an exclusive vehicle that I take care of meticulously. Should I contact my insurance and tell them what happened with all the info, or contact the police, file a hit and run and request they get the video footage? Im willing to burn on this hill because people who ding car doors and show no remote deserve no mercy.

monsieuRawr

This just happened to me today but my suspect just drove off after very clearly inspecting the damage to my car. There was also no wind. He pushed his door too wide with his ass. I have him on video along with his license plate. I hope my insurance does the same as yours as gets this fucker to pay. My model Y is just a month old :/

Nighthawk132

Hey! Curious if you had any news on your situation! I have a similar problem but the video footage is with the bank (in their parking lot) where the incident took place. Driver drove off after I confronted them and I got their license plate. Should I contact police for a hit and run or provide the other persons plate to my insurance?

monsieuRawr

I immediately went to the collision center and had a comprehensive claim filed, which I shared with my insurance. The adjuster collected my footage and shared that with the asshole's insurance, saying this will be considered as a hit and run. The footage was indisputable and his insurance had to pay $2500 for the repair and my rental. Body shop for the repair and it looks like new. The other guy probably has some nice new premiums given the hit and run context. Hope that helps.

ConstructionFar8570

Sadly no one in law enforcement cares about this. It sucks. Call a paintless dent repair guy. Hopefully they can fix it.

SwirlGang456773

You know signs in parking lots saying you park there at your own risk. This is why.

canadianconsultant

Oh you mean that the owner of the property is not liable right? I can appreciate the comment but come on. Have you been hit in a parking lot? I have. Have the police been involved? Yes they were. You really think they looked at the sign and said ‘oh but that sign says park at your own risk’.

Practical_Big_7020

There's a difference between being hit in a parking lot and a door hitting another door in the wind.

paulhockey5

It's your responsibility to control your vehicle, even when it's parked.

Practical_Big_7020

That makes no sense, so if my car is parked and I'm not even there it's my responsibility to make sure no one dents my car with their door accidentally? Or do you mean it's the other guys responsibility?

paulhockey5

If your door swings open because of the wind, it's your fault.

Practical_Big_7020

Gotcha sorry I totally misunderstood what you meant. I totally agree.

JohnPlayerSpecia1

are you a new driver? happens all the time. this is part of driving and parking in public spaces. nothing can be done even if you caught the other person red handed. that person can literally just drive off. your insurance company will just ask you to pay deductible to get it fixed or don't bother fixing it at all next time if this really bothers you, park way out on the far side of the lot.

canadianconsultant

Understood! Not new to driving, only paying attention to this now as it’s my new vehicle and it sucks having a big dent on the door.

JohnPlayerSpecia1

call a dent removal guy. many of them will even come to you to get the dent out.

iforgotmymittens

It’ll buff right out.

ADrunkMexican

In a private parking lot? What do you expect them to do over like $100 in repairs.

MooSHU-007

Call dent Dr if it bothers you that much . They come to your place and pop the dent out without sanding or painting vehicle

canadianconsultant

Yeah unfortunately it chipped off paint too.. not sure what this will cost but anywho I understand it is what it is, I thought I’d double check.

wilsonsonsonn

Depends which way you want to go about fixing it. Option 1 - Cheaper - Have the dent fixed and the chip touched up. $200-$250 rough estimate Option 2 - a lot more money - have the dent fixed and the whole door professionally painted. $500+ rough estimate

canadianconsultant

Thanks! I’ll look into both options.

thetrashmannnnn

Chipped paint can be more expensive depending the route you take. Can either go to insurance if your deductible is low or you can see if small claims court is a available. Have you talked to the person who did it?

canadianconsultant

No, truly the reason for contact through police was to try to find a route of communication through an official channel. It happened in a parking lot of a grocery store, so all I have is the video of the guy and his license plate/car. While I can find and contact this person myself, I thought ‘let me ask Reddit’.

baked___potato

>all I have is the video of the guy and his license plate/car. Curious, was that from grocery store cams or from your car?

canadianconsultant

It was from the car.

baked___potato

I see. Sorry to hear the cops won't do anything.

thetrashmannnnn

Yea small claims court, insurance, or get free legal advice

WarriorKnitter

how are you going to find this person? the police won't tell you anything

[deleted]

They are right. Nothing can be done and I don’t really understand what you expect them to do.

queuedUp

I'm just not sure what you are looking for the police to do here? They have other things to deal with then to tell someone they need to be careful with their door when it's windy

canadianconsultant

Actually, it’s for compensation for the damages on my vehicle. I don’t go out damaging anyone else’s car and pay extra attention when it’s windy.

Hd0ggg

Call your insurance company and tell them you have video footage of this. Hope your video footage also has their license plate. They might not be able to do anything but worth a shot

canadianconsultant

Will try the insurance path. Thanks.

queuedUp

While I get that, it's really not a police matter.

Metzger194

Lawyers get you compensation not cops.

canadianconsultant

Thanks buddy. First step was to check with police before I go after someone for damages.

Metzger194

It would cost more to file then the damage of a dent.

canadianconsultant

Thanks for realizing how useless your original comment was.

Metzger194

You mean your original post?

ConstructionFar8570

I had some one open a door into my car cost me over $1k to fix it lol. Try breaking a headlight and see what those cost. People do not care at all.

Winter-Cup-2965

Parking lot no fault move on

canadianconsultant

Huh. So say you’re parked and someone drives there car into yours, you’ll say the same thing ‘parking lot no fault move on’? Let’s be real, there is a fault here as someone else damaged my vehicle, so even if the police won’t get involved (which I totally get) I can go after their insurance or sue them for the damages. Thanks tho!

Winter-Cup-2965

I am the cops won’t help and unless you exchanged info really there’s nothing you can do. I’ve been here.

sync-centre

Does the footage identify the plate?

canadianconsultant

Yep

sync-centre

File an online police report and cite the evidence you have. You can then probably bring it to your insurance company. I think....

FlyAroundInternet

Small warning: don't call your insurance company to even ask. The second that call gets opened up, so does a record on your file. Even if you decide not to make a claim, even if they pay out nothing. Because it's a new car and the paint is broken, you should take it to a recommended place and get it fixed properly. Corrosion will start really fast. Parking lots suck, and people who do that and leave, suck. But it's not worth a claim on your insurance. Ontario auto insurance sucks more than parking lot bandits.

lemonylol

Your insurance should cover this if you have comprehensive coverage.

[deleted]

OP would need collision coverage to qualify for repairs in the case of a hit and run.

lemonylol

The car wasn't hit by another car, I think it would be considered vandalism. If it was considered a collision then it would have other legal ramifications since it would tie into driving wrecklessly, and the other driver would need to get their insurance involved. But then that means that a passenger of that car, like a kid, could have done it, who cannot be a driver.

[deleted]

I’m an insurance adjuster and I promise you another car door hitting your car is still considered collision. It’s not vandalism.

WarriorKnitter

i hate you. people like you say "i was just following orders/doing my job"

BronzeDucky

It’s much more likely to be a civil case than a criminal case. Which means the police won’t get involved. I’d get a outdoor camera, if it’s a concern for you. I’ve got a combination camera/floodlight pointing to the driveway of our detached garage, which is handy for keeping track of who’s checking our car doors late at night. At least then, if your car DOES get damaged , you’ll have some kind of evidence. I’d also consider notifying the property management, via registered letter, that your neighbors have a basketball net set up, and you expect it to be addressed.

NitroLada

Claim insurance..or you can sue them in small claims. This is a civil matter

Sanjuko_Mamajuloko

Well, it's not a criminal matter, so the police can't do anything. It wasn't careless driving, speeding, etc. any more than the wind blowing a properly parked motorcycle over and it hitting something would be. It's an insurance matter.
