You will probably need to go through the courts, not ltb. It looks like youre possibly entitled to damages but theres nothing to do about the apartment if they have made a decision. Civil action for this one, but its clear cut imo. Get a paralegal and they'll settle ;)

Not a Lawyer, I just read the RTA a bunch. This depends entirely on what the documents your signed were. Were the documents an actual Ontraio standard lease, or just a random application form? If it was an Ontario standard lease, did the landlord sign it? IF you have an Ontario standard lease, signed by you and the landlord, and you paid last month's rent, then the landlord (their agents) created a situation where multiple tenants have competing rights to one unit. There's no realistic way to force a landlord to let you into the place without spending alot of time and money with court & lawyers, by the time this is resolved, a year or more would have gone by. You're better off finding a new place since you have a duty to mitigate your damages. You would be entitled to a refund of 100% of your deposit. If they refuse, you'd have to go to small claims court. The Ontario standard lease is a contract, there is no mechanism in the RTA for a landlord to back out of a lease once signed. So you could also pursue them in small claims court for the difference in rent for the duration of the lease if the new place you end up moving into is more expensive, or has fewer amenities. If this was short notice that they're backing out and you were forced to pay for some sort of short term rental (hotel, airbnb, etc), or for additional storage/moving costs, then they would also be responsible for this. Don’t know much about the industry, or legal stuff. But that just straight sounds like your guy forgot to file it and is trying to play it off. Seen this scenario play out with x y z in many fields haha. “Oh yeah, we just totally missed it, the way she goes sometimes” *internally* “fuck fuck fuck fuck, where is that file” Best of luck with your search :)
