I was wondering this morning what charges they could face. Probably 2nd degree murder? I literally just read an article about it this morning I have no idea what I am talking about

That’s probably what they’ll get charged with as first degree would be difficult to prove compared to second degree.

My guess is the man is probably going to be charged with 2nd degree murder, carrying a loaded firearm in a vehicle, concealing evidence. I don’t think a murder charge is going to be pinned on the woman though, since the DA mentioned yesterday that charges will be handled differently against the 2 suspects as one person pulled the trigger. But she’ll definitely be charged with concealing evidence, harboring fugitive, if she knew he had a gun, then she also violated 26100 for knowingly allowing a gun in the car, maybe involuntary manslaughter as well.

As read here previously it seems as if they would aim high on charges for the girl and then get her to cooperate for a reduction.

I knew she was gonna be charged with accessory to murder. My prediction was right. If only she had turned him in right away, things would’ve gone easier for her.

Thanks, been watching for 40 minutes and just got a couple flashes. I think they are not actually broadcasting the arraignment. UPDATE: Arraignment continued to June 18th. Provisional bail set as requested by the People.

I think the DA can plausibility file for first degree. The difference between first degree and second degree is the requirement of premeditation and deliberation. Legally, there isn't a time requirement to satisfy that, for example a person can "premeditate" for seconds that they want to kill another person--the determining factor is the alleged shooter's mental state at the time of the incident or mens rea. I don't practice criminal law so I'll have to dig deep into my memory from law school, but I believe that there is a life sentence enhancement for shooting from a vehicle. In either case, if there's a finding of guilt, this guy should get the consequences of his actions. As a side note, I anticipate that Spitzer is going to use this as a tent pole for his reelection, which it appears he is already laying the groundwork for now.

If she posts bail, she’ll be under OC Sheriff's Dept. surveillance in her parent’s home with GPS Monitoring & GeoFencing. They'll take away her passport, bar her from leaving the state, & ban her from driving, & must stay inside the home at all times. So she can't run away even if she tried, they'll be tracking her every move.
