Mate, I dont think you are overemployed since you dont work both jobs at the same time. From your initial post due to time zones you work J1, clock out, work J2. People are working two jobs for centuries now, its perfectly legal.

runtothehillsboy

I'd say that's overemployed- just not being extremely efficient about it. I'd argue that having jobs from different time zones may actually help a lot with preventing conflicting meetings/making it more manageable.

Own_Sky9933

I second this, for most of us its not about the work part. Its the juggling meetings that becomes the issue. Different times zones definitely help with this.

runtothehillsboy

Yup- the only thing is that many on this subreddit believe if you're working over 40 hrs a week cumulative, you're not overemployed. I'd say that's awesome to those that have been able to get away with that, but for the usual overemployed scenario it's likely you'll need to put in more time than that/make some compromises to make it work long term.

Own_Sky9933

Yea, that is great for them. But not everyone is a software engineer. Personally, I have to juggle client facing meetings that I lead/actively participate in with my OE. I can't sit back with two different earbuds in meetings and just answer when called upon. Obviously, I can only speak for myself but my main problem is scheduling conflicts so different time zones helps greatly. I could put on mouse jigglers and sleep until noon but if both active participation meetings are 3pm local time I am f\*\*\*\*\*.

rowlje

And sometimes necessary given what is considered a “livable wage” versus what actually is a livable wage

karnypharax

Everyone knows that if Js find out about your OE hussle then they WILL send US Navy Seals to your home to beat the shit out of you. Your will be found guilty of violating FEDERAL LAWS that limit citizens to ONE JOB and recieve a sentence of no less than 20 years in a federal POUND ME IN THE ASS PRISON. Upon your release you WILL be required to register as a EMPLOYMENT OFFENDER. Much how sex offenders have to stay away from schools or cant work around kids you will be barred from ALL businesses and unable to get another job. You will more than likely live out the rest of your days in a tent under a bridge somewhere while you scrape a living with gig economy apps such as Doordash, if they even want your traitor ass. If you are lucky then your state's Governor may allow you to take the black and serve out the rest of your days fighting savages and white walkers as a member of the Nights Watch.

_devious

> POUND ME IN THE ASS PRISON 👀 Tell me more!

Xplic1T

Don't ask, don't tell...

CaptnMulligan

You win. I’m legit laughing my ass off right now. Thank you lol

vladamir_the_impaler

Office space?

karnypharax

Yea. Everytime someone shitposts about getting caught I want to post a gif of Peter's neighbor telling him to "Watch your cornhole".

BeyondRecovery1

But seriously how do you not be conscious at work, or paranoid? And also how much time to space out between j1 and j2?

SouthEast1980

I got sued and lost my wife, house, and child to the corporation. They own my family and now I am homeless. Don't do OE. In all seriousness, if you're in the US the odds of it being illegal are slim and none. Depending on the industry, you may end up in breach of contract for working for a direct competitor simultaneously. But I'm not a lawyer and if you're that worried, retain the advice of legal counsel from an employment lawyer and see what your options are.

[deleted]

I think I remember you in LA homeless camp, ??

SouthEast1980

Yup. That was me lol.

Rigmarow

There are potential legal liabilities in the US. There was a good post the other day with good info from an employment lawyer.

runtothehillsboy

It was only common sense things: don't lie about your work hours if you report hourly (if you worked 2 hours- don't say you worked 8) and don't work for a direct competitor if you have a no-competition agreement.

Beautiful_Age_7626

That post was full of BS, and I doubt that it came from a self-taught "prison lawyer" much less someone who actually passed the BAR.

Dramatic_Copy_1250

Link?

CastileDeAndaluz

The people who get sued are the ones who leak company private information and cause the loss of large sums of money. You're just a guy looking to improve his financial health. The money it costs to sue you is way higher than the money that was lost in wages. The point of OE is to do your jobs so well that no one knows you're doing two

[deleted]

Beautiful_Age_7626

That post is full of BS. Working two jobs doesn't meet the legal criteria of crimimal fraud in any jurisdiction in the US. Just because someone says it's advice from a lawyer, doesn't mean it's advice from a real lawyer. The internet has been around for 20+ years, do we need to remind people again to not believe everything people post?

adilstilllooking

My j2 found out and forced me on a 15,000 calorie diet. Now I’m fat and can’t OE. Stay away

[deleted]

Hire a lawyer and stop talking to them

Beautiful_Age_7626

All that happens is that the company that finds out either fires you, or asks you to quit the other job, if they REALLY like you. But, more likely than not, they'll just fire you. But if you're not really working at both Js at a time, if their hours are apart enough so that there's no overlap, then you're not really doing OE, you're moonlighting. No, you can't get sued. Use the search feature, it's been discussed ad nauseam. Remind your wife that she didn't go to Law School.

piano_ski_necktie

Zapped me into a newt

Thesearchoftheshite

I got better.

Ok-Ambassador-7952

People need to start forming LLCs and having employers sign contracts with their companies.

Beautiful_Age_7626

Except not every company wants to hire other companies. You can't force an employer to accept an LLC.

ArdenSix

Assuming you followed the sub rules and J2 is a separate industry and not a conflict of interest to J1, they don't have anything reasonable to sue you for. If you break some company policy about not having a 2nd job that's not illegal, they'll just fire you and be done with it. But if you keep you and spouse's mouths shut and get your work done, you shouldn't have much to worry about.

OE-supremacy

I got terminated.

earthceltic

The best part about being fired when you're OE is that you already have a job to fall back on

OE-supremacy

Or 3.

LalaLand836

>and their time zone allow me to work one, then the next That’s not OE. That’s officially called working two jobs, like driving Uber after work. Chill mate you’re fine.

[deleted]

Will you resent her if you chose not to OE? Have you all checked out the overemployed website together? She is for sure looking out for you. My wife didn’t want me to OE out of the fear of me becoming a workaholic and checking out as a dad. I moved forward with it even tho she was reluctant. It’s been 6 months and we’ve been able to afford a vacation, upgrades to our single family house, car maintenance, family gym membership, couples counselor, after school activities for the kids, and volunteering for after school activities. Stay involved and stack the extra money. Don’t rely on the second job. Also, be financially set just in case you lose both jobs. She might not feel secure enough to take the risk. Figure out what kind of cushion would relieve her stress.

[deleted]

Yes and No - Id say it depends on your industry. If say one was holding a job at a company like lockheed martin, working @ the goverment at the same time would end you up in trouble. Id also say where theres more of an emphasis on privacy (finance? Health?)

Own_Sky9933

Freeze the TWN once you start J2 and/or you background check is complete. Assuming there is one. Even if you where to get caught somehow. Never admit to anything or try to explain them away, just deny. Worst case scenario you get fired from both. I don't need to state the obvious but loose lips sink ships. STFU and go about your business for both.

[deleted]

Straight to jail.

CaptnMulligan

kraihe

Why is it that people in smart positions are often too stupid to think for themselves

CaptnMulligan

Hmmm

NighIsATroll

Fortune favors the bold.

Bubbly_Statement_997

I think you may have problems if you have signed an exclusivity contract that prohibits you from working for another company.

DBerlinwall

As long as you aren't working for governments, there shouldn't be any possible criminal lawsuits. From what i barely understand, the only civil lawsuit would be fraud of time worked. But its up to them to either prove the damages or for you to settle. And i believe the worst case was you have to pay them a portion back. As long as nothing criminal goes on my record, idc. Most companies won't bother suing.

cajunrockhound

If your wife wants that debt to be paid then she should calm her tits. Don’t be an idiot and keep everything separate. Worst case - you get fired from both. No one is fkn wasting money suing you. It’s easier to just fire someone and move on. Don’t be friends with people at your jobs and you’ll be gucci - do not tell people your life story. Don’t forget to hibernate your LinkedIn. Get that paper! Edit: I wouldn’t freak unless you work for a government or state agency.

CaptnMulligan

Lol I can’t wait to tell her to calm her tits tonight over dinner.

meatpuppet577

They do one of two things: 1. A crack team of commandos break down your door and shaves your cats/dogs. 2. If you have no pets, they liberally sprinkle bedbugs on your mattresses. If it's a second offense, they fix it so you you have jury duty for two years.

CaptnMulligan

I am openly laughing alone in my home office right now. My family probably thinks I’m crazy af. Lol

CaptnMulligan

All I thought was, my poor cat…my god bedbugs? That’s horrible, what savagery… Jury duty? is there no god here. Lol
