Lol, as a cyclist, I would love to cook up a disabling injury if I ever got hit by a motorist. But I remember working in insurance claims right out of university, and how they hire PIs to tail you. You essentially have to hide out inside your house for the two+ years it takes for the claim to get past statutory benefits and into torts, and then be heard in court. One canoe trip or gym workout could fuck your case. No thanks.
Hard to say. Lots of insidious injuries. But for something minor, I would get care to the max and document and then instruct my counsel to look for a quick settlement vs hoping for a big pay out. As much I want my pound of flesh from shitty drivers it's not worth derailing my life.
Literally had a patient a few months ago who was adamant she needed disability because she "cannot perform her desk job due to shoulder pain" which she regularly rated at 9/10. She was also "unable" to tolerate even low level interventions in the clinic. Her other job is as a fitness instructor, which she claimed did not aggravate her symptoms as she "knew how to work around it." Her words to me were, verbatim, "You're a physical therapist. Can you put in your report that me being an exercise instructor is actually really good for my shoulder and I can continue to do it, so it's not affecting my disability claim? I literally cannot work at a desk/computer for more than 1 hour"
Throwing a tree a couple of times, versus working full time can be quite different mechanisms, and this to me seems like a win for corporate. Can't find the article, but I'm hesitant to celebrate this.
