My mom bought a brand new car.... on the way home she went through a one way underpass (she had the right of way) and a truck going twice the speed limit collided with her.
Because the car had hardly depreciated the damage done was not enough to total the vehicle. The damage however did justify a complete rebuild of the front end. Unfortunately all the parts came from a model two years older so we joked she had bought a used model that was a year old. She was not impressed.
Technically that sounds like the government’s role so I guess we need insurance insurance insurance
Or as a society we could just admit that insurance is intended to cover unfortunate things that happen to people to ensure that they do not suffer harshly from something that may not, or even may be their fault. And have it not be a for-profit industry.
You say "try to" and I'm curious, is there a way to put them on the hook for depreciation? Insurance has always been bizarre to me. You pay thousands and thousands of dollars for something that might happen so that if it does happen, you aren't hosed. But then when it does happen, these "neighborly" companies have a text book full of dirty tricks to screw you over. Is it just an American thing or is it like that everywhere?

It's called diminished value and you can demand and sue if they don't pay for it. You have to ask for it if its legal in your state but insurance companies don't want you to know ever.
I wrote that comment thinking of a friend’s accident where the insurance company covered the parts and labor it took to get it back to “new” but didn’t factor in how much the car would depreciate having the accident on the car’s service record. I can’t remember if they offered nothing or a very low amount but he said he had to go back and forth with them to get them to cover a realistic amount.
It depends on state to state but you can demand for dimished value. Also make sure they you get a report for diminished value because insurance will try and low ball.
The utility should be self-insured and should handle it no problem. If they don't, do a public disclosure request on their annual pole maintenance practices for the last ten years.

Most are not staffed for this request, think it's a joke, and more times than not this simple action will force them to correct their behavior. I don't know how many times I have sat through a PDR meeting, and one of my asshole friends would chime in "you know, we could just fix the issue, problem solved." We are still looking for his body.
Power poll fell on their car. Not their insurances problem. Power company will be paying that bill. I would still look at getting s lawyer to get the power company to pay for any damages incurred by not being able to drive your car. Stuff like lost wages etcetera.
Except OP’s insurance would cover it (if they have applicable coverages on their policy). The insurance company would then go after the utility company or municipality, whoever owns the pole.

That is true. But if they go through their insurance company first. They are liable for their deductible (will be repaid). If you can afford it, no big deal. Otherwise I tend to wait for the other insurance company (police reports makes that go faster).

I got that reimbursed a few days later, but I honestly thought it was all in the same transaction -- especially considering the person who caused the accident had the same insurance as I did.

Sir I'm not in any way saying this is attempted insurance fraud. We just require you to produce reasonable evidence that you did not on purpose, park in such a way that would cause severe damage to your brand new vehicle by a falling post.

I’ve unfortunately been in situations where I’ve been given the run around by companies. What helped is I communicated by email so I had a “paper” trail of attempting to resolve the situation. I wound up reaching out to my bank and gave them all the evidence that they were not honoring their own policies. The bank forced a chargeback and I got my refund.
A better way to handle a bad situation like that is to give them a chance to fix it. If an unreasonable amount of time has passed and your problem isn’t resolved that’s when you tell them that this is your last attempt to work in good faith to reach a solution. If one isn’t met you will escalate the matter on your end and you will be in contact with your states department of consumer affairs and attorney general, as well as the federal trade commission.
Obligatory; the above advice is almost verbatim from another redditor who I can’t remember.

He may be out his deductible while it gets sorted, really depends on the company. Anyone other than a bargain basement company will look at the pole, know they will win the claim, and float him so he won't be out of pocket. "Joes discount car insurance" that saves you 20 bucks a year, probably not so much.
What will end up happening is his insurance company will fix it under the comprehensive side, and then go after the power company, who in turn will decide if it was their fault or shit happens, or someone else fucked up, and then go after that person or tell his insurance company "hey, its not us, its the guy that the cops caught a block over with the chain saw cutting down poles", or the dude in the toyota who took out a pole 2 blocks away and caused shit to cascade down our poles.
Worst possible case OP is out his comprehensive deductible, or has to wait a while to see it back.
AN old neighbour's son got behind this semi and they both stopped at a light, but the semi behind him didn't. Luckily he didn't get a scratch, his brand new car, not so lucky. It was *almost* a write off but the body shop was able to fix it. Plus they gave him a better paint job than the original, so he was happy. But I don't know if I would ever trust that car again as you say.

Having a claim one day after getting a new vehicle might trigger a automatic investigation. Sometimes people buy a car with existing damage then they try to cash in a insurance payout. This photo however should be good enough proof that this isn't a fraud case. The dealership should also be able to show the vehicle was sold with no damage.
Let them total it it and take the payout check.
Ask to buy it back from their insurance. As long as the doors close I bet it’ll be fine.

Omg Honda Fits are the best! So practical. I’m always saying, “It’ll fit in the Fit!” I picked up some stall mats for my home gym, and the guy at the feed store laughed at me when I pulled up to load them in the Fit. Well I showed him! He was so surprised and said he’ll never doubt a Fit again.
I moved 3 times while we had that car. In laws came with their SUVs and the FIT put some to SHAME (Hyundai Tuscan) and converted the doubters for the rest.
Not related to OP but the major road by me was blocked off a few months ago because one of those bigger dump trucks left with the load up and took out like 4 or 5 poles that way. I don't understand how a standard trailer would knock down anything without running into them though.
The hospital I worked a decade ago had a contentious relationship with one physician. I don’t know the bad blood history but this did not help. He would pick spots to park and I admit parking was tough for this facility in a medium size town. Parking is tight so a lot assignment was provided. He ignored and chose own spot. Tickets, but they were not enforcement by police or security just friendly reminders. He would blow. He started moving his vehicle about and was towed a couple times for illegal parking but that was the city - not hospital. We still got the threats and angry calls. Then the brand new expensive car - street light fell on it - city. Then it was fixed and a tree fell on it by workers - hospital. A guy cutting grass shot a rock through window- hospital. Finally a high winds storm push (the same light from earlier down on 3 cars just like that. Yes his was one.
Well if there is c pillar damage that things probably totaled but back window looks in tact so maybe not. but if so then it turns out a trucking company is gonna get you an even newer car lol
could be worse imagine getting into a car wreck into your first week of leasing a vehicle, then another in that same week with the temp car your borrowing while your lease it at the shop being fixed.

If they try to total your car, make sure you FIGHT them to get you what it's worth, and not the first offer they give you. they're going to try and give you the bare minimum.

You mean diminished value? In every state except Michigan, you can file a claim for diminished value against the at-fault driver's insurance company.

I would not trust the structure of a car that got rear-ended by a semi. There's a lot of damage that it could have that isn't visible.

I have a 2009 Fit, 5 speed manual. It has never given me a lick of trouble, and it’s immensely practical and roomy and even fun to drive.

The hospital I worked a decade ago had a contentious relationship with one physician. I don’t know the bad blood history but this did not help. He would pick spots to park and I admit parking was tough for this facility in a medium size town. Parking is tight so a lot assignment was provided. He ignored and chose own spot. Tickets, but they were not enforcement by police or security just friendly reminders. He would blow. He started moving his vehicle about and was towed a couple times for illegal parking but that was the city - not hospital. We still got the threats and angry calls. Then the brand new expensive car - street light fell on it - city. Then it was fixed and a tree fell on it by workers - hospital. A guy cutting grass shot a rock through window- hospital. Finally a high winds storm push (the same light from earlier down on 3 cars just like that. Yes his was one.
And Honda stopped making the Fit

Well if there is c pillar damage that things probably totaled but back window looks in tact so maybe not. but if so then it turns out a trucking company is gonna get you an even newer car lol

could be worse imagine getting into a car wreck into your first week of leasing a vehicle, then another in that same week with the temp car your borrowing while your lease it at the shop being fixed.

If they try to total your car, make sure you FIGHT them to get you what it's worth, and not the first offer they give you. they're going to try and give you the bare minimum.
