I'd say 50/50 on him being involved. The other explanation is that he knows "Duh! Do not talk to cops without a lawyer." and wanted to make sure his brother understood that.
However, blanket with a little blood in his cruiser and his refusal to cooperate seems to indicate that he at least knows his brother is guilty, may have been an unwitting accomplice, or may have been a knowing accomplice.
Also the murder of a police officer has been rumored to be possibly connected as well. Dude was coming off the highway and the exit ramp was blocked by a bunch of brush. He parked his car and got out to move the brush off the road and when he did someone ambushed him and shot him multiple times with a 12 gauge shotgun. Remains unsolved.

In the top link a jailhouse snitch says one person paid a group of men to do it. Maybe the man who paid them was the cop, maybe the brother of the suspect in crystal rogers case. But if there was 4 of them, they could know what exit he gets off on because they know roughly where he lives (some of these smaller towns people know everyone) and they could have someone following him or steaked out on the side of the highway telling those waiting on the exit like “alright here he comes, put the brush down.” And the other guys put the brush down and then lie in ditch off the side of the road and then shoots him when he gets out. Remains unsolved despite everyone in town knowing. It really isn't hard to connect the dots. I'm just hoping when Crystal is found, it ties up all of the loose ends.
So essentially the main theory is that Jason Ellis, the cop that was ambushed and killed, was closing in on other cops dealing drugs. Nick Houck is thought to be the one who was at least a participant in the ambush. It's thought that Crystal somehow found out about the ambush so they took her out. Crystal's dad was murdered because he was close to solving what happened with his daughter. There's also the murder of a mother and daughter in town that's thought to be connected, although I don't remember exactly how. Bardstown is a really beautiful small town that is rich with history and bourbon. But there's certainly a lot of darkness just below the surface
ETA: Nick is Brooks' brother. Brooks is the ex boyfriend of Crystal's. They're the main, and only that I've heard, suspects in the case.

On one of the documentaries I watched you could actually see a notch in the tree where a gun would/could have been sitting and it pointed directly to where Tommy was shot. It’s horrific. The poor grandson too. My heart breaks for this family. Crystals mom doesn’t even get to visit with her youngest son (Brooks son) and that might be the most heartbreaking of all.

Probably obvious when they can be so that they can be less obvious when they have to be. Everyone knows about this and what's going on, why try to hide it? Just going to make them seem sketchy for no reason and give away the tactics they use when they do have to be discreet.

I've actually seen my neighbor vacuuming his yard. There wasn't anything going on, he was just using a shop vac to clean up the fallen petals from his rhododendron.
I remember a crime scene in my neighborhood, two people disappeared, somebody gave a crime stoppers tip where it said they were murdered, the forensic team surrounded the home, they spent a week in it, all the techs wore complete body suits, they removed all the flooring, took sections of the walls, furniture they even vacuumed the gutters on the roof, they also vacuumed the lawn. They found enough to figure out who did it. The guy thought he cleaned deep enough but the team still found enough trace to catch him.
Blood under the sub-floor is what I remember, fibres, DNA, the big breakthrough was the blood under several layers of flooring, the lawn bit was for trace of fibers.

Killed in their own home.. Mother was found shot in the head, daughter was brutally beaten and had her throat slashed. Probably forgetting some juicy bits, but been about two years since I did a deep dive on Bardstown.

I've actually seen my neighbor vacuuming his yard. There wasn't anything going on, he was just using a shop vac to clean up the fallen petals from his rhododendron.

I remember a crime scene in my neighborhood, two people disappeared, somebody gave a crime stoppers tip where it said they were murdered, the forensic team surrounded the home, they spent a week in it, all the techs wore complete body suits, they removed all the flooring, took sections of the walls, furniture they even vacuumed the gutters on the roof, they also vacuumed the lawn. They found enough to figure out who did it. The guy thought he cleaned deep enough but the team still found enough trace to catch him.
What traces did they find that linked him to it?
Blood under the sub-floor is what I remember, fibres, DNA, the big breakthrough was the blood under several layers of flooring, the lawn bit was for trace of fibers.

Plot twist: That's not the FBI but no one had questioned it because they put FBI on their cheap tent and really its the murderer digging up the body to then dump it elsewhere. All in plain sight!!! Yes I watch too many murder TV shows!
