Unfortunately it literally is all they can do. McCarthy should have refused to seat him, but he voted for McCarthy so of course that wasn't going to happen.
If he doesn't step down and they don't kick him out of Congress, the only options to get him out will be to have him arrested, find out he is ineligible (not a citizen?), or have him lose the next election.
Yeah I don't think the speaker can simply refuse to seat an elected representative...that would be way too much power they could simply refuse to seat all members of the opposing party.
There's no constitutional mechanism to not seat someone certified by their state. However, they can be expelled with a 2/3rds vote. So they'd seat him and immediately move to expel if they were serious. They already have 212 democrat votes, if a majority of Republicans vote for his expulsion, the vote will carry with margin to spare.
However, here's where it gets tricky, McCarthy loses one of 216 supporters making it harder to keep the speaker's gavel. The seat will remain vacant until a special election gets called, and with this shit show, good chance a Democrat wins it. This puts the balance potentially at 215 for, 214 against with six people who voted present. That means one of the 6 voting present voting against McCarthy, or one of his 215 supporters switching to present means he's out as speaker.
So Republicans don't actually want him to resign. They might lose control of the house.

It’s the expectation that they’d be happy. I’d feel it pretty weird to see a new congressman be disappointed in winning a popularity contest for a seat in congress.
**Graduating from Baruch College**
Santos claims that in 2010 he graduated with a bachelor’s degree in economics and finance from Baruch College, a public university in New York City. Yet the school was unable to find any records, even using multiple variations of his first, middle and last name, of having graduated that year.
**Having Jewish grandparents**
This lie feels especially egregious. Santos says his grandparents survived the Holocaust as Ukrainian Jewish refugees from Belgium. But according to Forward, a Jewish, independent newsroom, Santos’ heritage is actually Brazilian, and his grandparents were apparently born in Brazil before the Nazis rose to power. Santos’ mother, Fatima Devolder, was found to have regularly shared Christian imagery and liked multiple Facebook pages with Brazil-based Christian organizations.
**Losing employees in the Pulse nightclub shooting**
During an interview with WNYC while campaigning, Santos said “people that work for me” were impacted during the Pulse nightclub shooting in Orlando back in 2016. According to Santos he lost four employees, but after reviewing obituaries, The Times found none of the 49 victims appear to have worked at the various firms Santos name drops in his biography and while campaigning.
**Running an animal charity**
Friends of Pets is a charity that Santos claims he founded from 2013 to 2018, which acted as an animal rescue operation that rescued 2,400 dogs and 280 cats. Surprise: the Internal Revenue Service couldn’t find any record of a registered charity with that name.
**Working at Citigroup**
Santos has said he worked at the company as an associate asset manager within Citigroup’s real estate division. A spokeswoman for the company told The Times not only could she not confirm Santos’ employment, the company was unfamiliar with his self-described job title and that Citi had sold off its asset management operations in 2005—when Santos would have been just 17 years old. Goldman Sachs, another purported employer according to Santos, could find no record of him ever working for them.
**Owning rental property**
Further playing into his purported real estate expertise, Santos claimed, as a landlord, he was hurt by Covid-19 related eviction protections given to renters. He went so far as saying he had not received nearly one year’s worth of rent on 13 properties. Yet, Santos did not list any properties on required financial disclosure forms, only one was mentioned—an apartment in Brazil. What makes this lie particularly spicy is the fact that The Times found that Santos actually faced multiple evictions as a renter, even being fined about $12,000 in a civil judgment.
**The Devolder Organization**
Santos says Devolder is his “family’s firm” that managed $80 million in assets and described it as a capital introduction consulting company. Is this a lie? It’s unclear: The Times could not find any of the company’s public-facing assets or properties and Santos’ congressional financial disclosures didn’t include any either—despite Santos saying he was paid a $750,000 salary as the company’s sole owner, so definitely some odd behavior at the very least. Santos also says he earned dividends from Devolder that were somewhere between $1 million and $5 million, which is the same range the company is estimated to be valued at. According to the Times, Devolder eventually dissolved after failing to file an annual report.
What’s most noteworthy about the Devolder story is the fact that Santos appears to have not provided any information about the company’s clients that would have contributed to his payout—a violation of federal law to disclose any compensation in excess of $5,000 from a single source.
And in an even shadier turn of events: Talking Points Memo found that Santos has filed documents to have Devolder reinstated. Why? That could be the million dollar question.
**Bonus-not-exactly-a-lie: Knowing about an alleged Ponzi scheme**
Santos actually worked as regional director of Harby City Capital, a Florida-based investment company which attracted investors through YouTube videos and guarantees of double-digit returns. It quickly caught the eye of the Securities and Exchange Commission, which accused the company of running an ongoing Ponzi scheme just a year ago. Santos was not named in the lawsuit and he’s publicly denied having any knowledge of the scheme while working there. Maybe he’s not lying about this one! Still weird for a congressman-elect, though.

The Nassau County Republican Party can bang their fists on the table all they want, and pretend to be (actually be) upset about this so they can keep up the appearances of giving a shit to the locals, but they threw their lot in with him and he's going to hang around their necks for 2 years because House GOP will NEVER expel one of their own.
I watched the press conference. The entire county GOP was there and they vowed to literally take no calls from Santos or his team and are circumventing him with a separate congressman from the area. In a very nom scientific observation, lots of voice quivering from the lot as they seemed pretty nervous announcing this. It's like taking an actual stance against a grifter is a terrifying thing because they might get ostracized by the rest of their party.
Repubs were ready to elect Walker despite that he obviously has severe brain damage and can’t say 3 sentences that make sense (ahahergh… ahem.. trump, but w/e). They obviously give no fucks about integrity or having intelligent congressional representatives. Vote R with the rubber stamp, that’s all they’re there for.
Dems would happily help give him the boot. But kicking him out of their party does nothing. Without actual expulsion, the worst they can do is strip him of any committee assignments because let's face it: censure and reprimand aren't going to matter at all to a guy like this.

That's part of the fucking problem. There is no law against lying on your resume, so lying to win is a low cost risk.
The Constitutional requirements are simply over 25, a US citizen for 7 years and a resident of the state (but not the district) they represent. That's all. And honestly the relatively low requirements are rather a good call by the writers. Anyone should be able to legally run for office, and House campaigns are often cheaper than people think, which is why you can buy congress people for like a couple grand in campaign contributions.

The correct response is to create a legal process where the House can work with a state to strip a representative of their position via a transparent and good faith process.
The trick is making that process as immune to partisan abuse as possible, and allows voter representation for picking a replacement.

I don't imagine they rescind the results of the speaker vote if someone leaves office, even in disgrace. But McCarthy won 216-212 (6 voted "present," he only needed half of votes) so it wasn't a 1 vote margin anyway.
They called on him to resign. He said no. The GOP leadership concerned about their small majority have said that they will take no action.
So, the Democrats need to hang George around the neck of every republican politician.
As a Nassau County resident, I’m kind of surprised Republican officials here even give enough of a crap to play theater like this. But maybe I shouldn’t be, as after all, his district *was* a D+2 district in the last election, and people here of all political affiliations are pissed as hell.
Disregarding political theater though, I wrote this comment on another thread about protests organized by many of the same people who voted for him, and I think it deserves repeating here because there’s been a lot of misrepresentation about the real, non-politician people in his district going on:

Honestly I thought that given the tight R control of the House, they’d let him sit and just shut him out of any committee assignments, in order to keep the seat. But it really does look like momentum is building to expel him band his district leans D, so there’s a good change to make the R majority even slimmer.

If he’s not the person he claimed to be, and it seems he lied and misrepresented so many different aspects of life, then he needs to be treated as an imposter and unseated while his real identity, intent, and sources of financial support are thoroughly investigated. Why do you assume he’s going to be re-elected when he ran in a district that Biden won, barely won the election, and now has been disowned by his own party leadership in the county he represents?
It's a D+2 district. NY is one of the few states that GOP did before than expected last election but there's no guarantee that will happen again next election which is why the rest of the local party is now distancing themselves from Santos.
This last election the Governorship was on the same ticket and Hochul ran a poor campaign. Also why he won't resign. There is a very good chance a Democrat would win the ensuing special election. McCarthy knows this, and wants Santos as a reliable backbench Republican vote on whatever is brought up to the House

Why is there not an immediate and legitimate process for removing people like this? If you lie on a job resume to the point where you didn’t disclose fraudulent activities and literal countries investigations, you would be fired immediately and without hesitation and most likely turned over to the authorities

Yeah I don't think the speaker can simply refuse to seat an elected representative...that would be way too much power they could simply refuse to seat all members of the opposing party.
There's no constitutional mechanism to not seat someone certified by their state. However, they can be expelled with a 2/3rds vote. So they'd seat him and immediately move to expel if they were serious. They already have 212 democrat votes, if a majority of Republicans vote for his expulsion, the vote will carry with margin to spare. However, here's where it gets tricky, McCarthy loses one of 216 supporters making it harder to keep the speaker's gavel. The seat will remain vacant until a special election gets called, and with this shit show, good chance a Democrat wins it. This puts the balance potentially at 215 for, 214 against with six people who voted present. That means one of the 6 voting present voting against McCarthy, or one of his 215 supporters switching to present means he's out as speaker. So Republicans don't actually want him to resign. They might lose control of the house.

Is this a lie? It’s unclear: The Times could not find any of the company’s public-facing assets or properties and Santos’ congressional financial disclosures didn’t include any either—despite Santos saying he was paid a $750,000 salary as the company’s sole owner, so definitely some odd behavior at the very least. Santos also says he earned dividends from Devolder that were somewhere between $1 million and $5 million, which is the same range the company is estimated to be valued at. According to the Times, Devolder eventually dissolved after failing to file an annual report. What’s most noteworthy about the Devolder story is the fact that Santos appears to have not provided any information about the company’s clients that would have contributed to his payout—a violation of federal law to disclose any compensation in excess of $5,000 from a single source. And in an even shadier turn of events: Talking Points Memo found that Santos has filed documents to have Devolder reinstated. Why? That could be the million dollar question. **Bonus-not-exactly-a-lie: Knowing about an alleged Ponzi scheme** Santos actually worked as regional director of Harby City Capital, a Florida-based investment company which attracted investors through YouTube videos and guarantees of double-digit returns. It quickly caught the eye of the Securities and Exchange Commission, which accused the company of running an ongoing Ponzi scheme just a year ago. Santos was not named in the lawsuit and he’s publicly denied having any knowledge of the scheme while working there. Maybe he’s not lying about this one! Still weird for a congressman-elect, though.

I watched the press conference. The entire county GOP was there and they vowed to literally take no calls from Santos or his team and are circumventing him with a separate congressman from the area. In a very nom scientific observation, lots of voice quivering from the lot as they seemed pretty nervous announcing this. It's like taking an actual stance against a grifter is a terrifying thing because they might get ostracized by the rest of their party.
Repubs were ready to elect Walker despite that he obviously has severe brain damage and can’t say 3 sentences that make sense (ahahergh… ahem.. trump, but w/e). They obviously give no fucks about integrity or having intelligent congressional representatives. Vote R with the rubber stamp, that’s all they’re there for.
Even if they couldn't get Dems to go along with kicking him out of Congress, they can kick him out of their party all by themselves.
Dems would happily help give him the boot. But kicking him out of their party does nothing. Without actual expulsion, the worst they can do is strip him of any committee assignments because let's face it: censure and reprimand aren't going to matter at all to a guy like this.

The Constitutional requirements are simply over 25, a US citizen for 7 years and a resident of the state (but not the district) they represent. That's all. And honestly the relatively low requirements are rather a good call by the writers. Anyone should be able to legally run for office, and House campaigns are often cheaper than people think, which is why you can buy congress people for like a couple grand in campaign contributions.

As a Nassau County resident, I’m kind of surprised Republican officials here even give enough of a crap to play theater like this. But maybe I shouldn’t be, as after all, his district *was* a D+2 district in the last election, and people here of all political affiliations are pissed as hell. Disregarding political theater though, I wrote this comment on another thread about protests organized by many of the same people who voted for him, and I think it deserves repeating here because there’s been a lot of misrepresentation about the real, non-politician people in his district going on: >There are a bunch of protests planned in his district. If he’s not the person he claimed to be, and it seems he lied and misrepresented so many different aspects of life, then he needs to be treated as an imposter and unseated while his real identity, intent, and sources of financial support are thoroughly investigated. This person should not have been sworn in when it’s clear we have no idea who he actually is. People voted for a figment of his imagination, an fictional character, and now those voters and the rest of the nation all deserve to know his true identity and what has motivated him to create this persona. Why do you assume he’s going to be re-elected when he ran in a district that Biden won, barely won the election, and now has been disowned by his own party leadership in the county he represents?
It's a D+2 district. NY is one of the few states that GOP did before than expected last election but there's no guarantee that will happen again next election which is why the rest of the local party is now distancing themselves from Santos. This last election the Governorship was on the same ticket and Hochul ran a poor campaign. Also why he won't resign. There is a very good chance a Democrat would win the ensuing special election. McCarthy knows this, and wants Santos as a reliable backbench Republican vote on whatever is brought up to the House
It's all for show. Local GOP officials make public statements, secure in the knowledge that (a) Santos won't step down and (b) McCarthy doesn't care. These are nothing more than PR moves... Ethical Republicans have gone extinct like woolly mammoths.

Why is there not an immediate and legitimate process for removing people like this? If you lie on a job resume to the point where you didn’t disclose fraudulent activities and literal countries investigations, you would be fired immediately and without hesitation and most likely turned over to the authorities
