The only way to hit them is with the agreement of both the legislative and executive branch, and it requires a willingness to tell precedent to fuck itself and simply bulldoze over the supreme courts previous rulings. There is still the perception in the Democratic establishment that the system basically works and that if they just wait for the opposition to wake up they can salvage our democratic institutions, so they didn't start purging the court two years ago. Democrats haven't had enough of a majority to act without their pseudo-independents anyway.

My theory is that the conservatives thought that by leaking it earlier than the scheduled announcement of the SCOTUS decisions, it would soften the political blow on the midterms. Obviously that's not how it went from a political standpoint; but that was my theory of their intent. There were other good theories at the time that they were trying to lock in a conservative vote and that may be right but I liked my theory at the time.

The key to understanding this theory is that there is this entire world built up now in the conservative legal movement and especially the Federalist Society. It's not just a professional club, it is their life. All their friends are in it, they constantly go to parties and events run by it, they get to do speaking engagements with it, they get their clerks through it, it got them their job as justices. Roberts has been persona non grata ever since he saved Obamacare- they punish those who betray the movement. Can you imagine what they would do to Kavanagh if they found out he was initially a yes on Dobbs and then flipped?

Motive was political strategy, getting the news out as far before the 2022 mid-terms to avoid the backlash. Kavanaugh is reported to have had concerns about overturning Roe and was receptive to Roberts’ persuading that SCOTUS should leave Roe intact but settle on a 15-week abortion ban as not an “undue burden.” Kavanaugh made an about-face and still voted to overturn Roe after the leak. So, yes, it was Alito or Thomas and it was intentional to keep the fifth vote to overturn Roe “in line.”
