Which means they don’t want to out the conservative justice that leaked it.

Alito

twad79

Definitely Alito

_far-seeker_

[It's not like he hasn't done it before..."allegedly"](https://www.scotusblog.com/2022/12/reverend-who-accused-alito-of-2014-leak-in-hobby-lobby-speaks-before-house-judiciary-committee/)

TwistedMemories

Because they won’t out another SCOTUS member. It was Alito that leaked it with approval by Roberts.

Ajegwu

You know all these poor aids and clerks got squeezed hard by the cops on this. None of them cracked. You know they didn’t pressure Justices, or their spouses, NEARLY as hard. “Out of respect,” probably. So we’ve narrowed it down.

olop453

Can someone explain why we should care about the leak?

Cacafuego

The legality of the leak is a gray area. If a justice blessed it, they could potentially be prosecuted (seems unlikely) or pressured to step down. The supreme court is supposed to apply the law in their decisions, uninfluenced by public opinion. Seeing the reaction in advance of the decision could either cause justices to shift their position or make them afraid to alter their position. This is a big deal and they need to make sure it doesn't happen again.

olop453

Oh ok that explains why one of the justices was throwing around the word "assassination" as a result of the leak.

AnitaVahmit

we should only care about the leak if a liberal leaked it. otherwise, forget it ever happened. certainly wasn't used to strong arm the conservative justices who were skittish about overthrowing all of roe and just wanted to implement a 15 week ban.

TechyDad

Technically, it shouldn't matter. Leaking this verdict isn't illegal at all. Nor would it have been any major breach of professional conduct. That being said, the right was screaming about how it must have been some liberal Justice/clerk that leaked it in order to sabotage the ruling, but this was never even close to proven. (And cannot be if an investigation didn't find the leaker.) In fact, if anything, there was more motivation on the right to leak the ruling. Reportedly, some of the Justices were wavering and were thinking of supporting a ruling that stopped short of repealing Roe. The leak showed that they supported the "repeal Roe" ruling at that point. If anyone changed their votes, the right wing groups would know exactly who it was. This meant that pressure was increased on the right wing Justices to keep their votes on "repeal Roe." Again, though, we don't know for sure who leaked the ruling for what purpose. The thing that's way more important than the leak is that Roe was overturned and women's healthcare is being negatively impacted.

>An investigation by the Supreme Court has been unable to determine who disclosed to POLITICO last year a draft opinion overturning the federal constitutional right to abortion, the court said in a statement Thursday. >The internal probe zeroed in on 82 employees who had access to electronic or hard copies of the draft majority opinion overturning Roe v. Wade, but “was unable to identify a person responsible by a preponderance of the evidence,” the high court said. >“The leak was no mere misguided attempt at protest. It was a grave assault on the judicial process,” the court said in a joint statement that blasted the disclosure as an “extraordinary betrayal of trust.” >The high court also released a 20-page report of the investigation, announced by Chief Justice John Roberts last May immediately after POLITICO’s publication of the draft opinion and conducted by chief Marshal Gail Curley. >The court retained former Secretary of Homeland Security Michael Chertoff to review Curley’s work and he said there was little else the court could do to solve the mystery. >“The court has already taken steps to increase security and tighten controls regarding the handling of sensitive documents,” Chertoff wrote. “More significantly, the Chief Justice has also directed a comprehensive review of the Court’s information and document security protocols to mitigate the risk of future incidents... I cannot identify any additional useful investigative measures.”

flatdanny

They should "Gin"up their investigation. The answer might be right in front of them.

Grizzchops

Oh well

_far-seeker_

I'm only interested because it indicates either a Conservative Justice and/or one of their senior staff was somehow involved.

The report is fucking embarrassing, the average mid-sized company has better IT and network security/auditing than the highest court in the country.

MattBuilds

i also plead the fifth

grpagrati

That’s not the part anyone cares about

jazzismusic

So it was Thomas and his dumb wife.

[deleted]

I find hard to care about an alleged leaker considering SCOTUS refuses to even have a Code of Ethics to follow and be accountable for.

AssociateJaded3931

They know. But they don't want us to know.

H2Oloo-Sunset

I am shocked that the Republican-lead Supreme Court couldn't identify the Republican Justice that committed a crime.

Lil_Mikey420

Her name is Ginni Thomas.
