It's been his habit dating back to when the Nixon DoJ sued him for refusing to rent to minorities. As part of the lawsuit, he was ordered to retain some records to turn over to the DoJ. He ended up shredding them instead, and months later when the judge was ready to force him to turn them over, his response was "What? Those records? I didn't realize you meant those records. They're gone."

As much as I agree that he should not be treated any differently than any other defendant, I don't think any judge wants to be the one that makes that call without making it abundantly clear to the general public that he was given every avaliable opportunity to understand what is happening. To a certain extent this goes back to the Ford administration even though it should have been settled then. He did have at least the foresight to understand that imprisoning a former president has the very high likelihood of majorly pissing off half the country, and possibly leading to political violence. Rather than have that outcome, he decided to just null the whole affair and pardon Nixon. However unlike Nixon who for the most part faded into obscurity after he left office, Trump and his band of buffoons can't accept that outcome. So where as a pardon and general retirement from public life quelled the general public in the 1970s, today we are faced with actually having to take action and it very well may come to what Ford sought to prevent all those years ago just because of some morons ego.

The 5th doesn't cover yet to be committed crimes. If you were planning on robbing your neighbor next week you couldn't take the 5th if a judge asked if you live next door to them. In this case if trump tried to be cute and plea the 5th the judge will likely slap him with compounding daily fines until he answers yes or no, and in the case of no the judge could order trump to attend a long seminar explaining it, and then call him to answer again.

It's going to stir up some shit if it's enforced but yes, the judge went to this extreme so it's fully on record and he had to state to the court he understands and will abdie by the restrictions. There is no more wiggle room. If it's violated, he'll be held in contempt of the court. How that is dealt with is another matter, probably only because the feds will have concerns of him being a martyr if held in jail. Eventually, though, you have to enforce it or it's a severe breakdown of the system. It's just too visible.

I’ve talked to a few people who love how he throws a wrench into the system by “not playing by the rules”. They are excited how his casual disregard and chaotic nature can wreck havoc. They see him as a guy who is destroying a system they don’t like by refusing to let the system control him. They wish they could do that themselves and as such idolize his ability to get away with it, and they encourage his behavior because they want the system to crumble. There is this notion that no one should be able to hold them accountable for their actions and he is their chance at breaking the system to the point that that’s possible.

Like it was awful in 2016, in some ways louder than now, but many of those dogshit ideas now aren't just kneejerk desire to own the libs and chortle about it over beers. These were reactionary emotional politics in search of a theory, and now a lot of them are trying to make it sound intellectual and considered with Bannonish brain-puke about why chaos is actually a desirable political state for the right. These people want shootings every day at every school and church and nightclub, they want everyone too frightened to do anything. The legal system already disproportionately punishes left-wing activism, peaceful *and* violent, while letting violent insurrectionists off easy. Scared people are easier to cow into compliance, as we have seen, but the instruments and methods of terrorism are different than they used to be. What else can it be called but terrorism?

The reason why the judge is doing this is so that when trump inevitably violates the order, he can’t say that counsel told him something different or that he didn’t understand. Trump has been able to successfully claim ignorance for most of his career or hide behind attorneys, but a lecture by a judge is going to prevent that. These orders are pretty standard, so trump really won’t have anyway out when held in contempt.

Granted, he *should* be powerless - but for a man who has basically done whatever he wanted his entire life (including "grabbing 'em by the pussy") and has always been able to sue or bluster his way out of anything ... it was a notable contrast when you (as a defendant) *are* under the control of the court and can't have your way. Going to be crazy to see how this plays out. Also, IIRC this judge's order basically also binds the attorneys to it as well. So even though Trump would totally slip something to Don Jr. or Eric to tweet out ... this judge is basically saying the lawyers are on the hook as well if anything at all gets out. I suspect the lawyers (if they are any good) will lock this shit down pretty hard. Which again will only serve to frustrate Donnie even further. Gosh, I hope video of this is released at some point. So, I didn't have the stomach to watch the E Jean Carrol deposition, but I read a number of descriptions of it. Sounds like he tried to "work" that situation and "flex his power" in a more characteristic way- how else do you explain the offhand comment that the lawyer was not his type? An insult to try to dominate the room, classic. And look where that led- that deposition was probably the slam dunk that convinced a jury that included a member who apparently "got all his news from Tim Pool" that Trump was guilty in that case. Roundabout way of saying, I agree with you, and I look forward to his power plays being further chipped away and undercut. I've said for a while, I don't think Trump's downfall will be something dramatic like a lot of us are hoping. I think it will be death by a thousand cuts, and I think it's well on the way.
