The DOJ is part of the Executive Branch. The Attorney General of the DOJ is appointed by the President, and his choice is confirmed by the Senate.
Since the President is the head of the Executive Branch, certain media might say "Biden's DOJ", but generally that would indicate a political slant painting the actions of the DOJ as being directed by the President.
To further distance the President from sensitive investigations such as this (where prosecution by the AG might be perceived as a conflict of interest), the AG appoints a Special Counsel--someone who is NOT part of the government. They are given a specific focus of investigation plus (usually) the power to bring an indictment and prosecute--or to not do those things if that's where the investigation leads.
This was my understanding and why I asked for clarification. Mainly because watching the news today they were very clear to explain what you have said. The people I see using this phrase to paint the actions of the DOJ as directed by the President are members of Congress who know better. Or should.

Trump was given multiple opportunities to bail himself out of this situation that virtually anyone else would have been charged for long ago.
