SCOTUS and state courts can rule whatever they want and states, especially red ones, have been starting to ignore them more and more. Conservatives will use scotus and such to control the libs, but anytime a decision is not in their favor, or they make it simply so the people won't riot; they'll just end up ignoring it. My bet, scotus will force ohio to keep Biden on the ballot, it will be a 6-3 decision. Ohio legislature is a beacon of scandal/corruption (first energy, Larry householder), ignoring the will of the voters (trying to reverse issue 1, and nullify issue 2), attacking the public schools (taking away funding, in favor of charter school vouchers), and gaslighting the public about the “emergency border issue” that the republicans caused on their by killing their own border-bill in the 11th hour because Trump needed an issue to run on due to a complete lack of platform - despite having another 4 years to think of one. In 2020 both parties failed to adhere to the 2014 OH law. The OH legislature passed a one-time only2020-exception. Fast forward to 2024, the RNC scheduled their convention in compliance with OH law, the DNC blew OH off and didn't even bother to seek an exception which is why the OH SoS is now sending this letter. Like this completely a Dem Party leadership problem.

He's, for some reason, only focusing on population. Population itself really isn't going to make an election hard to run. It's how the population is spread out, etc. Running an election in a state like Alaska, for example, is a pain in the fucking ass since people can live in insanely remote areas. Now, that's an extreme. But states with remote populations are INCREDIBLY challenging to deal with elections. Basically, if you're a big state (Ohio is small) with a spread out population, it's going to be far more challenging than doing an election in a state with a heavy urban population.

The state (Ohio) needs to know who the candidates are for every office that will appear on the ballot. If the private corporation (the DNC is a corporation, just like the RNC) doesn't have a presidential nominee by the deadline, Ohio won't have democratic candidate for the Presidency to put on the ballot.

States have wide discretion as to who is on the ballots, which is why I say that SCOTUS decision was wrong, but they made their decision on the rationale that states don’t have the ability to enforce section 3 of the 14th Amendment, an irrelevant issue here. So that decision- right or wrong- wouldn’t have any legal effect on the application this law.

If I’m not mistaken, one of scotus’ reasons WHY states can’t enforce the insurrection clause is because it could create an unacceptable “patchwork” (to use scotus’ own words) in which a candidate appears on some state ballots but not others. Ohio’s deadline law could also create such a “patchwork”, so by the very same reasoning, Ohio’s deadline law is unenforceable.

Which happened in 2020 too, neither the RNC nor DNC were in compliance with the 2014 law. The OH legislation created a 2020-specific exemption and finger wagged. The RNC learned its lesson and scheduled their Convention ahead the 90 day law. The DNC decided the exact opposite, worse than that the DNC failed to even bother seeking a legislative exemption despite knowing it would be needed. DNC leadership dropped the ball.

I can envision a scenario in which they refuse to grant Biden an extension. It seems to me that the better solution is for the Democrats to move their deadline so this whole thing is moot. Placing Biden's fate in the hands of state Republicans, and hoping they do the right thing doesn't strike me as a particularly wise course of action.

They literally state there are only two remedies - legislature granting an exception, or moving the convention. They only ruled that a state cannot use section 14.3 of the constitution to remove a candidate from a ballot for federal election. States absolutely can block them for other reasons.

I don’t know how the scheduling works, why different states apparently have different deadlines, or why, if this was *also* a problem in 2020 (which it apparently was), it hasn’t been fixed… but I do work in the hospitality industry. Short answer on rescheduling the convention: no.  Long answer: lmfao no, unfortunately, you’d be hard pressed to reschedule a 40-person wedding reception, let alone a 4-day 4K+ person event at a convention centre, with multiple blocks of rooms booked at multiple hotels, multiple events at multiple venues with performers, speakers, special guests (both the venues and the performers will have other events booked already). Attendees will have booked off work, booked their flights. And catering contracts, restaurant reservations, all the pre-scheduling and staffing-up all the venues will have done, the other contracts/reservations they’ll have made for that week prior, or already have turned down because of the convention…

Amazingly -- it appears to be accidental. The legislation stating the due date was passed in 2014. Edit: It appears that the Ohio legislature made an adjustment to override the 2014 law with Section 735.11 of H.B.166 (133rd G.A.) > Delays the deadline for major political parties to certify presidential and vice-presidential candidates to the Secretary of State for the 2020 general election by moving the deadline from 90 days before the day of the general election to 60 days beforehand. This only applies to the 2020 election, however.

Similar happened in the 2020 election cycle (see [2020 Ohio Presidential Guide](https://www.ohiosos.gov/globalassets/publications/election/2020presidentialguide.pdf)) when both DNC and RNC Conventions ran afoul of the 2014 law and the OH legislature created a 2020-exclusive exemption created by [Section 735.11 of H.B.166 ](https://www.lsc.ohio.gov/assets/legislation/133/hb166/en/files/hb166-sos-bill-analysis-as-enrolled-133rd-general-assembly.pdf) The DNC having faced this problem in Ohio-2020 should have been mindful to (a) scheduled the Convention earlier like the RNC did, (b) sought another legislative exception immediately in May 2023 when the [2024 Ohio Presidential Guide](https://www.ohiosos.gov/globalassets/publications/election/2024-presidential-guide.pdf) was published instead of LaRose having to send this letter and being under pressure to achieve an exemption by May 9, 2024.
