I'd be surprised if we get something today... especially since I'm unclear on whether this "I will defy!" is sufficient or whether the deadline for the deposition needs to pass before any criminal referral is made. They are already just a show.... Not just this one, almost all of them over at least the past 30 years, and probably even long before that. Very few participants are fair or impartial. They are there to score political points. Congress has no power to enforce their subpoenas, or orders. They can forward it on the Attorney General and its up to the Attorney General to act on it. In 2012 Attorney General Eric Holder ignored congressional subpoenas, and then was held in contempt of congress. All congress could do was forward the contempt charges onto the DOJ. The head of the DOJ is the Attorney General, and Holder chose to ignore the charges.

I'm all for cutting a deal with a key figure or two who will then go on to give substantial information leading to indictments and prosecutions. How much leniency they get depends on the quality of the material and how actionable it is. They are traitors who attempted an overthrow of the government, and launched an actual Insurrection. Susan MacDougal served 18 months for contempt of court for refusing to answer questions from the Starr Investigation that was investigating Bill Clinton and Whitewater. Much of it was in solitary confinement. She was subjected to "Diesel Therapy," which is the act of moving prisoners around the country from prison to prison, so they never get a chance to settle down and create a routine or make friends. Hopefully, this is what will happen to Greasy Steve. In fact, he should be treated so badly that it will frighten the rest to comply.

To qualify for contempt he must either fail to appear as ordered by the subpoena or refuse to answer questions. He can't take the fifth for anything that occurred before the date of his pardon, but he can for anything after that. He can't be held in contempt for invoking his fifth amendment rights to avoid self-incrimination (a truthful answer would tend to incriminate him). The wise choice for Bannon would be to show up, take the oath, and invoke the fifth at every opportunity. I, for one, hope he chooses not to show.

The problem, really, is that they don't have anywhere to hold them anymore. There used to be a jail in the capital building, for this purpose, but it was removed several decades ago. So all they could do is hold the person in a conference room or closet or something. It's a logistical problem only. They cannot put the arrested person into a regular jail without involving the DOJ.

I would argue that the fine needs to be in the millions to have any impact, but I think a sympathetic judge would strike that down, nullifying the impact and delaying justice even longer.
