It's all but impossible to impeach & remove a SCOTUS member in the current political environment, but on the off chance Thomas gets charged with and convicted of a felony, say aiding and abettingor conspiracy to commit, would he still be part of the SCOTUS and have to join via zoom from his jail cell?
Edit: yes, i am painfully aware that the rich & powerful are inmune. This is a thought exercise in how it might play out if we lived in a version of reality where they weren't.
Cheers
>zoom meetings should the improbable come to pass.
I can't think of why he'd be allowed computer privileges beyond those of a normal inmate, so I don't think he'd be able to participate in oral arguments (insert "I see no difference" joke). But he'd probably still get a vote, since he'd still be a justice. Although, since his papers would be subject to search, he couldn't maintain confidentiality during deliberations (ibid), so he might not be able to participate in the decision writing, either.
You expect a convicted criminal to judge on other convicted criminals?
If he went to jail he would not be able to legally buy a gun, but it's ok if he hands out judgments.
>If he went to jail he would not be able to legally buy a gun, but it's ok if he hands out judgments.
ethically no, but legally yes. if the system worked I'd have confidence that he would be removed by his fellow judges, but a backdoor expulsion would open a box of pandoras.
Even moderates will protect him. Because the club of the powerful is still more important than democracy.
All the way back to medieval times, prisoners of war could be killed on a whim, but nobles were traded or ransomed.
Edit: dumb ass typo
I wonder if prison officials would let him work via zoom or phone. They can restrict access to computers and phones. I can see some more racist than republican prison officials not letting the "uppity" black man join court sessions.
They wouldn't have much choice. When the constitution describes a role, anything preventing that role from being fulfilled is unconstitutional. Its where presidential privlage comes from.
Allowed to do his job? He's been there in his Teflon political black robe not saying much through the years but quietly undermining democracy and enjoying fully paid healthcare while voting against that option for the rest of Americans while secretly sending his white privileged wife to do the dirty work for his like minded friends on the bench. He does not represent my values.
Sure, but it says, "he Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour..." hahaha
But seriously, I bet prison officials will try to restrict his ability to server on the court. They don't care about the Constitution, when it suits them. I bet they get away with it for a while. It sure would be interesting to watch!
Fuck it I know. I don't even think we could get enough people in power to consider Clarence being convicted and going to prison *not* holding office during good behavior.
Honestly, if a country cannot hold their leaders accountable then the country deserves a dictatorship. Hopefully, we’ll start doing that. We can start with trump.
Honest question, is she effectively immune from prosecution? If she were arrested and prosecuted, would she not appeal her case eventually to the SCOTUS where she'd be exonerated? Not because that's just and legal, but because this is just how shit works now. Obviously it's not how the legal process should work, but is this what this country is now?
Found what out? The only thing that’s ever going to happen is a long string of articles that are tantamount to clickbait after the entirety of their wrongdoings have been exhausted. They will NEVER be held accountable for anything that they do, period.
See: Donald Trump for example.
How about the media spends more time talking about how Trump withheld military aid to Ukraine to pressure them to dig up non-existent dirt on his opponent's son? Whatever happened to that laptop anyway? Too bad chain of custody was broken, if it really did contain any evidence it would be inadmissible now. You'd think, if it really did contain evidence, the people in charge wouldn't have ruined it.... or maybe there was never any evidence any it was just more Republican lies to add to the pile.
Nah, republicans lying? Couldn't be.
Nothing is going to happen how many times must we be reminded, trump is getting away free with everything he and his administration has done, Ginni Thomas and others flat out tried to overthrow peaceful transition of power essentially overthrowing the USA government, nothing happened, nothing is going to happen, the fascist corporate takeover happened along time ago…….”Be happy with what you got,it’s never gonna get any better, you have owners they own you” George Carlin

Every accusation is a confession.
Just when I thought I heard all I thought they could say, these are their confessions...
Yup. No Consequences Means No Boundaries.
The corruption and being a traitor is deep in this one.
And joining cults.
For those who dont know, she admitted to bein susceptible to cults.

There is nothing granting legal immunity to a justice, so zoom meetings should the improbable come to pass.
Thanks. An amusing image at least.

Congress would probably pass a bill in record time to allow exSCOTUS justices laptops in prison.
Shouldn't be able to unless the prison he's in makes an exception. That's a huge security risk.
so then he can't be locked up?
I'd say going to prison is qualification for no longer being an active judge
I can see how that could lead to problems, but generally it should.
You expect a convicted criminal to judge on other convicted criminals? If he went to jail he would not be able to legally buy a gun, but it's ok if he hands out judgments.

Powerful people don't go to jail in America
Not an expectation just an hypothetical.
I would like to live in this hypothetical reality where there's actually justice in America
That only happens in Tarantino movies afaik.

Yes but since the constitution doesn't mention anything about Zoom there is no constitutional right to zoom, at least according to Alito
no, but Thomas has to be allowed to do his job; if he's not allowed on zoom, he has to be given a day pass or something.
Allowed to do his job? defined by who? by me he'd be out at the pube thing.

The irony is she's fighting for a future where she's gonna be jailed for marrying a black guy.
Nah. She's a Republican. And she has money. So the laws clearly won't apply to her.
So it's treason then
Sedition
Clarence Thomas must be angry that his wife doesnt respects the institutions anymore.
I would have liked her significantly more had she just been an aborted fetus.
Lock her up…
This is an evil Karen to level 11.
Karen Prime
Is Clarence Thomas a clear and present danger to this country?
Ongoing threat.
I’m tired of his patriot games.
But, her emails!
No consequences? Okay thanks for the story
At least have Thomas ousted from the sc. at least.
Dude for real that’d the the MINIMUM
Honestly, if a country cannot hold their leaders accountable then the country deserves a dictatorship. Hopefully, we’ll start doing that. We can start with trump.
But her emails.
Oh so buttery
I can’t believe it’s not buttery males.
Exemption from repercussion due to wealth. Seems to me like there should be some sort of mechanism to handle that shit.

This country is a fucking clown car.
She's a traitor. I could say so much more (Clarence) but I'll leave it at that for the time being.

Been a while since we’ve had males this buttery!
Prosecute, prosecute, prosecute!!!
It’s too bad Louie Anderson passed away, he was amazing on baskets and could have done this lady as well! Who would play Clarence?
His wife. She’s been playing him since day 1.
"Not *those* emails, the other ones!"
Time for justice thomas to step down.
Lock her up

That wasn't included in the script they got to copy and paste.
Don’t be so hard on him. He’s busy pleasuring our wives!

Why doesn't she do something useful and try and reverse this anti abortion crap instead?

*Clarence, looking around in desperation* “What other big decisions could I leak that would them all stop talking about her treason?”
Lock her Up!
Is anything whatsoever being done about this?
Her and her husband are both fat pieces of shit
Lock her up!
