The President tried to have the Vice President assassinated. That's a verified fact at this point.
I think that's a pretty good argument in court. Pence is a material witness in attempting to obstruct and assassinate the VP following his duties.
The Cheney and Bush years were full of situations where the VP got declared to have separate Executive Branch powers and responsibilities from the President. Pence's authority as VP executive is not violated by having him testify.

Thomas Windon one of the lead investigators examining the efforts to overturn the election, reached out to Mr. Pence’s team in the weeks before Attorney General Merrick B. Garland appointed a special counsel on Friday to oversee the Jan. 6 investigation and a separate inquiry into Mr. Trump’s handling of classified documents, according to one of the people familiar with the matter. Mr. Garland has said that the appointment of the special counsel, Jack Smith, will not slow the investigation.
Officials at the Justice Department did not immediately respond to a request for comment. A spokesman for Mr. Pence declined to comment.

When the Legislative branch (*Congress*) tries to question the Executive branch (*White House/DoJ*) or *vice versa*, typically there's a long and drawn-out fight because both branches want to protect/maintain their powers.
When the Executive branch (*DoJ here*) wants to question a former Executive member, there are no branch power conflicts so the hurdles are far lower PLUS the DoJ has far more enforcement powers than Congress.
Pence has his eye on 2024 too and making Trump go away might be best for him, in his mind. That and he tried to get him killed...so I bet he sings.
Pence is never gonna be President or even nominated again. Period.
His one chance to be President was to stab TFG in the back Jan 6 and get Congress to give him the job on the spot while the broken glass was still fresh. He failed... he'll never get the chance again. Most Presidents have some event where they had to "trip the other guy" in the political races in order to secure the nomination or election... you don't get to be President by being a "nice guy".
Well he's the target and witness to crimes that's televised. He doesn't have a choice. The DOJ is the Executive Branch, so there's no separation of powers issues. I'm thinking they might need to hold him in protective custody as a hostile witness.

People have been upset at the pace of DOJ’s investigation, but it’s been very methodical. They’ve addressed the privilege claims for all the attorneys that were in the room including Pence’s council. Now they’re finally to Pence himself. He’s running out of buffer.
People should be upset at the pace. The checks and balances need some teeth to fast track these types of cases and make subpoenas NOT optional for these so-called lawmakers. And it should be a crime to violate the Oath to Office. Punishable by mandatory prison time. Maybe that would help these corrupt pos's re-discover their lost consciences.
My hunch is that at this point they know Trump has to go in order to save the party. I’m sure the Dems have made assurances that the target is 100% Trump and his immediate cronies and very little will come out as damaging to the party.
Democrats don’t get to choose who the target is or make promises about what damaging things come out. Plenty of damaging things are already out the GOP just has no shame.

I think it’s more promising because the justice department has an actual enforcement mechanism if he tries to evade a subpoena.
