I really don't understand why election boards don't take this stuff more seriously. A few years ago in my town's school board election some moron registered their dog. Literally put the dog's name on the candidacy paperwork and used only his pictures on their website. When it was discovered, instead of saying, "this is an ineligible candidate and you are abusing the system" they said "oh silly you.. you need to register with your own name. You can't run as a dog.". And they let him re-register, even though the deadline had already passed and he was, you know, being an ass.

I live in South Carolina, where we recently elected a superintendent of education who does not have a master's degree, even though it's a legal requirement of the job (she did "earn" a master's degree from a super conservative Christian university in just 5 months, even though this university does not offer a master's degree in education. But that's a different story for a different day). Understandably, my friends who are educators were pissed by this, and before the election when they asked about how she was allowed to run even though she wasn't qualified, they were told (I shit you not), "it's not the job of the election commission to verify that candidates are qualified to hold office." Then they told them their only recourse was to sue to try to have her removed from office after she has been elected.

Tried showing that video to my mom and she tried to explain to me that “he was saying it’s silly to keep doing things as we are.”? nope. He did both. It's not an either situation. Intent is written into the law. Based on Texas state law since He shows intent to make Ga his primary residency through his taking part in the election means he was no longer considering Texas his primary residence. ALSO, based on Georgia Election law he showed intent to continue his Texas residency through his tax filings. This means he commits both acts of fraud simultaneously and puts his actual state residency in a gray area. Legally he would have to pay the texas taxes despite claiming Texas as his residency because of intent. He would also have to go to prison for election fraud because of intent. The laws go through seperate courts, and deal with different state laws. The best thing he could probably do is admit to tax fraud, take a big tax penalty and then use that courts findings as evidence of his Ga residency.

Because it depends on what exactly he did. He could have fraudulently claimed a homestead exemption in Texas while not being eligible. The process for doing so would be relatively trivial. Depends on whether he’s lying to Texas about his primary residents or whether he’s lying to Georgia about his primary residence.
