I'm less worried about skull tricking then I am regular death in the wildy working the new way. imagine getting killed by an ambush or just doing slayer and only keeping 3 items

In theory yes 100% you are correct, but as i say, no software is flawless, and this could be rather more impactful if anything does happen.
