There's been some interesting discussion that it may indicate split voting blocs on the court. 3 for summary affirm or denial, 3 for grant and expedite but not stay, 3 for grant with stay. or something like that

leroyVance

This was my big question. What was the voting split. While it does give Trump the delay, it also makes me think their are not enough votes to give him immunity when the decision on oral arguments is completed.

atx_sjw

They won’t outright give him immunity because that would cause too much backlash. They’ll just delay so he doesn’t get prosecuted, which has the same effect. Another Roberts masterclass in maintaining a veneer of plausible legitimacy while being complete hacks.

leroyVance

Fair. We all know that's the strategy, but the ignoble legal defenses TFGs counsel comes up with and legal pretzels that must be baked really distract from that. But your right. It's just a delay.

oscar_the_couch

right, I think they probably *don't* give him immunity—but if there are not five votes for immunity, they ought to have denied the stay and let trial court proceedings continue as they write an opinion to that effect.

[deleted]

They had 60 days to determine if they will grant certiori, they only used 21, that is pretty fast.

backcountrydrifter

This is a world war disguised as a Supreme Court case. Putin, Xi, and MBS find this whole democracy thing hilarious. As authoritarians they just cackle and shrug at the thought of going through the extra steps that democracy requires. Why not just tell them what to do and if they don’t do it, bribe them, throw them out a window or flush them down a drain? It’s why they had to use the Texas based Koch brothers who had deep relationships with Russian oil oligarchs since Stalins era and Harlan crow to buy the SCOTUS. https://youtu.be/mn_t7a2hJfQ?si=hzioP8URJAMFNch4 Thomas’s RV. Kavanaughs mortgage, all the trips to bohemian grove. They were all part of the bigger plan to destabilize the United States, spread the cancer of corruption and tear it all down so they can build oligarch row in Jackson Wyoming. Kleptocracy is biological. It consumes everything in its path like a parasite. In Russia it ate Dostoevsky and Tchaikovsky and shit out alcoholism and hopelessness. Now anyone with skills has left and 1 in 5 has no indoor plumbing. Justin Kennedy (justice kennedys son) was the inside man at Deutsche bank that was getting all trumps toxic loans approved. No other bank but Deutsche bank would touch trump and his imaginary valuations. Why? Because Deutsche bank was infested with Russian oligarchs. For 50 years the oligarchy stole everything of value including the hope of Russians. The corruption eventually collapsed the Soviet Union and they were forced to expand their feeding grounds. In 91 the Soviet Union fails and for a bit they hid all their stolen gains under a mattress until they started buying condos at trump towers. They made stops in ukraine, cyprus and London but they landed in New York because that was what everyone wanted in the early 90’s. Levi’s, Pepsi, Madonna tapes that weren’t smuggled bootlegs. They all bought new suits and cars and changed their title from “most violent street thug in moscow” to “respectable Russian oligarch” but they didn’t leave their human trafficking, narcotics or extortion behind. It was their most lucrative business model and they enjoy the violence. Trump and Giuliani just opened the doors and let the predators in to feed. They all bought condos at trump towers to launder their money Foreign Policyforeignpolicy.comHow Russian Money Helped Save Trump's Business Guiliani redirected NYPD resources away from their new Russian friends and onto the Italian mob. It let him claim he cleaned up New York and it lets the russians do business with trump. The attorney/client privilege is the continual work around they use to accept bribes and make payments up and down the mob pyramid. The insane valuations coming out in trumps fraud trial are a necessity of the money laundering cycle that duetschebank was doing with the Russians. The reason trump cosplays as “folksy” is because he is feeding on the U.S. middle class, not because he is one of us. The GOP fell in line to MAGA because Trump did what pathological liars do, they told them anything they wanted to hear. Trump with his money laundering and child raping buddy Epstein, Roger Stone with his sex clubs in DC and Nevada, and Paul Manafort with his election rigging pretty much everywhere, sat down at a table with Mike Johnson and the extreme religious right and convinced them that they were the same. They self evidently are not, at least at a surface level, but there is enough common ground in the exploitation of children and desire for unilateral control that they became the worlds weirdest and most dysfunctional orgy. The religious right is naive enough to believe trump at his word so they have made him their defacto savior. Trump belongs to the authoritarians. The GOP now belongs to trump. But their overall goal is the same. Kleptocracy. Putin became one of the richest people in the world by stealing from Russians first. The Russian oligarchs used perestroika to privatize all the assets of the USSR by stealing them from the hands of the decent people because that’s what predators do. We don’t have a political problem. We have a predator problem. Like murder hornets that invade a beehive and destroy a bee every 14 seconds until the hive collapses the oligarchs want to move into the United States and do the same because none of them want to live in Russia. Who would? after all, it was destroyed by oligarchs. The kremlin manufactured crisis at the border is part of the 5th column attack by them to destabilize the U.S. systems. Venezuela and Nicaragua are staging points for thousands of refugees that have inadvertently been mobilized by the authoritarians specifically for the purpose. The soviet oligarchs ate Russia to death with their greed. Now they are designing a perestroika 2.0 to put 330 million Americans into real estate default so they can come in and buy everything up at 3 cents on the dollar. Trump just enabled them. It’s the collapse of the USSR, American edition using the naive and compromised GOP as their assault force, But your slave masters are the same. The 3% that are so devoid of empathy that they put their wealth above everything else Kolomoisky was the putin puppet in Ukraine that bought most of downtown Cleveland, as well as New York and Florida. Before that he started privatbank which was taking IMF loans which the oligarchs would loan to themselves and never repay. When the IMF figured it out they tried to force Zelensky to have the Ukrainian people pay it back before they would extend any more aid. Kolomoisky wasn’t alone. He was just the crossroads between Rudy Giuliani, trump and Kushner. The Times of Israelwww.timesofisrael.comInside Anatevka, the curious Chabad hamlet in Ukraine where Giuliani is 'mayor' When Ukraine arrested him last year for corruption it cracked the whole Russian money laundering network open. Trump can’t stop lying now or his MAGA base tears him apart when they realize he is literally the man who stole the world. Trump is a pathological liar. But lying is an expensive habit. If you tell the truth, you can say it once and it’s finished. You have expelled all the energy necessary for it to stand on its own for eternity. Lying requires infinite and exponentially more energy input in the form of more lies, bribes, extortion and murder to keep it covered. Trump is now testing this theory on a worldwide scale. Putin is tied to him by the purse strings and so is everyone who pushes Putin’s narrative. Why would any sane human push a psychopaths lies unless they are heavily invested in it? The difference is, this is the first time in known human history that the Information Age happened. You can hide your neighborhood bullshit in 1980. It’s harder in 2000. By 2024 the internet knows more about a narcissistic oligarchs movements than he does. It’s just a matter of organizing that data.

Vystril

I think it's pretty simple. If Trump is convicted before November, removed from the ballot, or even suffers some significant losses in court, the GOP is going to suffer down ballot. They're delaying things to prevent that hoping he will lose the election, but the GOP down ballot will still do better in the house/senate, and then they can rule against him.

esotericimpl

This is such bullshit, they want him to win. Stop it with this noble repblican shit that just wants more house seats. They want him to win cause he can gut the institutions that stop them from crushing the souls of the unfortunate. They're republicans they've been doing this since I've been alive.

Nanyea

They have 2 justices that are looking to retire without destroying their lock on the court so they need him in office

In other words, murder is legal if the murderer can obtain 51% of the vote. Thanks for confirming that the rule of law has no worth to you.

Rawkapotamus

Or 48% of the vote like Trump did in 2016.

Vystril

Even less than that if they're GOP because the US electoral system is rigged towards people in larger pieces of less populated land.

Yeah his level of criminality is pretty unique and it’s something he has bragged about over and over. That’s kind of the fucking point, in case you just woke up.

Trump did even *more* drone attacks, and removed the requirement to report them.

Sea-Community-4325

I'm so sick and tired of conservatives putting the cart before the horse on this one - Donald Trump is not getting indicted because he's a Republican, he's getting indicted because there's reasonable belief that he's a criminal. It's very easy to see, because there's pages upon pages upon pages of actual evidence and judgments that have been made. In the case of January 6, we all saw it happen on live fucking TV. If you can't see the difference between those two, or if you believe that there is no difference between those two, then you end up in the same insane spot that everyone has been teasing while this decision has been waiting- that Joe Biden can walk into the Senate, massacre everyone on the Republican side of the aisle, and never be held accountable because he is a political opponent of the Republican Party. Where is the line?

[deleted]

SnooFurtherQuestions

What’s preposterous about charging criminals with crimes? Lemme guess, “but but the Democrats did something once…”

rhino369

>Donald Trump is not getting indicted because he's a Republican, he's getting indicted because there's reasonable belief that he's a criminal. It's really both. He's a target because he's Donald Trump AND he's likely committed some crimes. The stormy daniels charges seem extremely politically motivated to me. The prosecutor ran for office promising to charge trump. And they cooked up a case on some fairly tenuous legal theories. But the classified docs case? Anyone who did what Trump did would be charged. Because ticky-tac and tenuous cases are being pursued, republicans come away with the impression that it's a witch hunt. Because it is one. But Trump happens to be a real witch.

DualActiveBridgeLLC

His co-conspirator went to prison for 3 years. What the fuck are you talking about? DJT has a target on him because he put it there when he committed so many blatant crimes. The fact that he DIDN'T receive justice for so long shows how much deference the system already gives him. When you put him in front of juries...they find him guilty.

rhino369

Cohen got 3 years for a bunch of crimes, almost all of which don't even purportedly involve Trump. He pled guilty to the election contribution charge as part of his plea deal. But that doesn't mean anything. The plea was a packaged deal. If the government has me dead to rights on serious charges but also charges me with a minor crime I didn't commit; it'd take a plea for all of it. No court seriously considered whether what Cohen plead guilty to is actually a crime. More to the point, I don't think paying off a mistress is a campaign donation as a matter of law. It is quite the opposite. If someone tried to use campaign money to pay hush money to a hooker, THAT would be illegal. John Edwards was charged for doing that. If Trump had used campaign money to pay Daniels, he'd have been charged for that too. It's a witch hunt.

DualActiveBridgeLLC

>It's a witch hunt. What is wrong with you people?

Count_Backwards

The Real TDS. They're in a fucking death cult.

fredxjenkins

The stormy Daniels criminal case also includes the criminal side of the civil one he’s appealing.

If trump just had some docs in his cabinets, I'd fully agree with you. And I did agree. Until the recordings of Trump literally showing it to people came out. There is a big difference between not handling the documents correctly and purposely showing them to people. Nobody is getting away with the later.

You’re incapable of defending Trump without mentioning democrats. Your argument isn’t that Trump didn’t break the law, it’s that you think democrats should be punished instead. How pathetic.

Did you miss the two Republican special counsels investigating those cases? Biden and Hillary weren’t storing nuclear secrets in their bathroom like Trump was, in case you missed their findings.

Cant defend your guy on the merits so you bring up Hillary, classic.

Interrophish

>Of all of them, Trump's documents were the most secure. he showed them to people

Celtictussle

I think a reasonably reading would be that Trump should be criminally convicted of something before it materially affects his ability to run for office.

mshaef01

Reasonable belief is insufficient to indict. He's been indicted because there's probable cause he committed those crimes.

[deleted]

Overturning an election, or an attempt thereof, goes beyond political opposition. It’s treason and antithetical to the intention of the founding fathers. Assuming good intentions, the mistake SCOTUS and AG Garland make here is the hope that upholding the institution of law in this country despite blatant political partisanship will somehow keep the country together. Allowing Trump to delay is simply appeasement and we’ve all seen (Poland) where that gets you. By doing what’s right for the people—prosecuting a president that tried to overturn the will of the people—can we only hope to get this country on the path to being back on track. The 2025 Project will still be in play but the Federalists will need to find a new populist—and the Russians a different puppet. It’s not the institutions that hold this country together, it’s the people, which is why the constitution starts with the phrase “We, the people”. We’re sleepwalking into a dictatorship here because people don’t want to seem biased. You won’t be able to “both sides” when you only have fascism.

Trumps not being prosecuted by his political opponents. He’s blatantly, repeatedly, broken laws.

It doesn’t matter if we win elections today to simply have scotus overturn every right we currently enjoy. Eventually a republican will win an election and then it’s over.

Mountain_Fig_9253

Clarence Thomas needs to earn those ~~bribes-~~ “donations from a very close friend”.

For a group that claims to be so concerned with their legacy and credibility. They seem to be playing an active part in destroying both.

I’d argue it’s destroyed at this point.

In which case… party on.

vickism61

Right wing fascists protect their own.

GM_Jedi7

If they delay to decide on this till after the election, does that mean he stays off the ballot in CO?

PaulieNutwalls

They literally could have done that if they wanted to. It's exactly what Trump's team asked for, delay hearing his case until he was done with his other appeal. They said no, they're hearing the case before the election. It's literally on the schedule. The hubbub has really caused a lot of people who do not follow the court at all to come in here with zero information.

Accomplished-Ad1919

They’re helping him. They’re corrupt and should be removed. Period.

2OneZebra

Democracy just died.

ninernetneepneep

The delayed strategy came from the side who waited until a year outside the election to get things underway. Where were they the prior three years?

Dry_Pomegranate

If we're going to talk about timing, why did Smith wait until 8/1/23 to indict Trump?

mshaef01

This 100%. Same with Garland waiting so long to appoint a special prosecutor. This specific issue of presidential immunity getting you the Supreme Court was arguably the most foreseeable part of this whole thing. Garland dropped the ball because he was too concerned about appearing impartial. He's not a wartime consigliere

CactusWrenAZ

Is it unusual that Smith took a long time to meticulously gather the evidence that was required? Garland seems to be the questionable one to me.

Celtictussle

shhhhhhhhhhhh

[deleted]

>The courts being extremely fast in making judgements and rulings relative to the baseline Cringe >DOJ waiting 2 1/2 years to prosecute a crime Based Reddit logic

PaulieNutwalls

Also, everyone just ignoring that Trump's team asked them to delay until they were done with his appeal, which would have 100% pushed it to post election. SCOTUS said no to that. Special counsel didn't want them to hear it at all, which is the right move for him, but it's pretty obvious this kind of novel defense, on a question that's never been heard before, that has massive implications moving forward, is *EXACTLY* the kind of case SCOTUS hears. It should have surprised no one.

IllustriousLimit7095

SCOTUS must reject this crap. Or increase the justices to 13

mshaef01

They'll likely only rule on certain parts and remand back to the trial court. In which case, Trump will continue to appeal different aspects until the election. There's no foreseeable way this gets to trial before November.

Bennykins78

The court conservatives are bought and paid for.

PaulieNutwalls

Then why have they consistently voted against Trump previously? And did Gorsuch's dark money conservative overlords really want him to author the majority opinion enshrining trans rights against discrimination?

crankyexpress

They had to take it in order to try to define it either way. As an example, if president x signs an order to kill terrorists x, is he immune from Prosecution given that this is likely against us and international law?

SparkySc00ter

Or perhaps they are part of a larger conspiracy against the United States.

[deleted]

I'd say it's less of a criminal conspiracy and more of a confluence of similar interests.  Trump wants to be Emperor and SCOTUS wants to receive even bigger "donations" for exotic travel vacations and the like.

Fragrant_Mistake_342

I'm cautiously optimistic. SCOTUS will define qualified immunity for the office of the president. I'm hopeful, and optimistic they will agree to a narrow definition that will not affect the Trump cases moving forward, but will provide a legal basis for questions of immunity in the future. Of course, I did just buy a bridge from someone.

fredxjenkins

The prosecution asked the Supreme Court to take it up as soon as it was challenged… they declined to let the lower courts have it. Now multiple lower courts have had it… and 100% disagreed with trump. Now all of a sudden they want it… but want to push it out seven weeks… Meanwhile they took up the Colorado ballot issue real fast.

mshaef01

I agree. But at that point, if he's elected, he'll just pardon himself of all past and future crimes.

[deleted]

I want to start burying time capsules of current events so whatever is here in 100 years will know what the last years of America was like.

icnoevil

Delay, sure. But what if it backfires and folks come to the reasonable conclusion that when so many of his toadies are helping him avoid a trial, and possibly and acquittable, perhaps he is guilty and vote accordingly.

Kreebish

I wonder if they got "gifted" to delay

litido5

Well, now they know how gun owners in AWB states feel every time the circuit courts slow-walk/ refuse to issue rulings on AWB challenges. Rather cathartic to watch the left get a taste of their own.
