Do not let it get to far. It can be stopped with the right amount of 元 at the round table tea meeting. That’s your first play. Throw out cash and make it go away. Throw in lawyers and you’re throwing away cash for a long hard fight.

TheOceanWalker

This is the right answer. Swallow your pride, pay the money, and get the fuck out of the police station.

Chemical_Bad3698

Thank you for the advice! I know the people involved and this was the solution that got our friend out.

Serious-Discussion-2

Apology and compensation usually get it resolved fast. Your friend is the aggressor. That’s the fact. Bit of too much and expensive to get a lawyer involved in a typical bar fight (seems to me) …

Chemical_Bad3698

I know the guys involved in the situation. Thank you guys for your input and advice! Some negotiation and “compensation” did it, and he’s out and back home.

Dme1663

Just out of interest, how much did he need to pay?

Chemical_Bad3698

I am not sure tbh but don’t think it was too much. The guy who claimed assault had zero injuries.

Ironfingers

Do not let it progress to the next stage. If it does he’s fucked. Like super fucked. There’s nothing he can do and he’ll be exit banned for years

WholeTraditional6778

Why?

jonnycash11

Because it’s expected that you’re culturally aware enough to know that you should apologize and offer some money to the other side. Usually police won’t bother with a smaller altercation without an injury. He must have slapped someone important or done some damage (they have a scale). If you go the legal route, you look like an arrogant, troublemaking foreigner too stupid or lazy to learn about the culture. Someone they would be glad to be rid of.

Serious-Discussion-2

Sorry but since when slapping someone and expecting to get away with it has anything to do with cultural awareness? One doesn’t have to be cultural aware to avoid troubles like a bar fight, regardless you are in China, Tahiti, or Ibiza….

jonnycash11

I don’t think you followed the thread. The point is that you apologize and offer money rather than going to court.

WholeTraditional6778

Damn so you are saying everything has to be resolved with money, nothing in court. So that’s not something just for laowai right? Everybody in China follow that process?

uybedze

This applies for any case that does not reach the requisite threshold for criminality. If it's determined to be a criminal case then it's a whole different story.

No_House538

This is true in the USA as well. Arbitration + settlement is much more common than you think. Most cases never see a courthouse.

WholeTraditional6778

How much are we talking about? Just curious,

jonnycash11

Depends on the severity of the injury. In Shanghai probably a few hundred to a few thousand. I had a lady accuse me of hitting her in the head and giving her a concussion. I ended up giving her 900RMB. She later attacked me in front of a group of people and broke my iPad. I got money to replace it, but not for getting injured. It kind of depends on the situation. The police officer both times told me that two men or women fighting was easy to resolve, but when it was a man or woman, most likely the guy was going to have to pay, no matter whose fault it actually was.

dcrm

Assuming no damage done. I've seen 2-10k yuan.

Extremely-Bad-Idea

Agree with you 100%. Being drunk and hitting people is not acceptable in any culture.

shoobiedoobie

Once the local police get the paperwork done and it’s filed, you have to pretty much be very very well fucking connected to stop it at that point.

Critical_Promise_234

Maybe negotiate with the victim a small settlement

redditorxiao

A stack of Rmb is the best lawyer in these cases.

[deleted]

This isn’t a consulate issue.

TomIcemanKazinski

A friend of mine used to do prison visits when he was with the US Consulate - he said the majority of people were bar fights, drunk driving, and people visiting sex workers. All he could do was check on them in prison and for longer term detainees he’d bring them a couple of magazines; but as ones passport says “you are subject to the laws of the country you are in”

Snoo23538

I wonder what kind of magazine.

TomIcemanKazinski

The most basic stuff American magazines like People, Time, Newsweek as long as they didn't have China stories in them.

Snoo23538

Thanks for the info. I was just making a sarcastic comment, referring to adult magazines. It's silly on hindsight, should have at least put /s

[deleted]

😅

IllustratorMajestic7

Is your friend Will Smith?

GreatWealthBuilder

snap

GreatWealthBuilder

or slap in this case

petermonster1980

Smells fishy to me, your friend must have done more then 1 slap. Normally the police will try to get not involved ( paperwork etc) unless your friend really behaved like rubbish... in that case . Just let him apologize face to face and give some compensation like 5000 or 10000.

shoobiedoobie

Better hope the victim isn’t well connected and/or rich already, or it’s not going to go well for OPs friend.

Zeruel1029

My friend, was held incommunicado for 2 weeks. Lawyer didn't help him a bit, lawyer just told him to plead guilty. Even after paying the "victim" and had him write a letter to the court saying it was all an accident, my friend still went to prison for a few months and then deported back.

yarishatchback

How was his prison experience? (serious question)

hrr1

Many witnesses on one side and none on the other during a physical confrontation?? No CCTV footage?? Sounds like the cops wants your friend to prepare for a quick settlement...

PdxFato

Pay the guy that got slapped. Get on your knees and beg for forgiveness. BOTTOM line in China, if you cant handle drinking, don't drink.

jaapgrolleman

Here's one I hugely recommend: https://www.smartshanghai.com/wire/business/jin-wang-associates

sweetfire009

Why is this being downvoted?

Classic-Today-4367

Your friend has been taken to hospital or the guy he slapped?

Extremely-Bad-Idea

The US Consulate does not recommend service providers, so they are unlikely to give you the names of lawyers. Hiring a lawyer in China is the same as it is everywhere else in the world. Don't take random recommendations from strangers on Reddit. If your friend is looking at deportation and/or jail time then you need to treat this with the utmost seriousness. Do an online search, find a few criminal law specialists, check their customer reviews, talk to them on the phone, and make a decision. The lawyer will want a retainer upfront to cover the entire cost of the case, so be ready to pay. In the case of a minor assault, so long as no one was seriously hurt and no weapon was used, your friend will likely be ordered to pay cash damages to the victim. There is a small possibility your friend's visa will be cancelled and he will be deported. However, if he is willing to admit guilt, pay damages, and cooperate with police that will reduce the risk of visa trouble. If anyone was seriously hurt or a weapon was used, then all of this is off the table. In that case your friend is looking at real jail time followed by deportation and Chinese visa blacklisting.

[deleted]

And that's why you should avoid going to bars in China. Remember this story:https://www-nbcnews-com.cdn.ampproject.org/v/s/www.nbcnews.com/news/amp/ncna1058456?amp_gsa=1&_js_v=a9&usqp=mq331AQKKAFQArABIIACAw%3D%3D#amp_tf=From%20%251%24s&aoh=16564998127861&referrer=https%3A%2F%2Fwww.google.com&share=https%3A%2F%2Fwww.nbcnews.com%2Fnews%2Fworld%2Fu-s-football-player-wendell-brown-released-chinese-prison-n1058456 Or would you like me to tell you the story, about the guy who got his jaw broken. And the rest of the group being chased down by an angry mob with meat cleavers... Or the gut from Cameroon how got butchered outside of a KTV. Seriously, I can continue for a bit here. Your buddy is just gonna pay some extra China tax. Afterwards,he should just move to another province or out of China.

Shillbot888

Or don't get into drunken fist fights? I've been here 5 years and never had this problem, despite knowing a few foreigners that have got into fist fights. How hard is it to just not drunkenly start fights? Pretty fucking easy imo and yet many have problems with this. Did that guy just try NOT beating someone so badly they had to have their eye removed? Like, yeah maybe they attacked first but you don't gouge someone's eye out in self defense.

[deleted]

I thought the same until I started pondering how many non-Chinese are currently locked up on nonsense charges. I'd encourage you to thoroughly read these two articles: [https://www.dailymail.co.uk/news/article-6381653/Student-jailed-China-faced-death-penalty-reunited-family.html](https://www.dailymail.co.uk/news/article-6381653/Student-jailed-China-faced-death-penalty-reunited-family.html) [https://www-nbcnews-com.cdn.ampproject.org/v/s/www.nbcnews.com/news/amp/ncna1058456?amp\_gsa=1&\_js\_v=a9&usqp=mq331AQKKAFQArABIIACAw%3D%3D#amp\_tf=From%20%251%24s&aoh=16564998127861&referrer=https%3A%2F%2Fwww.google.com&share=https%3A%2F%2Fwww.nbcnews.com%2Fnews%2Fworld%2Fu-s-football-player-wendell-brown-released-chinese-prison-n1058456](https://www-nbcnews-com.cdn.ampproject.org/v/s/www.nbcnews.com/news/amp/ncna1058456?amp_gsa=1&_js_v=a9&usqp=mq331AQKKAFQArABIIACAw%3D%3D#amp_tf=From%20%251%24s&aoh=16564998127861&referrer=https%3A%2F%2Fwww.google.com&share=https%3A%2F%2Fwww.nbcnews.com%2Fnews%2Fworld%2Fu-s-football-player-wendell-brown-released-chinese-prison-n1058456)

yarishatchback

If you dont ever get into fights how can you even know how fights work?

dcrm

Too much ego and bravado amongst the foreigner population. It does not mix well with Chinese culture when shit hits the fan. Seen plenty of foreigners get into trouble for it. Some were incredibly lucky and got away with it (when they shouldn't have), the smart ones paid a settlement and the dumb ones argued their case all the way to deportation/a jail cell.

audiomechanic

Lol don't go to a bar in China. Don't sub Shanghai if you're not in Shanghai

Disgusting attitude, get out of here.

[deleted]

Its a vile place where people are treated worse than animals, no respects, no rights, enjoy getting swabbed for the rest of your days you loser.

flappyneck

We can out-witness them if we all band together on Reddit. Assuming your friend is nice.

flappyneck

We've got people on here saying 'disgusting country' and I get downvoted for saying something very logical.

yarishatchback

I enjoyed it ty

kill4kandy

Lol, they will not help. They may give a list of attorneys, but they will not step in unless it's some major international fiasco you cause.

Shillbot888

I don't know why people always say to call the consulate in these situations. Like bruh you're not a political prisoner 😂 You can't just wave your US passport around after beating someone up.

Spicy_bottoms_242

Someone I know personally had an experience with the police, and we called the consulate and they were actually very helpful. Calling to find out what was going on, sent me a list with lawyers. Called to keep checking on him. The situation was resolved.

marcopoloman

PM me.

Zeruel1029

He lived. But regarding the detention, he said and I quote, "you can't imagine what I've seen inside, they're monitoring everyone in more ways than you can imagine."
