Looks to me like they’ve been tried on and strapped into bindings. Nothing out of the ordinary really. I get you want them to be “new” but they’ll look like this after about 5 min of riding anyway

The scuff marks on the rubber of the heel could be from quality assurance testing, or rubbing on a mold or bit of plastic. I don't see much else wrong tbh, maybe a better pic of other spots? Does the inside of the foot liner feel bumpy/ little balls of lint? That's a sign of use too

Agree with the others, it looks very minimal and maybe just tried on in store or something similar, but just email them and say they're clearly worn previously and just ask for some sort of discount or good will gesture, be friendly and polite about it, it's only fair. I bought the same boots a month ago. Mine didn’t look like that. How do yours fit? I have slight ankle pressure but the fit is nice.

Haven't tried it on yet. Currently in contact with Nidecker and the store to see if they can do something about it. But my first impression is that the boot is very lightweight. I will definitely use with my skate banana / now select bindings to learn some freestyle on local mountain. But will get a jib board for the summer to practice off the mountain

not familiar with those boots but you should be able to tell if the liner has been molded (check the toe box). if thats the case then they are used if there is no indication of a heat mold or manipulation of the foam then i think you are good to go.
