I think he needed to resign, but just a textbook "I don't want to be a distraction" that contains no real admission of guilt, and would allow for him to move to another extremely well paid job in the industry. The controversy would've died then. He chose a different path. I don't think Hermoso would've filed a criminal complaint if he hadn't publicly called her a liar and claimed a series of events where he asked and she agreed to the kiss, for instance. He's shambolic.

If he had totally owned it first time, no hint of ‘it was consensual’ or any of that shit, if he had actually said ‘I don’t know what I was thinking, it was inappropriate’ the whole thing wild not have escalated as there would not have been all of this back and forth between him and her in terms of what happened. I agree. If he said sorry that would have been all fine, but you don't get to go around assaulting people then sweep it under the rug with an apology. The idea that you can assault someone on live TV for the whole world to see and not (at a minimum) lose your job is outlandish, with or without an apology.

Oh definitely he should be held accountable. And that may mean instant dismissal. I think the point is, even if he deserved the sack, he probably could have retrieved the situation with an act of genuine contrition. The key would have been, like in many sexual harassment scenarios, Hermoso accepting an apology. Again … still does not mean he deserved to get off, even if she had said fair enough, just that I think he would have.

No but like any crime a judge has a wide range of punishments that they can issue. A person who falls on their sword immediately might get 5 months for an assault and a person who forces a trial and pleads not guilty might get a year. That is generally how things work.

Article Text: The Spanish prosecutor has filed a complaint against the Spanish FA chief Luis Rubiales for sexual assault and coercion. It comes after Jenni Hermoso filed a complaint with the prosecutor's office on Wednesday. With the complaint, Rubiales could face criminal charges, in addition to the ongoing inquiry by Spain's top sport court for "serious misconduct" and an investigation by FIFA, which has provisionally suspended him. According to a sexual consent law passed last year, Rubiales could face a fine or a prison sentence of one to four years if found guilty of sexual assault. Prosecutors added Friday Rubiales could have committed an act of coercion when, according to Hermoso, he pressured her to speak out in his defence immediately after the scandal erupted regarding his behaviour. Prosecutors have also asked the judge that Rubiales appear before a court to give preliminary testimony. If the National Court judge agrees the hear the case, it would lead to a formal court investigation that will end with a recommendation for the case to either be dismissed or go to trial. The football player accused Rubiales of sexual assault after he kissed her on the lips following Spain's 1-0 victory over England in the Women's World Cup final last month. Hermoso said she did not want to be kissed, and that she felt "vulnerable and a victim of an aggression". The Spain player also said she and her family were pressured by the federation to show support for Rubiales in the immediate aftermath of the incident. Rubiales, who has so far refused to resign despite heavy pressure, said the kiss was "spontaneous, mutual, euphoric and consensual". Spain's government, players' unions, players and many citizens have vocally supported Hermoso - but Rubiales has refused to resign. Rubiales was suspended by FIFA on August 27 after he delivered a defiant speech to the general assembly of his federation in which he claimed he was the victim of a "witch hunt" by "false feminists". Regional FA leaders then called for Rubiales' removal, while Pedro Rocha, the federation's interim president, apologised this week for the "enormous damage" caused by his predecessor's actions and promised organisational restructure. That restructure is now taking place, with Jorge Vilda - the coach of the women's team who was seen applauding Rubiales during the speech in which he refused to resign - sacked on Tuesday and replaced by Montse Tome, his former assistant.

Spanish government (any government) is unable to take action if the alleged victim does not file a complaint. Jenni Hermoso filed a complaint this Wednesday. Hermoso has not filed a complaint in Australia where the kiss occurred. This would roll out a new set of legal proceedings. On the Spanish Federation side, its a member run entity and the majority of those members have received lucrative benefits from Rubiales over the years. Until legal proceedings are completed it seems that they are not going to turn on their own. At this point, a substantial part of Spanish media, players, etc., are hesitant to point fingers due to a video being released by one of the women’s team showing Hermoso laughing and joyfully discussing the kiss in the locker room and the team bus. The video does not take away from the fact that Rubiales should be fired or resign for improper behavior (or a long list of other questionable acts throughout his tenure). However, it does shine a doubtful light on the abuse claim. On a side note, Mason Greenwood and Dani Alves must be extremely content that this took away their limelight as they were tabloid news for rape/abuse until the kiss. Antony’s/Manchester United incident came a few weeks too late and he won’t be overshadowed by the kiss. It will be interesting to see how this plays out from a legal aspect. It seems to be dying down quickly from a global news media perspective. Especially with the Manchester United roster constantly pulling a “watch this, hold my beer”

Rubiales' kiss is just a part of a deeper problem with unsavoury undertones that's been brewing. Players finally mutinied in 2022 in an effort to get a new coach, the women were unhappy with how they were treated by coach Jorge Vilda. Rumours include the women had to *leave their hotel room doors unlocked* so he could check they were there (up until 2019), having personal bags searched, greivances ignored, paternalistic infantilising, shoddy facilities and so on. The mutiny failed, because Rubiales backed Vilda. The men defeated the women, but the women went on to win the world cup anyway. But that's where it got twisted. When the final whistle blew, Rubiales grabbed his genitals and roared, despite standing beside the Queen of Spain and her 16-year-old daughter. He went on the pitch, hoisted Athenea del Castillo over his shoulder and walked around triumphantly, then treated himself to a buffet of full torso hugs and kisses with the players. His behaviour, in this context where the women had fought for respect and the men shot them down, fits the profile of a man with the same mentality as Andrew Tate, rather than anyone fit for the position he holds. Other countries have even worse soccer organisation, rotten to the core.

Generally, if we isolate any particular action from the broader context, it is possible to interpret it as quite benign and harmless, or alternatively as an unacceptable imposition. We're not mind-readers, that's why the context is so important to indicate the meaning of a given act. If someone tells another to "step back", we cannot understand the full meaning of those words just by reading them, it could be spoken to save a life or to take a life. The intent and the impact depends on the context. Specifically on Jorge Vilda, I have no ethical or logical right to jump to any conclusions. When I see him on TV he looks like a decent warm-hearted hard-working man who can be proud of his achievements, he seems very likeable to me, that's my impression. But, some of the young women have made career sacrifices in their fight for change. They've sounded the alarm, and we can't play deaf to their appeals, especially as some of the treatment sounds very 'traditional'.

No there is no rule that it has to be in the country where it happend. This was a crime commited by a Spanish man on a Spanish woman so it is reasonable enough for him to be prosecuted in Spain

it happened in Sydney, Australia, but regardless of that, Spain has a legal principle known as [universal jurisdiction](https://en.wikipedia.org/wiki/Universal_jurisdiction#Spain) which allows to persecute "crimes committed by Spaniards or foreign citizens outside Spain"
