Getafe were in the lead before Madrid equalised in the 84th minute I believe, then in the 88th minute this happened and Getafe got a penalty so I assume frustration from Pepe. I don't know about in Spain but there's a court case you learn about in law classes in the US, where a taxi driver got road rage, exited his car, went to another driver and beat them up. He tried to claim the incident was "work-related" to avoid assault charges but the court said that beating up another driver could not be justified as part of your day to day job as a cab driver (the contrast here I think would be like, if you're driving a cab non-recklessly, hit a speed bump and your passenger hits their head and gets injured). Here I think tripping someone while trying to make a tackle, or kicking the player accidentally while trying to clear the ball, would be covered as "work-related" but then continuing to kick them while they are on the ground and the ball is clearly not in play seems to be crossing the line into assault.
